Richards, Director of Community Development DATE: November 2, 1990 (CC meeting 11/21/90) SUBJECT: PD 135 MINOR MODIFICATION NO. 2 (RAYES) • Planned development Permit No. 135 was approved by the County of Ventura on January 2, 1962 to allow construction of a gasoline station at 506 E. Los Angeles Avenue (the southeast corner of Spring Road and High Street). On February 4, 1963 PD 135 (which had expired) was replaced by V -1718 (use variance). On February 27, 1981 Minor Modification No. 1 was approved by the County of Ventura to modernize the service station. The applicant is the franchise operator of the Unocal service station. Discussion This request is to install a 499 gallon above grade liquid propane gas (LPG) tank in the southeast corner of the property. The LPG tank would be used to service motorhomes, campers, barbecues, forklift tanks, and vehicles powered by propane. The proposed tank is nine (9) feet in height and three and a half (3 1/2) feet in diameter. A ring of metal poles imbedded in the ground to prevent a vehicle hitting the tank is proposed to be installed. It is possible that the tank may be laid horizontally to reduce it's visual impact. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 The Director Of Community Development intends to condition this Minor Modification request to require that the propane tank be installed horizontally and that four (4) foot tall screening with material and colors to match the existing wall on the east property line be installed. Additionally, the applicant shall plant three (3) 24" box Pepper Trees along the south property line with permanent irrigation. These conditions will ensure that the tank will not be visible from Spring Road, Los Angeles Avenue, or the railroad right of way. This Minor Modification has been reviewed by the Director of Community Development who intends to approve it with the above conditions in place. Pursuant to Resolution No. 88 -523, the Director has the authority to approve Minor Modifications. This matter is being presented to the Council as a courtesy. In the event the Council wishes to appeal the Director's decision, it may do so. Should the Council desire to appeal, it should set a public hearing date. Where a single container or the aggregate capacity of interconnected containers is over 1200 gallons water capacity, the installer shall submit plans for such permits. Sec. 82.102 (b) Installers shall maintain a record of all installations for which a permit is not required by Section 4.101 (bu, not including installation of qas- burninq appliances and replacing of portable cylinders) and have it available for inspection by the chief INSPECTION Of INSTALLATIONS Sec. 82.103 It shall be the duty of the chief to inspect a reasonable number of liquefied petroleum gas installations to determine if compliance is being made with the provisions of this article. INSTALLATION OF EQUIPMENT Sec. 82.104 All liquefied petroleum gas equipment, including such equipment installed at utility gas plants shall be installed in accordance with the provisions of UPC Standard No.82 -1 and UPC Standard No. 82 -2, except as otherwise provided in this article or in other laws or regulations legally in effect. LOCATION OF CONTAINERS Sec. 82.105 (c) The storage and transportation of liquefied petroleum gas and the installation of all pertinent equipment shall be installec and maintained in accordance with UPC Standard No. 82 -1 and subject tc the approval of the chief. These orders shall apply to all persons and places within the jurisdiction except as herein provided. Sec. 82.105 (e) A stationary tank shall be not less than 10 feet from the nearest street line or sidewalk. Sec. 82.105 (f) Liquefied petroleum gas storage shall be separated from flammable or combustible liquid storage as specified in Section 79.505 (c) PARKING AND GARAGING Sec. 82.106 (a) The parking and garaging of tank vehicles used for the transportation of liquefied petroleum gases shall be in accordance with Article 79. Sec. 82.106 (b) During the unloading or transfer of liquefied petroleum gas, the tank truck shall be located or parked clear of a public thoroughfare unless: 1. The failure to transfer would create a hazard. 2. it is impossible due to topography. PROHIBITED USE OF LIQUEFIED PETROLEUM GAS Sec. 82.107 (a) Liquefied petroleum gas shall not be used for the purpose of operating any device or equipment unless such equipment or device is approved for use with a liquefied petroleum gas. Sec. 82.107 (b) Liquefied petroleum gas shall not be released to the atmosphere except through an approved liquid -level gage or other approved device. DISPENSING AND OVERFILLING Sec. 82.108 (a) The dispensing of liquefied petroleum gases shall be performed by a qualified attendant. EXCEPTION: An attendant'is not required for a liquefied petroleum gas dispensing system, including key, code and cardlock dispensing systems which is not open to the public and which is limited to the filling of permanently mounted fuel tanks on LPG- powered vehicles, provided the system is in accordance with the following: 1. The system is provided with an emergency shutoff switch to be located within 75 feet but not less than 25 feet fro s the dispenser. 2. The systems site shall be provided with afire alarm transmittir device. Such a device may be a telephone.- 3. Portable fire extinguishers shall be provided in accordance with Article 10. 4. Operating instructions shall be posted and maintained in an appro- priate location. 5. The owner of the dispensing facility shall be accountable for the safe operation of the system and the training of the users thereof Sec. 82.108 (b) It shall be illegal for any person, firm, corporation, association, club or organization to operate a self- service liquefied petroleum gas- dispensing operation which is open to the public. Sec. 82.108 (c) A person shall not fill or maintain a liquefied petro- leum gas container with liquefied petroleum gas in excess of the fixed outage gage installed by the manufacturer or the weight stamped on the tank. SAFETY DEVICES Sec. 82.109 A person shall not tamper with or make ineffective the safety devices of any liquefied petroleum gas container. SMOKING AND OPEN - FLAME DEVICES Sec. 82.110 (a) The chief may require the posting of NO SMOKING signs. No person shall smoke within 25 feet of any LP -gas container of 1200- gallon capacity or less, nor within 50 feet of any such container having a capacity over 1200 gallons. Sec. 82.110 (b) A person shall not install or maintain any open -flame device outside of buildings within 25 feet of any LP-gas container having a capacity of 1200 gallons or less, nor within 50 feet of any such container having a capacity over 1200 gallons. Sec. 82.110 (c) A person shall not install or maintain any LP -gas container with a capacity of 1200 gallons or less within 25 feet of any open -flame device outside of buildings, nor shall any person install or maintain any such container with a capacity in excess of 1200 gallons within 50 feet of any such open -flame device. CLEARANCE OF COMBUSTIBLES Sec. 82.111 All weeds, grass, brush, trash or other combustible material shall be kept a minimum of 10 feet away from all LP -gas tanks or containers. ABANDONMENT OF LIQUEFIED PETROLEUM GAS EQUIPMENT sec. 82.112 Whenever the use of liquefied petroleum gas equipment has been discontinued, it shall be abandoned in an approved manner within a period of 30 days. All of the following procedures may be used when approved by the chief: 1. Removal of all liquefied petroleum equipment. 2. Burn-off of contents of container. 3. Ventinq contents of container to atmosphere when discharge of gas can be led to a safe point of discharge. 4. All service openings shall be capped or plugged after contents have been removed from container. Page 4 of 5 ra PROTECTING CONTAINERS FROM VEHICLES �. Sec. 82.113 LP -gas containers located in areas such as alleys, drive- ways or parking lots where they may be damaged by vehicles shall be protected. The following requirements must be met for the installation and use of liquefied petroleum gases (L.P.G.). 1. obtain planning (Zoning) Department approval for outside storage of LPG. 2. Provide site plan of installation. 3. No fixed electrical within 15 feet. UNTFO M FIRE CODE - STANDARD 82 -1 (3711 4. No hazardous material storage or use within 25 feet. 5. Commercial tanks shall be protected from tampering by one of the following: (a). Enclosure with at least a 6 foot high industrial type fence.. There shall be at least two means of emergency access from the fenced or other enclosure. EXCEPTION: If a fenced or otherwise enclosed area is not over 100 square feet in area, the point of transfer is within 3 feet of a gate and containers being filled are not located within the enclosure, a second gate need not be provided. NATIONAL FIRE CODE 58 P. 837 (b). As an alternative to fencing, suitable devices which can be locked in place shall be provided. Such devices shall effect- ively prevent unauthorized operation of any of the container appurtenances, system valves or equipment. 6. Affix the following signs to all tanks: A.
