SUBJECT: Consider Authorizing City Manager to Sign Owner's Certificate on
Behalf of the City of Moorpark for Lot Line Adjustment No. 2014-03
Located at the Northeast Terminus of Fremont Street
BACKGROUND
On April 6, 2005, the City Council approved a General Plan Amendment, Zone Change,
Vesting Tentative Tract Map, and Residential Planned Development for 99 duplex style
and detached condominium dwellings on 15.13 acres, located at the terminus of
Fremont Street, south of Los Angeles Avenue (Hwy 118) and east of Majestic Court on
behalf of Shea Homes. The Residential Planned Development subsequently expired
and was resubmitted and approved on June 15, 2011. This project, known as Ivy Lane,
is nearing completion of construction and the developer is finishing project obligations.
A 1.22 acre lot, which is a part of this project, includes all of Fremont Street, an area for
4 homes with access from Fremont Street, and a five to ten-foot wide strip of land on
the east side of the Fremont neighborhood, extending to Los Angeles Avenue. This
unusual situation is being cleaned up by this project, with Fremont Street remaining a
private street to be maintained by the Canterbury Lane/Ivy Lane Homeowner's
Association. The five to ten-foot wide strip of land was designed to be conveyed to the
adjacent properties on Fremont Street, to extend the rear yards.
In order to effectuate this conveyance, Shea Homes has been processing Lot Line
Adjustments between the affected lots. The California Subdivision Map act allows a Lot
Line Adjustment between four or fewer existing adjoining parcels, where the land taken
from one parcel is added to an adjoining parcel, and where a greater number of parcels
than originally existed is not created. Lot Line Adjustments are approved by the
Community Development Director if they meet these criteria and demonstrate
compliance with the General Plan, any applicable Specific Plan, and Zoning and
