SUBJECT: Consider Waiver of Park Rental Fees for
Moorpark Kiwanis Club Softball Tournament
Susan Wesner, President, Moorpark Kiwanis Club, is requesting
waiver of rental fees for use of the softball diamonds at
North Meadows and Peach Hill Parks for a softball tournament.
The tournament is scheduled to be held on Saturday, September
29, from 7:00 a.m. to 7:00 p.m. Funds received from this
tournament will be used for various special projects which
will directly benefit the residents of Moorpark. Kiwanis has
cosponsored the City's Easter. Egg event the past two years.
This tournament will not disrupt City recreational softball
play as we do not schedule games on Saturday. However,
should Kiwanis request to expand tris tournament to two days,
Saturday and Sunday, it wou]('. rter,`ere with City league
games on Sunday.
Fees requested to be waived are as fol_ows:
Softball fields (2) at $2.50 /hr. x 20 hours $ 50.00
Bases - 2 sets at $2.50 /hr. x 20 hours $ 50.00
Base deposit $100.00
Total fees requested to be waived: $200.00
Direct staff as deemed appropprir,te.

Dear Mayor and Councilmembers:
The Moorpark Kiwanis Club is planning a Men's Slo -Pitch
softball tournament for Saturday, September 29, 1990. We
have reserved use of the softball field at Peach Hill Park
and one of the two fields at North Meadows Park from 7 a.m.
to 7 P.M. This tournament is planned as a fundraiser for our
club with proceeds to be used for various special projects.
We anticipate approximately 16 teams to participate.
The Kiwanis Club requests the City assist us in our endeavor
by waiving the rental fees for the two fields. In the event
the lights are used at Peach Hill Park, we would pay for such
use at the applicable hourly rate. In addition, we request
use of two sets of bases, field drag, liner hoses and a
landscape rake stored at Peach Hill Park and permission to
operate a concession stand at Peach Hill Park during the
tournament. We are aware that alcohol consumption is
prohibited in City parks.

Subject: Certification of the Carlsberg Specific Plan Final Ent
Dear Pat:
The options available to the Citv for cmtificWm of the Final EIR, as we currently
understand the projects, issues artd CBQA requii+emaats are summarized below. We will
also be available to discuss the alternatives with you when we arrive. Please call us if
you would like us to meet you prior to the meeting..
Our initial comments address only the won of the current FIR, for the project
as defined in the specific plan f EIR. We recommend that the Final ER be certified for
the project as proposed, as long as the procedures required by C EQA are followed
closely. Please note that this includes the requirements of Section 15090 of the CBQA.
Guidelines, that the lead agency "review and consider th information contained in the
final EIR," and that the lead agency "manes one or more written findings for each
significant effect," as outlined in Section 15091. We have also recommended that a
Statement of Overriding Considerations (Section 15093) be considered for traffic and air
quality issues, as listed on page 119 of the Draft EIR. AB 3180 also requires adoption
of a mitigation monitoring program concurrently with making the findings. We would
recommend certification of the Final ED?, only when these procedures are followed
Based on Cheryl Kane's comments on the ovkio>s of the City's contract with Carlsberg
Corporation, it would be possible to certi�y the Final ER for the current project, deny
the proposed project, and use the extension, provisions to proceed to identify any new
requried -environmental documentation for the cblanged project.
When a project changes, the three options for environmental documentation are an
adendum for minor changes only, and a supplement or subsequent EIR for a changed
project. We recommend a supplement be prepared for the revised project because the
changes proposed are not minor. For example, the graded area has changed, the
removal of biological resources has changed, the development mix has changed and most

topical areas of the Draft EIR will be substantially changed. While a school was
referenced in the DEIR as a preference, it was not included in either the land plan or
the traffic analysis. We would conclude that the current Final EIR is not adequate or
sufficient documentation for the "nevi" project. In addition, the mitigation measures
recommended for the current project may not be appropriate for the ' new" project. In
any event, the comments mentioned above in regards to findings, mitigation monitoring
and Statment of Overriding Considerations must be prepared for the new project.

As I mentioned at the last public hearing, there are a few revisions we would like to add
to the public record prior to any certification of the Final EIR. Specially, the four items
are:
1. Pages 101 - 102 of the Draft EIR, Mitigation Number 2. Delete the last sentence
of the mitigation measure, which states: 'The city and the library district shall
negotiate a total library contribution per capita prior to certification of the Final
EIR."
2. Page S of the Final EIR, Response 1 - 32. Revise the first sentence of mitigation
number 3 to specify the widening of New Los Angeles Avenue is "to six lanes,"
as recommended in the Traffic Technical Appendix.
3. Page 12 of the Final EIR, Response 3 - 5. Revise the last sentence of the
response by adding the word "site ", so the sentence states "...is the site for the
middle school preferred by the school district."
4. Page 17 of the Final EIR, Response 10 3. Revise the year stated in the last
sentence, so the sentence states: Since the 1995 population will be less than the
1995 AQMD forecast, the project is consistent with the AQMD (see Response 10 -
5 below).
Following your review, please transmit these comments to the City Council.

To whom it may concern:
I have reviewed the draft environmental impact for Million Bell Plaza
and Greenleaf Apartments in Moorpark.
I am extremely concerned about the short: term and long term emissions
generated by this project and the health impacts they would create for
my patient, Barbara Shultz.
Ms Shultz has been a patient of mine since 1981. During this time, she
has had a history of chronic bronchial problems and severe sinus infect-
ions, in addition to allergic reactions. I feel it would be very unhealthy
for her to reside next to a project of this magnitude because of the
fugitive dust generated during grading activities and the high levels
of ROC and NOx generated by the project once it is completed.
Although mitigation measures addressed in the EIR would be helpful,
they would not solve my patient's problems.
My recommendation would be the installation of a central air conditioning
system in Ms Shultz's home so the windok,s could remain closed to reduce
the impact on her health as much as possible.
