MEMORANDUM
TO: The Honorable City Council

SUBJECT: Senior Citizens Addition - Additional Costs
As you are aware, the contract for the Senior Citizens Additions was
awarded to McCarthy Construction for the sum of $261,650. In
proceeding with the project, staff discovered the kitchen, which is to
be added on the south side of the Community Center building, would be
approximately nine to eleven feet within the Southern California Edison
transmission line right-of-way. Previously, research for development
of the Senior Center did not disclose any information related to
Southern California Edison having a right-of-way easement south of the
Community Center.
To expedite this project and keep costs to a minimum, it was decided to
move the kitchen approximately thirteen ( 13) feet further east of its
proposed location, which would remove it from the Edison easement
right-of-way.
Staff requested a revised cost from McCarthy Construction for the
additional work to be in compliance with Environmental Health code
requirements which require 25% of the total kitchen area be reflected
in dry storage area for kitchen, equipment, food, etc. McCarthy
Construction estimates the cost to do the additional work to be
$4,725.
Additionally, staff asked McCarthy Engineering to provide costs to pave
out the additional footage at the rear of the Community Center to
eliminate dirt and dust. Cost for the additional paving provided by
McCarthy Construction is $6,720.

As the additional square footage is needed to be in compliance with the
Health Department regulations, staff is recommending the additional
square footage be added to the Senior Center and funds in the amount of
$4,725 be appropriated from the previously approved project contingency
which is $13,083.
If Council approved the additional paving, staff recommends that the
money would be appropriated from the neighborhood park portion of the
central park funds.
Additionally, McCarthy Construction is requesting an extension to the
time period of the notice to proceed with the project of four (4)
days. Currently, their heavy equipment is involved with another
project which will be tied up through the remainder of this week.
Staff does not feel this request of four days will be a major concern
with the construction of this facility.
Also, as the project site was not originally surveyed, McCarthy
Construction is requesting to be held harmless for any problems which
would arise through the construction of the Senior Center additions;
i .e. building within the Edison easement right-of-way.
STAFF RECOMMENDATION:
1. Approve request for four (4) day extension for date to begin
construction of project;
2. Hold McCarthy Construction harmless for any action arising out of
any portion of the Senior Center additions being constructed

Attention : Phil Newhouse
Dear Phil :
This letter is intended to clarify a few issues that are of
concern to us with regards to the upcoming construction.
We would request that the Notice to Proceed become effective
on November 3rd , 1989 instead of the October 30th, 1989 date .
As you are aware , we were delayed for a significant amount of
time in starting the project . We only request four additional
days as we must have sufficient time to move on our. equipment .
In addition, we must be held harmless and not be responsible
for any problems arising out of the City not surveying the
building site .
-We , McCarthy Construction are to be held harmless from any
adversed impact resulting. from the lack of permits including , but
not limited to the grading , building and environmental permits .
