HARE City Treasurer The Honorable City Council Susan Cauldwel ssistant to the City Manager November 28, 19 Request for Early Refund of Assessment District Overpayment by Villa del Arroyo In FY90/91, the Villa del Arroyo Mobile Home Park was overassessed for lights, landscaping maintenance, and parks maintenance. Assessment district engineers incorrectly calculated 300 home spaces rather than the existing 240. Thus, the park was assessed $11,481.32 for both districts, when it should have been assessed $9,187.52. In FY89/90, the Mobile Home Park was overassessed for lights and landscaping maintenance by $303.81 and was underassessed by $4,305.80 for parks maintenance. This resulted in a total due to the City of $4,001.99. In accordance with City Council action late last fiscal year, Villa del Arroyo was required to make up this amount in FY90 /91. However, the park was actually billed $6175.92 because of the space number problem noted in the above paragraph. Based on the following calculation, FY90 /91 Property Tax Bill $17,656.24 FY90 /91 Assessments Due ($ 9,187.52) FY89/90 Assessments Due ($ 4,001.99) the Mobile Home Park is due a refund of $4,466.73. Bessire and Casenhiser, the Mobile Home Park's management company, has requested that one -half of the refund, or $2,233.37, be paid after the December tax payment is made. The Park's managers state that these funds are needed to assist in paying the April property tax installment. 799 Moorpark Avenue Moorpark, Califomia 93021 (805) 529 -6864 Memo to the Honorable City Council November 27, 1990 Page 2 The underpayment of $4001.99 in FY89/90 will not be repaid until both property tax payments are made. Therefore, an early refund (if approved) should be timed to assist with the April 10, 1991 property tax payment. The second half of the overpayment would be refunded after proof of payment of the second installment is made to the City. If this occurs prior to April 1, 1991, a refund would be processed as soon as proof of payment is made. STAFF RECOMMENDATION When proof of payment of the December 1990 Villa del Arroyo property tax bill is made, approve Villa del Arroyo's request for an early refund of its overpayment of assessment district fees in the amount of $2,233.37, and mail the refund on April 1, 1991. If proof of both payments is made prior to April 1, 1991, process the refund as soon as proof of payment is made. villal Surplus AD 84 -2 Funds December 5, 1990 Page 3 F. Wall Problems As you may know, staff is presently working with the successors in interest in the Pacifica Development assets and liabilities, toward the resolution of structural problems encountered with the perimeter wall in the area of this proposed project. Be advised that the final design of the parkway landscaping project could be affected by the outcome of these efforts. G. Cost Estimate Based on the cost of the median improvements, it is the opinion of staff that the cost of this project will not exceed the above mentioned AD 84 -2 surplus. The development of a project cost estimate would be a part of the project design development. Staff recommends that the City Council take the following actions: 1) Authorize the use of the surplus AD 84 -2 improvement assessments for the construction of the parkway improvements described above. 2) Authorize staff to solicit proposals for a project design and construction cost estimate compatible with future block wall repair efforts.
