Richards, Director of Community Development( DATE: August 27, 1990 (CC meeting of 9/5/90) SUBJECT: STATUS REPORT CONCERNING RPD-89-1, LDM-89-2, CPD-89-1 AND CPD-89-2 Background The purpose of this memorandum is to keep the Council informed of progress on this matter since the last City Council meeting. At the City Council meeting of August 15, 1990, concerning the above referenced projects, the Council passed a motion to continue the public hearing for these projects to the Council meeting of September 19 , 1990 . The Council also passed a motion to have staff initiate a General Plan Amendment, to be paid for by the applicants, to revise the Circulation Element to show Gisler Road (Liberty Bell Road) terminating at Lassen Avenue. The Council also directed that the Planning Commission hold a public hearing on the General Plan Amendment and make a recommendation to the City Council no later than October 8, 1990. Discussion The following is a chronology of events since the Council meeting of August 15, 1990: CPD's 89-1 and 89-2 The Director of Community Development held a conference call with the City Engineer and Eric Sakowicz from Impact Sciences on Tuesday August 21, 1990 to discuss the scope of the expanded Traffic Study. Consensus was made concerning the content of the expanded scope of work. (See attached memorandum from City Engineer) . - The applicants are in the process of revising the western portion of the commercial site so that the square footage is consistent with the project described in the Environmental Impact Report. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council August 27, 1990 Page 2 - The revisions to the plans are to be completed by Monday August 27, 1990 . As of the writing this report, staff has not yet seen the revised plans for the commercial site. - Richard Devericks met with the Director of Community Development on Thursday August 23, 1990 to discuss the sign program for the proposed shopping center. - Eric Sakowicz has been in contact with the EIR traffic consultant concerning the time schedule and the cost for revising the Traffic Study to address the termination of Liberty Bell at Lassen Avenue and other project revisions . The traffic consultant has identified that the study would take them two months to complete and that the cost would be $15,000 . They apparently have other contract obligations that prevent them from completing the study any earlier than two months from now, and suggested that the City's General Plan Update traffic consultant, Austin-Foust, may be able to provide this information to the City. The Director of Community Development met with the two Senior Planners on August 23, 1990 to discuss the appropriate Environmental document for the proposed General Plan amendment. It was the opinion of the Director of Community Development that the General Plan amendment and the revised residential project would require a revised EIR project description and impact analysis, but that the Draft EIR would only need to be recirculated if the EIR consultant identified that the revised project would result in any new significant environmental impacts not previously identified. If the Draft EIR needs to be recirculated for a 45 day review period, this review could not be accomplished before the expiration of the extended processing time limit on November 16, 1990 . RPD-89-1 Staff met with the architect for the residential project, Neil Scribner, on August 21, 1990. Mr. Scribner submitted a revised residential site plan on August 22, and a copy has been forwarded to the EIR consultant and is attached for your information. This is just a conceptual site plan and no elevations, floor plans, conceptual landscape plans, etc. , have been submitted for the revised project. Because the revised residential project would require a tentative subdivision map and only limited information is available regarding project details, the City Council could not take final approval action for this project until all required 2 The Honorable City Council August 27, 1990 Page 3 information is filed. It is our understanding that the applicant is requesting conceptual approval of the revised site plan at this time. Recommendation Receive and file. Knipe, City En inee AUG 2 4 90 9 Date: August 22, 1990 '; CITY OF MOORPARK Subject: ADDITIONAL TRAFFIC INFORMATION MISSION BELL PLAZA During our August 17, 1990 conference call with Eric Sakowicz of Impact Sciences, Eric requested, in writing, the additional traffic requirements needed for this project. These traffic study requirements are as follows: 1 . Provide average traffic volumes (ADT) for the regional use of Liberty Bell Road if extended to Poindexter Avenue. This usage would be other than project traffic. The need for this information is twofold: o To determine the need/justification for the street extension. • o To provide sufficient analysis to support a General Plan Amendment to delete the segment between Lassen Avenue and ., Poindexter Avenue if that segment is deemed unnecessary. 2. Will the usage in No. 1 change if the two commercial centers (Mission Bell Plaza and Town Center) are connected? 3. How will Gisler Field (the commercial property to the west) connect to Liberty Bell Road through the western commercial portion of the Macleod property? 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 Page 2 4. An estimate of specific turning movements into each of the three sets of driveways along Liberty Bell Road through the commercial area. In addition, specific road sections should be recommended for each segment between driveways along Liberty Bell Road between Los Angeles Avenue and Lassen Avenue. A plan view sketch of Liberty Bell Road should be prepared. HARE City Clerk MEMORANDUM City Treasurer TO: The Honorable City Council FROM: Patrick Richards, Director of Community Development DATE: August 31, 1990 SUBJECT: GENERAL INFORMATION RECEIVED ON AUGUST 31, 1990 FROM IMPACT SCIENCES REGARDING CITY COUNCIL REQUESTED INFORMATION RELATED TO ENVIRONMENTAL DATA FOR MISSION BELL PLAZA AND GREENLEAF APARTMENTS The attached letter from Impact Sciences to the Director of Community Development received on August 31, 1990 indicates that preliminary information requested by the City Council can be available at the September 19 , 1990 City Council meeting. The letter further states that the development of this additional information is not considered as part of the consultants (EIR) contract with the City and that the costs associated with the development of this information would be approximately $6,000 . A quantified and complete response to the concerns are estimated to cost approximately $30,000. It is the consultant's opinion that it may be more cost effective for the City to retain Austin Faust and Associates to prepare the required traffic data as many of the traffic concerns are associated with general circulation issues that may be integrated into their traffic model. At that meeting the City Council took additional testimony from the general public and identified a number of issues where the Council concluded that additional information was necessary before an informed decision on this project could be made. These issues are generally defined below. • identification of an accurate project description • the impact of that project on the traffic environment and other environmental issues • connections of commercial centers to the east and west,and the impact of that modification on regional traffic • the regional traffic impacts associated with the deletion of Liberty Bell Road as a through street to Poindexter • the impact associated with changing the residential project from apartments to ownership type units • the air quality impact of the project considering this project's capturing of additional commercial business and automobile trips • the air quality impacts associated with projects of smaller scale Our offices, in combination with subcontractors associated with this project, have concluded that "preliminary information" in response to these City Council concerns can be available for their regular meeting of September 19, 1990. However, this preliminary information is not considered part of our Environmental Impact Report (EIR) contract with the City. The costs associated with the development of this information would be relatively small (estimated at $6,000.00), but we would require your verbal authorization to proceed followed by a formal contract amendment. s r '+b r 1111 As we have discussed with you, a quantified and complete response to these concerns would be very costly (estimated to be as much as $30,000).
