Richards, Director of Community Development DATE: August 30, 1990 (cc meeting 9-19-90) SUBJECT: Landscape Architecture Plan Checking Services Background On June 6, 1990, the City Council terminated its Landscape review contract with Wolf Breiman and directed Staff to obtain temporary services of a landscape architectural firm. Council also directed Staff to create a new RFP and send it out as soon as possible. In the interim, temporary services were to be provided by a contractor on a limited short term basis. On July 2 , 1990, the City hired David Barwick, an independent Landscape Architect, to provide interim services. On July 16, 1990, Staff mailed requests for proposals (RFP) to thirteen (13 ) landscape firms (see attached) . piscussion Of the thirteen (13) firms an RFP was sent to, only four (4) responded. Those who responded are as follows: 1. Harris & Associates; Los Alamitos 2. John K. Innes, Landscape Architect; Simi Valley 3. B. S. I . Consultants, Inc. ; Santa Rosa 4 . David H. Barwick, Landscape Architect; Simi Valley Staff has reviewed each of the proposals as they relate to the RFP and have found that all four firms addressed the ingredients required by the City for consideration. At this time, the current contract with Mr. Barwick will expire on September 30, 1990. The current deposit for landscape plan check and inspection services is $500. Seventy-five (75%) percent of the plan check deposit is available to the contractor. The City's charge rate is the contractors hourly rate plus the City's administrative overhead of 25%. The hourly charge rate proposed by those firms who responded are as follows: 1. Harris & Associates $50 to $130 range per hour 2. John Innes $50 per hour 3. B. S. I. $55 to $125 range per hour 4. David Barwick $37 per hour After reviewing the four (4) proposals, it is Staff's opinion that the firm of David Barwick, Landscape Architect can provide landscape plan check and inspection services at the lowest possible cost. With a contractors charge rate of $37 per hour, the billing rate for Mr. Barwick's service would only be $50 including City's administrative costs. Staff Recommendation That the City Council award the Landscape Architect and Plan Check Service contract to David Barwick, Landscape Architect and authorize the Mayor sign a contract for a $37.00 per hour rate. HARE City Clerk City Treasurer REQUEST FOR PROPOSAL LANDSCAPE ARCHITECTURE PLAN CHECKING SERVICES The City of Moorpark is soliciting proposals from a select group of professional consultants to provide a full range of Landscape Architecture Plan Checking and Inspection Services. This proposal is intended to provide not only plan checking in the traditional sense but to bring forth concepts and ideas to improve landscaping opportunities from those plans reviewed. Background The City of Moorpark has been providing landscaping review of residential, commercial and industrial under consultant contract since it's incorporation in 1983 . The City has no adopted landscape standards but relies upon the Ventura County's Landscape Guidelines . Project review has been on a case by case basis. The City has adopted a tree preservation ordinance and is very sensitive towards the removal of mature trees. A number of trees are considered historically significant. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 RFP - LANDSCAPE ARCHITECTURE July 16, 1990 Page 2 SCOPE OF WORK The consultant' s scope of work relative to the proposal is outlined as follows: 1. To review landscape plans submitted to the Department of Community Development in conjunction with proposed development plans . 2 . Such review shall include verifying compliance with industry standards, established city landscape policies, Ventura County Landscape Guidelines, Municipal Code requirements including the suitability of the proposed irrigation plans. 3 . The formulation of necessary conditions for the proposed project per request. 4 . Conduct site inspection as part of the review process and also perform site inspections to determine compliance with plans after approval by the City. 5. Initial inspections shall be within three (3) days of receipt of a work order from the Director of Community Development. 6 . Prepare such reports and attend Planning Commission and/or City Council meetings as may be required by the City from time to time. 7 . Provide all equipment and personnel necessary to complete each work task in a timely manner. 8. Professional services to be provided are to be actually performed by or shall be immediately supervised by a Landscape Architect licensed to practice by the State of California. 9. Monthly project status reports shall be given to the Director of Community Development in a form to be approved by such. c: \contract\lndrfp RFP - LANDSCAPE ARCHITECTURE July 16 , 1990 Page 3 FORMAT FOR RFP RESPONSES The proposal shall include the following information prepared as an original and provide ten ( 10) copies. 1. Transmittal letter. 2. Statement on how liaison and coordination is to be maintained with the city staff and the applicants landscape architect. 3. Identification of who will be responsible and other key personnel. The city will maintain the right to terminate the agreement if a change in management occurs or key personnel change. 4 . Identification of any subcontractors to be employed. 5. Resume of project manager and/or key personnel. 6 . Breakdown on hourly rate for project manager and/or key personnel. 7 . Statement on how monthly status reports will be given to the city. 8 . Statement on how billing will be accomplished. c: \contract\lndrfp • RFP - LANDSCAPE ARCHITECTURE July 16 , 1990 Page 4 LEGAL AND INSURANCE REQUIREMENTS The following are the Legal and Insurance requirements of the City of Moorpark: 1 . This RFP and the consultants response will be a part of the contract; 2 . Documents to Construed Together - The RFP, the Consultant's Proposal, and all documents referred to in the specifications and contract to be entered into between the consultant and he city, and all the modifications of said documents, shall be construed together as one document; 3 . Assignment or Transfer of Contract - The consultant shall not assign, transfer, convey or otherwise dispose of his contract, or his rights, title or interest in or to the same without previous written consent of the city; 4 . Indemnity - The consultant must agree to indemnity hold harmless and defend the city from any and all liability or loss, resulting from any suits, claims or actions brought against the city, which result directly or indirectly from the wrongful or negligent actions of the consultant in the performance of the contract; 5. Insurance - At the time of execution of the contract the consultant will be required to carry at least $1 million dollars of general liability insurance and to name the city as additional insured. A submittal of less that $1 million insurance limits are permitted, however, you must s specify the actual insurance limits you propose to provide. You must also state whether or not you can provide a $1 million limit if required to do so and at what cost. If less than $1 million is specified, please indicate what component(s) of your proposal, in your opinion, offsets or mitigates the higher insurance limit. An insurance limit of less than $1 million may affect your evaluation; 6. Compliance with Labor Laws - Consultant will be required to comply with all existing State and Federal Labor Laws including, but not limited to workers compensation; c: \contract\lndrfp RFP - LANDSCAPE ARCHITECTURE July 16 , 1990 Page 5 7 . Disadvantaged and Equal Opportunity Employment Provisions - Consultant will be required to meet all State and Federal Laws applicable to Disadvantaged and EEO; 8 . Proposals are due by 5:00 P.M. AUGUST 6, 1990 2 . The city reserves the right to reject any or all proposals without qualification. Proposals will only be considered in their entirety and the city reserves the right to determine the completeness of said proposals. Late proposals will not be considered. No amendments, additions or alternates will be accepted after the above submission date; 3. The city reserves the right to negotiate the specific requirements of the contract and the cost using the selected proposal as a basis; 4 . The consultant firm is responsible for any costs incurred by the firm, or their subcontractors, in responding to the request for proposal; 5. Each proposal shall be considered valid and binding on the proposer for a period of ninety (90) days after the proposal due date. Barwick PROPOSAL RFP — LANDSCAPE ARCHITECTURE I propose to offer landscape architectural plan review and inspection services to the City Of Moorpark based on the following: 1 . Liason and Coordination Determine which city agencies are affected by proposed plans and make reference , in the review process , to their concerns . Make personal telephone calls to applicants landscape architects and ask for clarifica— tion or justification of proposed design parameters . Meet with applicants ' landscape architect if necessary to expedite the review or inspection process . 2 . Responsible Party David H . Barwick will be the sole responsible party . No other party is authorized to act on his behalf . 3 . Subcontractors No subcontractors are to be employed by responsible party . 4 . Resume See attached . 5 . Hourly Rate The hourly rate shall be $37 . 00 base on portal to portal time for both review and inspection services . 6 . Status Reports Status reports shall be in writing or typed and shall give the current status of all projects either in review or progress and mailed to the Director Of Community Services at the end of each month . 7 . Billing Invoices shall be submitted at the end of each month for work performed during that month . Generally a statement indicating the status of current billings will accompany such invoices . 8 . Insurance • I propose to carry liability insurance in the amount of Five Hundred Thousand Dollars ( $500 ,000) . It is my opinion that the Million Dollar policy= would be a financial burden not sufficiently compensated for by the work involved . . March 1968 to March 1986 Employed by Bechtel Corporation in the development of a 3000 acre planned community at Calabasas Park , a project featuring residential , commercial and recreational facilities . Recreational features included several hundred acres of parks and open space together with lakes and a champion- golf course . My responsibilities ranged from the physical design of the project through construction to management of the properties after construction .
