ACTION:.____ / , - MINUTES OF THE CITY COUNCIL February 3, 2016 A Special Meeting of the City Council of the City of Moorpark was held on February 3, 2016, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:31 p.m. 2. ROLL CALL: Present: Councilmembers Mikos, Millhouse (arrived at 6:35 p.m.), Pollock, Van Dam, and Mayor Parvin. Staff Present: Steven Kueny, City Manager; Deborah Traffenstedt, Assistant City Manager; David Bobardt, Community Development Director; and Joseph Fiss, Economic Development and Planning Manager. Kevin Ennis, City Attorney, and Alison Krumbein with The Sohagi Law Group joined the meeting at 6:42 p.m. via conference call. 3. PUBLIC COMMENT: None. 4. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 5. PRESENTATION/ACTION/DISCUSSION: A. Consider Authorizing the City Manager to Sign Owner's Certificate on Behalf of the City of Moorpark for Lot Line Adjustment No. 2014-03. Staff Recommendation: Authorize the City Manager to sign the Lot Line Adjustment No. 2014-03. Mr. Fiss gave the staff report. Mayta Welnak-Welbat commented that Shea Homes had a settlement agreement with her to build a road to access her private property, and she wanted the City to assist in requiring Shea Homes to comply with the agreement. 10 Minutes of the City Council Moorpark, California Page 2 February 3, 2016 Mr. Fiss explained that there is a recorded access easement through the Shea Homes property and that part of Ms. Welbat's property is in the arroyo. Mr. Kueny stated that this private property access issue is not related to the lot line adjustment that is under consideration, and that the City did not have the authority to require enforcement of the private agreement she was referencing. Mr. Kueny said City staff will try to facilitate a meeting with Shea Homes and Ms. Welbat. MOTION: Councilmember Pollock moved and Councilmember Mikos seconded a motion to authorize the City Manager to sign Lot Line Adjustment No. 2014-03. The motion carried by unanimous voice vote. 6. CLOSED SESSION: Mr. Kueny requested the Council go into closed session for discussion of one case under Item 6.B. on the agenda. Mr. Ennis and Ms. Krumbein joined the meeting. The time was 6:42 p.m. MOTION: Councilmember Van Dam moved and Councilmember Millhouse seconded a motion to adjourn to closed session for discussion of one case under Item 6.B. on the agenda. The motion carried by unanimous voice vote. B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation (Pursuant to Paragraph (4) of Subdivision (d) of Government Code Section 54956.9: (Number of cases to be discussed — 4) Present in closed session were Councilmembers Mikos, Millhouse, Pollock, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Kevin Ennis, City Attorney; Alison Krumbein, The Sohagi Law Group; Deborah Traffenstedt, Assistant City Manager; David Bobardt, Community Development Director; and Joseph Fiss, Economic Development and Planning Manager. The City Council reconvened into open session at 7:17 p.m. Mr. Kueny announced that there was no action to report, and that the Council would be going back into closed session for a second case under Item 6.B. MOTION: Councilmember Pollock moved and Councilmember Millhouse seconded a motion to adjourn to closed session for discussion of one case under Item 6.B. on the agenda. The motion carried by unanimous voice vote.
