Subject: TEMPORARY USE PERMITS By
The purpose of this report is to identify the current practice under which Temporary Use Permits are issued and
their authority within The City's Municipal Code.
Temporary Use Permits are currently issued under the provisions of Article 45, GENERAL PROVISIONS - OTHER
PERMITS AND LICENSES - PROHIBITION: ENFORCEMENT: PENALTIES: as an over the counter Zoning Clearance. Temporary
Use Permits, as the name implies, are for a limited duration. Typically these permits are from one day to as
such as ninety days. A majority of the Temporary Use Permits are issued for events occurring between one and
three days. An example would be a church carnival or a promotional commercial parking lot sale. Temporary Use
Permits are issued under the direction of the Director of Community Development and generally receive a review
by the Director prior to approval.
Conditions are imposed upon all Temporary Use Permits as authorized under Section 0.165 -0.1. Conditions limit
the term, and all activities related to the Temporary Use. Violation of these conditions are grounds for
revocation of the permit.
Some Temporary Use Permit requests receive more review than others, such as permits to film motion pictures.
Seasonal sales of Christmas Trees is currently regulated by a minute action taken by the Council in 1988 (See
attachments).
Inasmuch as it is the City's intent to adopt the County Zoning Code as it's interim code; Temporary Use Permits
are more clearly identified and regulated. Within the County Code, Temporary Use Permits are still issued under
the provisions of a Zoning Clearance.
Staff Recommendation
Direct staff as deemed appropriate.

SUBJECT: CHRISTMAS TREE LOTS
With the Christmas season approaching it is inevitable tha a demand
will exist to establish Christmas tree sales lots within the city.
A review of the zoning code reveals hat no provision is included
for the sale of Christmas trees as a temporary use. Inasmuch as
Christmas tree lots are a tradition observed by many residents of
Moorpark, provisions should be made for this to occur. We
recommend that the City Council adopt by policy a set of standards
to regulate Christmas tree lots until more specific temporary use
restrictions can be implemented. Tree sales could occur only in
commercial and industrial zones via a zoning clearance issued by
the Director of Community Development. Such aspects such as
access, lighting and business days and hours available would also
be regulated by the same zoning clearance.
Recommended Action -
Adopt by minute action a policy which requires that temporary
Christmas tree sales shall be allowed only on commercial and
industrial zoned property subject to approval of a zoning clearance
by the Director of Community Development.

E. Consider a report concerning_ the sale of Christmas trees on tree
lots. Staff recommended Council adopt an interim policy
regarding such sale requests.
Patrick Richards gave an overview of the staff report dated
October 12, 1988. City Attorney, Cheryl Kane, commented the
City would need an ordinance to be able to enforce a use change
in accordance to the City' s zoning code.
MOTION: Councilmember Brown moved and Councilmember Harper
seconded a motion to adopt by minute action a policy which
requires that temporary Christmas tree sales shall be allowed
only on commercial and industrial zoned property subject to
approval of a zoning clearance by the Director of Community
Development. The motion was approved with Mayor Lane voting no.
Mayor Lane commented he felt the action should have been taken
by ordinance not by minute action.
AT THIS POINT IN THE MEETING, Item 11.J. was heard.
J. Consider a Major Modification request for a condition deletion
or modification for Development Permit DP-302 (American
Products. Staff recommended Council approve Resolution No.
88-515 so as to delete Condition No. 40 of Resolution No.
88-454.
Patrick Richards gave an overview of the staff report dated
October 25, 1988 and presented the proposed resolution.
MOTION: Councilmember Brown moved and Councilmember Galloway
seconded a motion to adopt Resolution No. 88-515, a resolution
amending Resolution No. 88-454 for Development Plan Permit No.
DP-302, Major Modification No. 1. The voice vote was unanimous.
F. Consider proposed means of proceeding with the establishment of
a city-wide traffic mitigation fee. Staff recommended Council
direct staff as deemed appropriate.
Steven Kueny gave the staff report dated October 19, 1988.
Councilmembers Galloway and Harper felt a Highway 118 bypass
should be built around the City, and that attention should not
just be given to Happy Camp Road. Councilmember Brown suggested
the City consider a list generated by the Year 2000 committee,
and incorporate this list. into our traffic mitigation fee
process.
Councilmember Harper was concerned the fee would only relate to
an access road to the Happy Camp Regional Park project. He felt
the proposed traffic mitigation fee process could be the last
opportunity the City would have to take care of its traffic
problems. Councilmember Brown stated she would like to see the
State able to participate -in funding projects, with this local
fee method funding the State' s short fall .
