Richards, Director of Community Development DATE: October 12, 1990 (CC Meeting of 11 -7 -90) SUBJECT: MOBILE HOME PARK RENT INCREASE - VILLA DEL ARROYO MOBILE HOME PARR Background The last rent increase for the Villa Del Arroyo Mobile Home Park was approved effective December 1, 1989. That rent increase was approved in conjunction with a Settlement Agreement (dated December 12, 1989) between the City of Moorpark and Villa Del Arroyo, Ltd., the owner of the Park. As a condition of that agreement, the owner agreed that no subsequent space rent increase would become effective prior to December 1, 1990, and that tenants would not be billed for water separately from the space rent prior to December 1, 1990. Discussion The Moorpark Municipal Code permits a non - discretionary space rent increase for mobile home parks if the proposed rent increase does not exceed the greater of four percent (4 %) or the adjusted Consumer Price Index (U.S. City Average, All Urban Consumers, All Items) of the total space rent of each affected mobile home park space, provided that: 1. The adjusted Consumer Price Index (CPI) means the full CPI above four percent (4 %) up to and including seven percent (7 %) and two - thirds of the CPI above the seven percent (7 %) up to and including eighteen (18 %) for a maximum total increase of fourteen point thirty -three percent (14.33 %), 799 Moorpark Avenue_ Moorpark, California 93021 10ACI Mobile Park Rent Review Board October 12, 1990 Page 2 2. The proposed space rent increase is to become effective no sooner than one year from the date the last increase became effective at the particular mobile home park. 3. Not less than seventy -five (75) days prior to the effective date of the proposed increase, the owner filed with the Board a Rent Schedule Form and supporting documentation together with a copy of the written notice of the proposed increase and proof that he served each affected tenant, personally or by mail, with the notice... (Ordinance No. 119) Ordinance No. 96 defines "Consumer Price Index" as the consumer price index for the U.S. City Average, All Urban Consumers, All Items, for the twelve -month period ending four (4) months prior to the effective date of the proposed rent increase (e.g. - November effective date would be for twelve -month period ending June 30). The attached rent increase application is in compliance with the referenced Municipal Code requirements for a non - discretionary space rent increase. A rent adjustment schedule is attached which shows existing rents, the calculated 4.8 percent increase, and the total new rent. The proposed 4.8 percent increase is consistent with the increase in the consumer price index for the twelve -month period ending July 31, 1990 (refer to attached published index). The rent increase application was filed on September 7, 1990, more than 75 days prior to the proposed effective date of December 1, 1990. The requested separate billing for individual water consumption is consistent with the Settlement Agreement. Included in that Agreement is the following statement: "At no time that separate billing for water is in effect shall the base meter charge and the charge for water consumed exceed the equivalent rates charged by Ventura County Water Works District Staff contacted Waterworks District 1 and was informed that the base meter charge for a 3/4 -inch meter is $7.00 every two months and that the water consumption rate is $.765 a unit for every 100 cubic feet or 748 gallons of usage. It is not possible to calculate the total monthly water bill for each tenant, because that amount will vary depending upon individual consumption. The Settlement Agreement does not require a deduction from the space rent to compensate for the conversion to separate billing for individual water consumption. Mobile Home Park Rent Review Board October 12, 1990 Page 3 Staff is recommending approval of the requested rent increase based on compliance with the City Municipal Code requirements and the referenced Settlement Agreement, Recommendation 1. Approve requested rent increase of 4.8 percent effective December 1, 1990, for the Villa Del Arroyo Mobile Home Park. 2. Approve requested separate billing for individual water consumption effective December 1, 1990. I have included a Rent Schedule Form, a copy of the Letter To The Residents, a copy of the Consumer Price Index card from the U.S. Department of Labor and Bureau of Labor Statistics, a Rent Roll and a copy of the written settlement agreement between Dale Williams, the park owner, and the City of Moorpark. The Letter to the Residents was mailed to them by U.S. mail on September 6, 1990. If you have any questions or concerns, please contact me at the number below.
