WALL Chief of Police City Clerk MEMORANDUM TO: The Honorable City Council FROM: Steven Kueny, City Manager DATE: November 9, 1988 SUBJECT: Christmas Decorations Program by the Chamber of Commerce The Chamber of Commerce is desirous of installing Christmas decorations on street light poles in the downtown area. This activity is also planned as a fundraiser for the Chamber. There are six poles on the south side of High Street extending west from Spring Road and four poles on the west side of Moorpark Avenue (SR 23) extending north from Los Angeles Avenue. The poles are owned by Southern California Edison (SCE) and are within City and/or State rights-of-way. The Chamber has received information from SCE concerning conditions of approval to permit the placement of the banners. SCE has requested that the Chamber include the City as part of SCE's approval action. I have informed the Chamber representative that the City will not be a party to an agreement with SCE but will work with the Chamber and issue an encroachment permit with standard and typical conditions after they obtain SCE approval to use the poles. According to the attached letter you received a copy of same/direct from Edison as we had requested. To complete your files , and to add continuity to our telephone conversation of August 25 , 1988 enclosed please find my letter to Christina Bradley, Area Manager, recapping the meeting and tour of Edison pole locations along High Street and Moorpark Avenue. Please consider this letter as a formal request for a City of Moorpark Encroachment Permit , which planning and public works staff have advised must be applied for directly through you. It is clear that in order to comply with Edison requested "hold harmless" and other release from liability requirements , the City and Chamber of Commerce will need to develop an agree- ment regarding, hopefully, shared responsibilities . Please contact our President , Dick Cameron , ( 805 ) 378-2411 to arrange a meeting to outline the conditions of approval of the permit , and whatever joint agreement may be required to effect this project . The Chamber (City Christmas Decoration Committee ) is prepared to proceed. A sample of the banner and its attaching devices is available for the City' s and Edison ' s inspection . We may wish to secure approval for the installationof some temporary poles to fill in the gaps where only wooden poles exist . The Southern California Edison Company shall be held harmless and indemnified against all loss , expense, claims, actions, cause of action, damages, cost, or liabilities , including court costs and attorney fees, for injuries to or death of any person (s) including employees , agents and contractors of Edison, arising out of or resulting in any manner whatsoever from the attachment installation, maintenance, and/or removal of Christmas banners and assemblies on Edison owned street light poles. 2. It is agreed that all such materials shall be approved by the Edison Company prior to attachment or installation, and attached to Edison street light poles by means of a stainless clamping ring and in a manner that will not crush, crack, or deform the street light pole . The material , while being displayed, shall clear any overhead street lighting conductor by a minimum of ten feet. 3 . It is understood and agreed that should a street light pole by crushed, cracked, deformed, or damaged in any other way by the attachment by such material, the City will reimburse Edison for any expenses for corrective action required including, but not limited to, the replacement of the street light pole. -2- 4 . It is also agreed that said Christmas banners and assemblies shall be installed and maintained by the agency in a good, safe and workmanlike manner and in compliance with all applicable laws, rules , regulations, ordinances , and decrees of all lawfully constituted federal, state, county, or city legislative bodies, administrative agencies, or tribunals pertaining thereto, including General Order No. 95 or the Public Utilities Commission of the State of California, and the California Occupational Safety and Health Act. 5 . The City agrees to remove all such Christmas banners. Should the City fail to remove such material by January 31 , 1989 , the City hereby authorizes Edison to remove such material and agrees to reimburse Edison for such removal and storage costs . This authorization is granted to attach Christmas banners on a temporary basis over this special event to Edison owned street light poles upon receipt by the Edison Company of one copy of this letter signed by a duly authorized official of the City of Moorpark. We have contacted a company who produces these banners and at a cost of $200 to $400 a banner can be sponsored by your Company. There is a choice of 6 different banners. The single banners are approximately 2 1/2 feet by 5 feet long and your company name would be silk screened on the bottom. On the double banner your name would be silk screened on the top. This is a one time cost and your banner would go up annually. Please fill out the attached form and return to the Chamber Office by October 10, 1988.
