Kellerman, City Clerk _ Clfy Como mee}w of 199� DATE: September 13, 1990 (for CC of 9/19/90) ACTION: SUBJECT: ORDINANCE TO RESCIND ORDINANCE NO. 77 RELATING FILLING COUNCIL VACANCIES 4 BACKGROUND On July 9, 1986, Ordinance No. 77 was adopted requiring a vacancy on the City Council to be filled by appointment within thirty days from the commencement of the vacancy, the appointee to hold office only until the date of a special election to be called immediately and held within the time periods provided in Section 36512.2 of the Government Code. Under the aforementioned Section and Election Code 2500, the date of the election to -be held, should a vacancy occur on the City Council as a result of the November election, would be- March 5, 1991. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING ORDINANCE NO. 77 RELATING TO FILLING VACANCIES ON THE CITY COUNCIL. WHEREAS, pursuant to Section 36512.2 of the Government Code, the City Council of the City of Moorpark previously enacted an urgency ordinance, Ordinance No. 77, providing for the filling of vacancies on the City Council; and WHEREAS, the City Council is now desirous to rescind Ordinance No. 77. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: Section 1. Ordinance No. 77 relating to the filling of vacancies on the City Council is hereby rescinded. Section 2. The City Clerk shall certify to the passage and adoption of this Ordinance and shall enter the same in the book of original ordinances of said City and shall cause the same to be published as prescribed by law.
