SUBJECT: SB969 (Bergeson)
Senate Bill 969 would statutorily recognize the existence of the
Southern California Association of Governments (SCAG) and would give
SCAG certain powers it does not have under current law.
The current Executive Committee structure would be replaced with one
representative from each board of supervisors except Los Angeles which
would have two; and one city representatives from each county except
for counties with more than one million residents which would be
entitled to one representative for every one million residents after
the first million. It is obvious the Executive Committee would be
heavily weighted in favor of Los Angeles County.
Two of SCAGs proposed new powers are objectionable. The first is the
Executive Committee's discretionary veto power over individual county
components of the Southern California. regional plans (except specific
land use entitlements). This could be detrimental to Ventura County
because, with respect to land use planning, SCAG has attempted to
encourage increased growth in Ventura County, beyond that which has
been allowed by the cities and the county. Similarly, with regard to
transportation planning, SCAG may not continue to accept the plan
formally adopted at the county level. The Executive Committee could
use its veto power to include items which would be objectionable to
Ventura County. The bill states that various countywide components of
a regional plan must be consistent with the goals, policies,
guidelines, or schedules adopted by SCAG in its Regional Mobility Plan,
Growth Management Plan, Regional Housing Needs Assessment, Air Quality
Management Plan, etc. This clearly gives SCAG the ability to veto
countywide plans.

The second objectionable power is the designation of SCAG as the
Transportation Planning Agency for the six county region, thus denying
the newly formed Ventura County Transportation Commission this
designation. In addition, the three quarters of one percent of TDA
funds used to support a Transportation Planning Agency's work would
also go to SCAG. This designation would be in addition to the required
formation of a countywide regional association to develop the
long -range transportation plan.
The Board of Supervisors recently adopted an oppose position on SB969
for the reasons described in the staff report (along with several
others) is requesting that all 10 cities oppose the bill.
Staff Recommendation
Oppose SB969 and authorize the Mayor to sign a letter communicating the
City's position to pertinent elected officials in Sacramento.
