Richards, Director of Community Development DATE: September 7, 1990 (CC meeting of 9/19/1990) SUBJECT: LOT LINE ADJUSTMENT NO.90 -2 (MARLA BROSSARD) Background On April 4, 1990, the applicant (Marla Brossard) applied for two lot line adjustments under Lot Line Adjustment No. 90 -2. The first adjustment is between Assessor Parcel No.512 -05 -22 (a portion of Parcel Map no. 3930) and Assessor Parcel Nos.512 -05 -04 and -05 (Attachment 1) . The second adjustment involves Assessor Parcel No. 512 -05 -23 (Parcel 2 of Parcel Map no. 3930) or Parcel B and Assessor Parcel No. 512 -05 -22 (Parcel 1 of Parcel Map no. 3930) or Parcel A (Attachment 2). The application was deemed incomplete on June 28, 1990 because of missing documents and corrections that were needed to make it complete. The second application was not completed until August 16, 1990 when all the corrections pertaining to the second submittal were made per direction of the City Engineer. Discussion The applicant's first lot line adjustment would involve a shift of 5.25 feet of property line so that Assessor Parcel Nos. 512 -05 -04 and -05 (Parcel C - Bowen's property) would gain 525 square feet of land from Assessor Parcel No. 512 -05 -22 (Parcel A - Brossard's property). The purpose is to place the block wall which was inadvertently built on Brossard's property on Bowen's property site. The shifting of the property line would reduce the common driveway of the two flag lots (Parcel A and Parcel B) from 50 feet on Wicks Road frontage to 30 feet to the north. The 30 foot width would still exceed the City's Subdivision Ordinance minimum requirement of a 20 foot common d3-i.veway 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 LLA 90 -2 September 7, 1990 Page 2 The second adjustment would involve an addition of 4800 square feet of land to Parcel B from Parcel A. The purpose of this adjustment is to relocate the Fire Department turnaround, which is partially on Parcel A, entirely on Parcel B for which the turnaround was intended. The Lot Line Adjustment complies with the City of Moorpark Ordinance Code in that neither a greater nor a lesser number of parcels than originally existed has been created, and the resulting lots would conform to all the applicable Zoning and General Plan requirements. The Lot Line Adjustment would not cause a conforming lot to be made nonconforming with the applicable zoning, and general plan. It is also consistent with the public health, safety, and welfare. The Director of Community Development has reviewed the proposed Lot Line Adjustment and intends to approve it. Pursuant to Resolution No. 88 -523, the Director has the authority to approve lot line adjustments. This matter is being presented to the Council as a courtesy. In the event the Council wishes to appeal the Director's decision, it may do so. Should the Council desire to appeal, it should set a public hearing date.
