Gilbert, Director of Public Works C DATE: September 7, 1990 (Council Meeting 9- 19 -90) SUBJECT: Consideration of Options for the Construction of Improvements to Bonnie View Street OVERVIEW This report discusses certain factors relating to the improvement and maintenance of Bonnie View Street. BACKGROUND Bonnie View Street is a narrow road, intersecting Charles Street, serving certain residential properties on the hillside northeast of Charles Street and Magnolia Avenue. The roadway was created many years ago by a series of land divisions. The width and other geometrics of the roadway are inconsistent with present day design standards. The question of future maintenance and improvement of the roadway offers a series of questions and problems. DISCUSSION A. Title to the Street It would appear from the design, condition and maintenance of the road, that Bonnie View Street was a private road. In order to clarify this question, the City ordered the preparation of a title report to determine the true condition of the title to the roadway. The findings of that report are summarized on Exhibit "A" attached. As you can see from this map, a significant portion of Bonnie View Street is owned (in fee lDr easement) by the City. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 City Council Bonnie View Street Page 2 B. Location of Existing Street Improvements The portion of the right -of -way utilized for street purposes is shown on Exhibit "B ". A survey of the street improvements was performed to determine the location of the right -of -way lines in relation to the street improvements. The street improvements lie within the right -of -way lines with the exception of the turn at the northwest corner of Lot 9. Any additional improvement at this turn could require the acquisition of additional right -of -way to accommodate a wider turning radius. C. It varies between ten and twelve feet (10' - 121) in width. Vehicular traffic is limited to one -way travel. In addition, the street is very steep in places. Use of the street by large trucks is difficult to impossible as demonstrated by the fact that refuse collection trucks will not travel on the street. Residents on Bonnie View Street must transport their trash cans to Charles Street to have their trash collected. E. Street Addresses The layout of the street makes it difficult, at times, to locate a particular house address. The Fire Department has recognized this problem and has required, as a prerequisite to the issuance of any new Building Permits (refer to the following Section F), the placement of address numbers clearly viable from the street. A map showing the house address is attached as Exhibit "C ". City Council Bonnie View Street Page 3 F. Fire Department Standards 1. Access: Section 13.208 of Ventura County Fire Protection District Ordinance No. 12 (adopted December 1977) states that all structures shall be served by an all weather access road of not less than twenty feet (201) of unobstructed width, with a turning radius capable of supporting fire suppression equipment having a minimum vertical clearance of thirteen feet six inches (13' 6 "). The existing street improvements on Bonnie View Street do not meet these minimum standards. 2. Additional Requirements: Because of this sub - standard access, the Ventura County Fire Department has, in recent years, imposed additional requirements on the issuance of Building Permits for certain properties on Bonnie View Street (see Exhibit "C ") . Roadway Design Geometrics The method by which this roadway evolved has resulted in the creation of some very substantial roadway design problems. To summarize, the existing roadway has a fairly steep grade, combined with very short turning radii, within a less than adequate right -of -way width. These conditions are not consistent with present -day street design standards. City Council Bonnie View Street Page 4 H. Street Construction and Maintenance Staff was unable to determine from City /County records, the thickness or composition of the structural cross section of the existing asphalt pavement. It is very possible that the asphalt pavement construction is substandard -- possibly a few inches of asphalt applied over native soil. It also appears that the roadway has received very little maintenance in past years. Any future maintenance, which may be undertaken by the City or others, will be made even more difficult and expensive than that required of a standard street, due to the street lay out and design factors previously discussed. I. Future Improvements 1. Alternates The various possible approaches to be considered in preparing a design for the improvement of Bonnie View Street, could be viewed as falling into three separate levels of effort: Alt. #1: Minor improvements (2" to 4" asphalt overlay) to be constructed within the present pavement width; Alt. #2: Major re- construction (new base and asphalt) of the street within the present right -of- way width; or, Alt. #3 Major re- construction requiring the acquisition of additional right -of -way and the construction of retaining walls. 2. Cost Estimate Be advised that there has been no extensive engineering analysis of roadway conditions or improvement design constraint factors. A preliminary estimate of the cost to construct Alternate #1 is $10,000 to $15,000. A more in -depth engineering analysis is required to develop cost estimates for Alternates #2 & #3. Properties Served A profile of the number of properties now being served by Bonnie View Street is as follows: Number of lots ..................... 11 Numberof residences ............... 10 Some of these lots are large enough to be subdivided thereby creating additional properties served by Bonnie View Street. It is anticipated that the no more than six to eight additional lots could be created in this way. K. Development Process The construction of streets usually occurs as a function of development. This typical development process did not apply to the recent construction of a number of houses on Bonnie View Street. Pursuant to the County Codes which have been adopted by the City, the owner of any legal lot may apply for and receive a Building Permit with no requirement on the part of the permittee to construct street improvements. Under these existing regulations, the City could not - as it does with a typical development application -- require the builder to construct off -site improvements. The net result has been that the builders of these newer houses on Bonnie View Street did not sustain the street improvement costs normally associated with residential development. L. Options 1. Street Vacation When certain conditions are met, some jurisdictions vacate public streets which do not provide general benefit to the traveling public. Such streets would be best characterized a joint use driveways. Upon vacation, the such a street would becomes a public safety /access /util.ity easement. City Council Bonnie View Street Page 6 It could be said that Bonnie View meets the criteria for this type of redesignation. It is also possible that the residents on Bonnie View Street may support action leading to their joint control and ownership of the access road serving their property. Staff recommends that this question be pursued. 2. Street Maintenance (Gas Tax) Funds The improvement of Bonnie View Street could be paid for by Gas Tax Funds. However, it is possible that these improvements could require major street reconstruction. Major street construction or reconstruction projects which benefit only a small number of properties are not normally funded by general street maintenance revenues. These funds are normally reserved for minor local street projects (i. e. Slurry Seal) or for major projects which provide general benefit to the Community. 3. Assessment District The maintenance or improvement of Bonnie View Street could be funded (in part or in total) through the formation of a Maintenance or Improvement District. In this way, the properties which derive the direct benefit from the improvements to be constructed, are assessed for (all or a portion of) the cost of those improvements. The down side of Assessment District formation is the "up front" investment in preliminary design and assessment engineering costs. The City would have to expend a considerable amount of money on the development of a preliminary design, a construction cost estimate and an estimated assessment amount, prior to the public hearing on the formation of the district. This would be done with no assurances that project formation would be supported by a majority of the land owners affected. City Council Bonnie View Street Page 7 It is recommended that the City Council direct staff to... 1. Install street address directional signs on Bonnie View Street. 2. Prepare a "rough" cost estimate for each of the project Alternates described above. Note: The project cost estimates are required in order to develop estimated amounts for the assessments to be levied in the event of a formation of an Assessment District. Information regarding the estimated amounts of the assessments would be included in the questionnaire mentioned below. 3. Prepare and distribute a questionnaire to the owners and residents of the properties being served by Bonnie View Street designed to assess their views regarding: a) the condition of Bonnie View Street; b) the need and necessity to construct street improvements; c) the formation of an Improvement Assessment District to fund all or a portion of the cost of the street improvement; and, d) the payment of an assessment ( estimated to be within a given range to be developed prior to the distribution of the questionnaire) for these improvements. e) the conversion of the street to a private driveway with recorded reciprocal ingress /egress easement between the properties fronting (using) same. 4. Report back to the City Council within sixty (60) days on the results of the questionnaire and the feasibility of proceeding with an improvement project for Bonnie View Street.
