Subject: Appeal No. 90 -3 (Karla and Abbebe Tesfay)
In early May of this year Ron Sisseck, 6708 Lafayette Court applied for a
Zoning Clearance to construct a patio cover and second story deck. The
City's Patio Cover Policy requires that all adjacent neighbors sign a
Neighbor Notification Form. Mr. Sisseck was unable to obtain the
signature of one of the neighbors, Mr Abbebe Tesfay. In addition, Mr.
Sisseck, Mr. Tesfay and the Homeowners Association have been in a
dispute about the planting of trees, blocking of views, and the
construction of the deck and gazebo. In conformance with Section 8163-
4.4.2 the Director of Community Development deferred this matter to the
Planning Commission on June 18, 1990 for review with an intent to
approve the permit. At the Planning Commission meeting both Mr. Sisseck
and Mr. Tesfay's attorney, Marc Charney, were present and addressed the
Planning commission. The Planning Commission moved to Receive and
File the report and uphold the directors decision to approve the second
story deck. On July 2, 1990 Mr. Abbebe Tesfay of 6709 Lafayette Court
filed Appeal 90 -3 with the City.

The appellant is basing his appeal upon the following reasons:
"The proposed second floor deck would be
obnoxious, harmful and impair the utility of
appellant's property; would not be compatible with
the character of neighboring development; and,
because of the shape, topography and location of
the properties, would confer a special privilege on
the applicant and a special detriment on the
appellant which is inconsistent with the
limitations upon other properties in the same
vicinity and zone, and which will be detrimental to
appellant's enjoyment of and the value of his
property.
It is staff's position that the second story deck meets all height and
setback requirements, and the project has been approved by the
Homeowner's Association, therefore the Appeal should be denied. The
Patio Cover Policy applies equally to all properties in the City and does
not take into account elevation differences between lots, location of trees
and windows, and which party has a v Few.

SUBJECT: Patio Cover Policy
The Department of Community Development received an application on May
21, 1990 from Ron Sisseck to construct a patio cover with a second floor
deck to be located in a rear yard at 6708 Lafayette Court in a Residential
Planned Development Zone (Varsity Park Estates). This project meets the
setback requirements of the City's Patio Cover Policy in regards to height,
setback, and compatibility to the existing house. However, the Policy
also requires that all applicants for a second floor deck circulate a
Neighbor Notification Form to all adjacent neighbors. This form is to be
signed by all neighbors stating that they have been notified of the
proposed construction. The applicant has obtained the signature of one of
his two neighbors but has been unable to procure the other neighbor's
signature (at 6709 Lafayette Court). The applicant, the Homeowners
Association and the adjacent neighbor have been involved in a dispute
regarding the planting of trees, accessory structures and the blocking of
views (see the attached letter from the applicant). At the homeowners
association meeting the objecting neighbor, Mr. Tesfay spoke against the
project, however, the Board of Directors approved the project
unanimously. The location of the p,:itio deck does not block the view of any
neighbors, nor does it permit locking into a neighbors windows to any
extent greater than currently exi: :;ts. The proposed patio deck would

permit the applicant to look across the rear of Mr. Tesfay's lot (the
applicant currently can look across his rear yard from his second floor
windows.
In conformance with Section 8163 - 4.4.2, 1 am deferring this matter to the
Planning Commission for review and comment. I intend to approve this
permit unless the Commission has an objection. The Commission also has
an option to make a policy recommendation to the City Council if it
desires to.

To Whom It May Concern,
I have been unable to get one of my neighbors signature for a proposed
second level view deck I wish to build. The neighbor is : Mr. Abbebe Tes-
fay, 6709 Lafayette Court, Moorpark, CA 93021.
Our home is a single family residence at 6708 Lafayette Court, Moorpark.
We are governed by a H.O.A. with C.C. & R.s. We have submitted our plans
for this deck to the Board of Directors of the H.O.A. and received approval.
The H.O.A. Archetecture Comm. and Board of Directors heard our neighbors
viewpoint on why he objected of the deck, but voted 5 to 0 in our favor to
allow the deck to be built.
Our problem has been an ongoing situation since January when Mr. Tesfay
planted 6 — 7 foot Malalucca trees and fruit trees directly in the way or our
view of the city below. We consulted with the neighbor to relocate the trees
but, to no avail. This neighbor said that he didn't want us to be able to
look into his back yard from our second story windows. Mr Tesfay planted
trees that were in violation of our C.C. ,& R.s.
We were then unable to get A.R. Development Inc. (acting as Board of
Directors) to enforce the C.C. & R.S. Therefore we filed a lawsuit against
A.R. Development Inc. and Varsity Park Estates H.O.A. in March before there
was an elected Board of Directors for failing to protect our view and
enforce the C.C. & R.s.
The elected H.O.A. then tryed to con: ;ult with Mr. Tesfay many times
but he was not willing to meet with anyone to resolve the problem. We offered
the Board of Directors a compromise that they approved last month which is;
1. Mr. Tesfay must remove a number of trees from our view and get
Arch. Comm. approval before replanting.
2. We will drop the lawsuit against the H.O.A. 'after tree removal.
We believe Mr. Tesfays' concern is not privacy at all (none of us have
privacy to begin with because the way the homes were built). We believe
Mr. Tesfay is unhappy that he was told by the H.O.A. to remove the trees.
We also believe that Mr. Tesfay wishes to get even with us by not signing the
neighbor consent form.
The Varsity Pard Estates H.O.A. has also found Mr. Tesfay uncompromis-
ing, unworkable, one -sided (in view), unreasonable, and not willing to sub-
mit any proposed work for approval before completion.
I do wish for zoning clearance and issuance of a building permit because
this view deck would improve the value of the neighborhood as well as our
home, provide greater enjoyment of our home and view, and improve the appear-
ance of the rear of our home.

Varsity Park Estates. You may contact ,a member of the board to verify the

substantial adverse effect on neighboring property interests may be decided

Sec. 8163-4.4.2 - Deferral of Discretionary Administrative Decisions - The
Planning Director may defer to the Planning Commission any administrative
decision on a discretionary permit for one or more of the reasons listed
below: (ADD. ORD. 3638- 2/22/83) _
a) Projects which result in significant environmental impacts which cannot
be mitigated to insignificant levels;
b) Projects which involve significant public controversy;
c) Projects which are in conflict with County policies or would
necessitate the establishment of new County policy;
d) Projects which are potentially precedent- setting; or
e) Any other cause deemed justifiable by the Planning Director.

Sec. 8163 -5 - HEARING AND NOTICES
Sec. 8163 -5.1 - Whenever an application request, which requires that a
hearing be held before the application can be acted on, is duly filed, the
Planning Division shall set a date, time, and place for the matter to be
heard and shall give notice of said hearing by mailing a written notice,
postage prepaid, containing the date, time, and place of the hearing, not
less than ten calendar days prior to the date of the hearing, to the
applicant, the owners of the property involved, and the owners of the
property situated in whole or ;cart within a radius of 300 feet of the
exterior boundaries of the Assessu;.'_, Parcel(s) on which the proposed use is
to be located. Names and addresses shall. be obtained by the applicant from
the last equalized assessment roll. In addition to or in lieu of mailed
