Re; Item 9A continued from 8/16/89 meeting
Moorpark City Council,
I would like to set the record straight, with respect to a
typographical error contained in the letter, which the Moorpark
City Council received from Mash Associates. Specifically, the
error was in the hours of operation on Friday and Saturday nights.
The letter indicates the hours would be from 11 a.m. to 12 midnight
and the hours should have been from 11 a.m. to 2 a.m. .
Councilman Perez in fact mentioned this obvious error at the
council meeting on August 16, 1989. My thoughts were dwelling on
matters we were discussing prior to his comment, and I therefore did
not respond to Councilman Perez's inquiry.
This error needs to be rectified for a variety of reasons. The
liquor license of Chuey's Restaurant is unristricted by the City of
Moorpark with respect to hours of operation and would therefore create
an environment of unfare competition. We checked with the State Liquor
Board to confirm that the license issued to Chuey's was in fact a new
license, and issued unconditionally.
Secondly, the difference in the investment capital required would
certainly suggest that unfair competition is not warranted in regards
to our new business. To comply with the hours as indicated in the
letter by Mash Associates, our restaurant would have to stop serving
dinners at 11 p.m. , which in turn suggests that patrons who arrive
after 10:45 p.m. could not be served due to preparation time.
I am confident that the Moorpark City Council didn't then or now,
intend to create an arena of unfair competition between local businesses.
