SUBJECT: Resolution Establishing a Criminal Justice
Administrative Fee (Booking Fee)
Recommendation:
1. Adopt the attached Resolution establishing a Criminal
Justice Administrative Fee (Booking Fee)
Discussion:
Background
During Final Budget Hearings, your Board directed the Chief
Administrative Office to return in September with a proposed
criminal justice administrative fee, also known as a
"booking fee."
SB 2557 (Chapter 466, Statutes of 1990) was enacted by the
Legislature during the FY 1990 -91 State Budget
deliberations. This legislation authorizes counties to
charge a criminal justice administrative fee for the booking
and processing of arrested persons.
SB 2557, which is codified in Section 29550 of the
Government Code, provides that:
"29550._ Notwithstanding any other provision of law, a
county may impose a fee upon a city, special district,
school district, community college district, college,
or university for reimbursement of county expenses
incurred with respect to the booking or other
processing of persons arrested by an employee of that
city, special district, school district, community
college district, college, or university, where the

arrested persons are brought to the county jail for
booking or detention. The fee imposed by a county
pursuant to this section shall not exceed the actual
administrative costs, including applicable overhead
costs as permitted by federal Circular A -87 standards,
incurred in booking or otherwise processing arrested
persons. A county may submit an invoice to a city,
special district, school district, community college
district, college, or university for these expenses
incurred by the county on and after July 1, 1990."
Although the booking fee will not become effective until
January 1, 1991, the County may at that time charge the booking
fee retroactively for all booking costs incurred on or after
July 1, 1990.
Establishment of a Booking Fee
Your Board is being requested to adopt by resolution a criminal
justice administrative fee (booking fee). This booking fee
would be imposed upon cities, special districts, community
college districts, colleges and universities to reimburse the
county for expenses incurred for booking or other processing of
persons arrested by an employee of one of those entities, where
the arrested person is brought to the county jail for booking
or detention. For purposes of this resolution, an employee
would include any person making an arrest on behalf of one of
those entities.
By statute, certain agencies would not be charged the booking
fee. They include the California Highway Patrol, FBI,
Immigration and Naturalization Service, Fish and Game,
California Youth Authority, Ventura County Corrections Services
Agency, and the Ventura County Sheriff's Department for
responsibilities within the unLncorporated areas of the County.
Methodology
The booking fee recovers through the attached methodology both
direct and indirect (overhead) costs incurred by the County in
booking and processing arrested persons.
Direct costs are ascertained by identifying and costing out all
activities directly involved in booking and processing. Such
costs include not only staffing costs, but also costs for
services and supplies. They include initial reception,

searching, fingerprinting, photographing, criminal record
screening, early release screening, classification, medical
screening, data entry, personal property accounting and
storage, clothing issuance, medical treatment, security, and
release processing. Overhead costs are ascertained in
accordance with Federal Circular A -87, as prescribed by
Government Code Section 29550. Unit costs for booking and
processing are derived by adding the annualized direct and
overhead costs, and dividing the sum by the number of booking
processing transactions.
Revenue Projection
The actual cost of booking and processing prisoners in the
Ventura County Jail System has been estimated by the Sheriff's
Department at approximately $120 per booking. This estimate is
based on the most current information available and is subject
to change. Further, this estimate is based on an assumption of
the elements included in the costs of booking and processing
prisoners.
The number of "billable bookings" is projected at 9,554 for FY
1990 -91. This is the same number of bookings as in Calendar
Year 1989 (the most recent data available). This projection
assumes no change (although a change could occur) in the number
of billable bookings during FY 1990 -91..
Billable bookings include only "fresh arrests" and exclude the
following booking categories: holds placed, commitments,
warrants, remands, bail bond surrenders, enroutes (temporary
holds placed by agencies transporting prisoners), orders of
production, orders of return, and roll -ups (inmates returning
from work furlough or work release).
Therefore, assuming the above conditions, establishment of the
newly authorized booking fee may result in as much as $1
million of additional revenue in FY 1990 -91. However, future
developments, including amendments to the booking fee
legislation or changes in the methodology used to compute the
booking fee, could affect this revenue projection.
This item has been reviewed by the Auditor - Controller's Office,
County Counsel, and the Sheriff's Department.

RESOLUTION OF THE BOARD OF SUPERVISORS OF
THE COUNTY OF VENTURA IMPOSING A
CRIMINAL JUSTICE ADMINISTRATIVE FEE
UPON CERTAIN SPECIFIED ENTITIES
TO REIMBURSE THE COUNTY FOR EXPENSES
INCURRED WITH RESPECT TO THE BOOKING
OR OTHER PROCESSING OF ARRESTED PERSONS
WHEREAS, Government Code section 29550, effective January 1,
1991, authorizes the county to impose a criminal justice
administrative fee;
WHEREAS, the fee can be imposed upon each city, special
district, school district, community college district, college,
and university;
WHEREAS, the fee can be imposed based upon each person
arrested by an employee of an above - identified entity, where that
person is brought to the county jail for booking or detention;
WHEREAS, the fee can reimburse the county for expenses
incurred with respect to the booking or other processing of the
person arrested; and
WHEREAS, the fee shall not exceed the actual administrative
costs, including applicable overhead costs as permitted by
federal Circular A -87 standards, incurred in booking or otherwise
processing arrested persons.
NOW, THEREFORE, THE COUNTY RESOLVES THAT:
1. It hereby imposes a criminal justice administrative fee
to the greatest extent permissible.

2. The fee is imposed upon a city, special district, school
district, community college district, college, or university for
each person arrested by an employee of that entity and then
brought to the county jail for booking or other processing.
3. For purposes of this resolution, an "employee" shall
include any person making an arrest on behalf of an entity listed
in paragraph 2.
4. For purposes of this resolution, the criminal justice
administrative fee shall only apply to original or "fresh"
arrests. It shall not apply to related matters, such as: holds
placed; commitments; warrants; remands; bail bond surrenders;
enroutes (temporary holds placed by agencies transporting
prisoners); orders of production; orders of return; and rollups
(inmates returning from work furlough or work release).
5. The fee does not exceed the actual administrative costs,
including applicable overhead costs as permitted by federal
Circular A -87 standards, incurred in booking or otherwise
processing arrested persons.
6. The fee is in the amount of $120.00 for each person
arrested.
7. The fee will take effect. on January 1, 1991, and will
cover all arrests occurring on and after July 1, 1990.

8. It will submit an invoice to each entity listed in
paragraph 2 on a monthly basis, beginning on February 1, 1991.

CPD 89 -1 AND 89 -2 MODIFICATION TO CONDITIONS OF APPROVAL
FROM CITY COUNCIL MEETING JUNE 26, 1990
DEPARTMENT OF COMMUNITY DEVELOPMENT CONDITIONS GENERAL REQUIREMENTS
Revise 9 a. Prior to submission of building construction plans for
plan check or initiation of any construction activity, zoning
clearance shall be obtained by the Department of Community
Development.
Add 9b. A stage grading permit may be issued by the City Staff prior
to recordation of the final map for the resubdivision for 89 -1 and 89-
2.
Add 9c. The developer may submit building plans for plan check prior
to zone clearance to accomplish the division of the property into
parcels. In consideration of the above, the City will be held
harmless.
PRIOR TO ISSUANCE OF ZONE CLEARANCE THE FOLLOWING CONDITIONS SHALL BE
SATISFIED
Condition 22c. - Revise. "A 20- foot -wide landscape area measured from
the face of curb shall be provided along Liberty Bell Avenue, Lassen
Avenue, and Park Lane. A 30- foot -wide landscape area measured from
the face of curb shall be provided along Los Angeles Avenue. The
landscape area shall include meandering walks. See attached Exhibit
"A"
Add Condition 22e. - Building setbacks, measured from the right -of -way
line, shall be 20 -feet along Liberty Bell Avenue, Lassen Avenue, and
Park Lane, and 30 -feet along Los Angeles Avenue.
Condition 43 - Revise to read, "All existing and proposed utilities
are required to be underground to the nearest off -site utility pole
except through transmission lines. Prior_ to the issuance of a
building permit, the applicant shall submit a plan for review and
approval to the Director of Community Development which identifies how
compliance with the underground requirement will be met."
Condition 48 - Revise. The applicant shall make a one time monetary
contribution to the City's Traffic Management System Fund, consistent
with the "buy- down" calculations giUsn in the Environmental Impact
Report. However, "buy- downs" shall iot exceed those required under
the Environmental Impact Report, and d j _1stc'd to final square footage
of approved building plan.
ENVIRONMENTAL IMPACT. REPORT CONDITION:
Conditions 105, 106 and 108 - DE le �. Its ,'ised Condition 48 will
replace these Conditions.

Condition 131 - Add. "and ajusted to comply with final approved
square footage."
Condition 134 - Revise. On -site detention basins should be
incorporated into the proposed site plan. If the Moorpark Avenue drain
is permitted by Cal Trans this condition is not applicable.
CITY ENGINEER CONDITIONS
Add Condition 4al - In lieu of Condition 4a, the developer may widen
Los Angeles Avenue on the south side to add one lane from Park Lane to
the west ECR of Liberty Bell Avenue with an appropriate westerly
transition. All lanes shall be created by striping and approved by
CALTRANS.
* Condition 4b4 - Delete and consider with RPD 89 -3, review and revise
to comply with the City Council final action.
* Condition 4c - Review for compliance with the westerly extension to
Sierra Avenue or knuckling Lassen Road as approved by Council.
Condition 4f - Revise. The applicant shall construct the necessary
improvements to provide 5 -foot bicycle lanes along Liberty Bell Avenue
per the Circulation Element of the Moorpark General Plan if
applicable.
Conditions 14b, 15b and 16b - Revise to read, "Sidewalks shall be a
minimum of 6 feet wide at all points."
* Condition 19, 20, 21 and 22 - Staff to establish a fee for these
Conditions, read memorandum dated July 25, 1.990, Pages 15 and 16.
Condition 35 - Revise. No trees with trunk diameters in excess of 4
inches shall be trimmed or removed without prior approval of the City
Council. The existing citrus orchard, wind breaks and trees on the
south side of Los Angeles Avenue, if applicable, may be removed
without approval of the City Council
* Conditions 37 - Staff to revise Conditions with one time mitigation
fee, read memorandum dated July 2 -;, 1,390, Pages 17 and 18.
Add Condition 41 - The developer is allowed to record the final map
for parcelization of CPD 89 -1 and f'-2 prior to securing a CALTRANS
permit.
Condition 42 - Building permits may he issued before CALTRANS warrants
and permits a traffic signal at the intersection of Liberty Bell
Avenue and Los Angeles Avenue. Occupancy of the first building shall
not occur until the traffic signal �_:- installed and in operation.
