SUBJECT: Unscheduled Planning Commission Vacancy

Mr. William Butcher's resignation as Planning Commissioner dated March
13, 1989 was received in the City Clerk's office. Section 54974 of the
Government Code reads as follows:
"Sec. 54974. Unscheduled vacancy; special notice; acting basis;
final appointment
(a) Whenever an unscheduled vacancy occurs in any board,
commission, or committee for which the legislative body
has the appointing power, whether due to resignation,
death, termination, or other causes, a special vacancy
notice shall be posted in the office of the clerk of the
local agency, and in other places as directed by the
legislative body within 20 days after the vacancy occurs.
Final appointment to the board, commission, or committee
shall not be made by the legislative body for at least 10
working days after the posting of the notice in the clerk's
office.
(b) Notwithstanding subdivision (a), the legislative body may,
if it finds that an emergency exists, fill the unscheduled
vacancy immediately. A person appointed to fill the
vacancy shall serve only on an acting basis until the final
appointment is made pursuant to this section."

In view of the foregoing, we have posted a notice of the vacancy
created by the recent resignation of Mr. Butcher from the Planning
Commission. A copy of the notice is attached. The notice was posted
in the City Clerk's office on March 20, 1989 in the same manner as all
public notices. Any further posting would be at the direction of the
City Council. Appointment to fill the vacancy may be made after April
3, 1989 or prior to that time if any emergency exists. We will place
the matter on the agenda for appointment to fill the vacancy at your
meeting of April 5, 1989.
RECOMMENDED ACTION:
Direct staff as deemed appropriate.

Dear Mayor:
It is with regret that I ask you to accept my resignation
as a Planning Commissioner for the City of Moorpark, Ca.
We are moving to Thousand Caks,Ca. 31 March 1989. Reasons
for this move are that we want to be close to our grand-
children, the church that we attend and belong and near.a
golf course. We do not like to drive as much as we used to
drive.
I do feel that in someways that I have contributed to the
growth of this fine city. I enjoyed working with the council,
fellow planning commissioners and city staff. Eloise your
exdellent information and thoughts have been appreciated. I
shall miss these assocations. Jackie and I have always enjoyed
attending the many city functions. We will miss this very much,
as in the short time we have been here Moorpark has gone from
a village to a booming city.

Qualifications of Members:
(a) The members of the Commission shall be residents and registered voters of the
City. When a person serving on the City Planning Commission ceases to be a
resident of the City of Moorpark, the City Councilmember responsible for the
nomination shall declare vacant such person's position on the Planning
Commission and shall nominate another eligible person to the unexpired term of
such former member.
(b) Members of the Commission shall, where possible, be selected on the basis of
special knowledge in the fields of real property, construction, law, zoning and
architecture or related subjects.
(c) No members of the Planning Commission shall hold any other remunerative office
or position with the City.
(d) Each Commissioner shall serve at the pleasure of his or her nominating
Councilmember or his or her successor.
