Richards, Director of Community Development DATE: August 9, 1990 (cc meeting 8/15/90) SUBJECT: Status Report Regarding The Vacant Texaco Station At 347 Moorpark Avenue Information Only On July 2 , 1990, the Code Enforcement Officer contacted Mr. Tash regarding the plastic covers and fence down on the above property. A complaint was also filed with the County of Ventura Environmental Health and a letter was sent to Mr. Tash on July 3 , 1990 by the County. On July 25 , 1990 the Code Enforcement Officer sent Mr. Tash a letter regarding the accumulation of weeds , the fallen fence and about keeping the plastic cover secured at all times on the contaminated dirt. Mr. Tash has complied each time the Code Enforcement Officer has informed him of the problem with the fence or the plastic cover blowing off and as of this date, he has removed the weeds. On July 6 , 1990, the County received a letter from E.N.S.R. , Mr. Shaughnessy, regarding the lab test results. On July 20, 1990 , the County responded with a letter to Mr. Tash and E.N.S.R. with comments and requirements that they had to comply with. A meeting was conducted on site (Texaco Station) at 10: 30 a.m. August 6, 1990 with City Officials, and Mr. George Tash, owner, regarding the condition of the property. Mr. Tash stated that he was trying to expedite the excavation of the property and the County was causing the delay and further, that E.N.S.R. had submitted to Mr. Goth, at Environmental Health, a Feasibility Report and a Corrective Action Plan on July 25, 1990 . Mr. Tash stated that E.N.S.R. is ready to start excavation as soon as he has approval from the County. Staff questioned the fencing around the property; it was explained that E.N.S.R. would require Mr. Tash to install a new chain link fence to secure the area, once the work 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council August 9, 1990 Page 2 has begun. Staff stated a contact would be made to management at the County Environmental Health and ask them to expedite their process in reviewing the reports from E.N.S.R. . As a final note, the weeds have been cut down on the site. Staff will continue to keep the City Council advised on the status of this matter in the future. Staff Recommendation Receive and file. The fence placed around the tank excavation has breaches on the north and east side of the property. The fence is inadequate and needs to be secured immediately. This inadequate fence presents a safety hazard. If you have any questions, please contact me at (805) 654-3524, between the hours of 8 : 00-9: 30 am. or 3 : 30-5: 00 p.m. , Monday through Friday. HARE City Treasurer July 25, 1990 Mr. George Tash 5777 Balboa Canyon Road Moorpark, California 93021 RE: Texaco Station, 347 Moorpark Avenue, Moorpark, CA 93021 Dear Mr. Tash: The City is aware that you are in the process of removing the contaminated dirt and filling the holes on your property. Now the property, listed above, has become a sight nuisance. The weeds have grown out of control on your property. We are asking you for your assistance, while you are waiting for approval for the clean-up on your property by keeping the plastic covers secured at all times, inspecting and insuring that the fence is tight and upright and most of all , the keeking weeds around your property clear. The City has received a complaint regarding this issue and this matter cannot wait until you or your contractor starts excavation or removal of the dirt. After a review of this report, the following comments are made: 1. In completing the site assessment, the full extent of the contamination plume both laterally and vertically must be determined. 2 . After the full extent of the contamination has been determined (the Site Assessment) , a Feasibility Study of alternative corrective action options is required. A feasibility study identifies and evaluates all feasible alternatives for cleaning up the site and remedying threats to public health and safety. The effectiveness of an alternative shall be evaluated using the following criteria: (1) human health and safety risk, (2) ground or surface water polluted, (3) beneficial uses affected, (4) contamination to ground or surface water. Secondary criteria include: (1) availability of alternative water supply and (2) vulnerability of the water supply. Cleanup and remedial action options may include the following or other actions, in any combinations: (1) excavation, (2) leave in place, (3) enhanced bio- degradation, (4) soil venting, (5) free product removal, (6) air stripping, (7) treatment at individual water supply hookup, (8) replacement of water supply, and (9) relocation of residents. If excavation is selected as the option to remediate the soil contamination, describe the extent of the excavation and calculate the approximate cubic yardage to be excavated. This can be illustrated on site plan. 4. A quarterly sampling program of the three (3) monitoring wells will be required. The first set of water samples shall be taken no later than September 1, 1990, and the laboratory analyses submitted to VCEHD within twenty (20) days. 5. Pursuant to Ventura County Ordinance Code Section 4528 (a) , you are required to submit a Corrective Action Plan within thirty (30) days or a Request for Extension of Time to Submit Corrective Action Plan. Enclosed for your convenience are the appropriate forms for either option. County Ordinance prohibits any correction action without prior approval of a Corrective Action Plan by the Ventura County Environmental Health Division. 6. Describe where the background total lead locations for item #9 of VCEHD letter dated May 11, 1990, can be found. 7. All work shall be performed per the guidelines found in the State LUFT Manual (October 1989 edition) and VCEHD Leaking Underground Tank Reference Manual. 8. An inspector from VCEHD must be present during site work. Please call (805) 654-3524, forty-eight (48) hours in advance, to schedule an appointment. 9. Submit copies of all correspondence with this Division to: Los Angeles Regional Water Quality Control Board 101 Centre Plaza Drive Monterey Park, CA 91754-2156 Attn: Mr. Joshua Workman California Code of Regulations Title 23, Section 2652 requires that the above-mentioned information be submitted in report form to this Division. Submit said report by September 1, 1990.
