GENOVESE City Treasurer T O • The Honorable City Council FROM : Steven Kueny, City Manager DAT E : May 15, 1986 SUBJECT • PD-1010 (PALMER) PARK FACILITIES (QUIMBY) FEE BACKGROUND Condition 30 f. of the approved conditions for the subject project requires the payment of a fee for park facilities commonly known as Quimby Fees. The developer was also conditioned (Condition 29) to be responsible for one-half (1/2) of the cost for design and construction of a pedestrian bridge across the Arroyo Simi. The City could require the developer to construct the entire bridge at their cost with reimbursement for the second one-half (1/2) portion to come from adjacent development to the west. Condition 30 f. specifically excluded any credit for the bridge towards the Quimby Fee. DISCUSSION At the time of the approval of PD 1010, an accurate estimate of the potential Quimby Fees was not available. The fee itself is calculated based upon the fair market value of the property at the time the final map is filed or the zone clearance when the first building permit of an apartment project is requested. PD 1010 is required to pay fees for the equivalent of 3.7 acres of land plus 20%. The estimated fee is in excess of $750,000. In comparison to other multi-family projects approved and proposed, including Regal (120 condominiums), Oliver PD 1046 (27 townhomes) and Lincoln Properties PD 1051 (proposed 136 apartments) , PD 1010 is required to pay comparably more due to the bridge requirement. The cost of the bridge is estimated as high as $300,000. It was originally estimated at $190 - $200,000. (This estimate is for new construction, not the proposed railroad bridge relocation). 799 Moorpark Avenue Moorpark, California 93021 (805)529-6864 PD-1010 PARK FACILITIES FEE May 15, 1986 Page 2 In light of the information of the amount likely to be paid in Quimby Fees, it is recommended that the City Council reconsider giving credit for the developer's one-half (1/2) requirement for constructing the pedestrian bridge with a "not to exceed amount" as monitored by the City Engineer. This action would not change the City's ability to require the developer to construct the full bridge as previously mentioned. RECOMMENDED ACTION Modify condition 30 f. of PD 1010 and LDM-3 to allow credit against the Park Facilities Fee for one-half (1/2) the cost of the pedestrian bridge , not to exceed $150,000, with the amount of credit determined by the City Engineer.
