SUBJECT: Agreement to Construct Improvements for PD 966 (Mash)
BACKGROUND INFORMATION
PD 966 (Mash) is located on the southeast corner of the
intersection of New Los Angeles Avenue and Moorpark Road. A
vicinity map is enclosed for reference.
On January 20 , 1986 the City of Moorpark City Council
conditionally approved PD 966 . Improvement plans for the project
have been submitted to the City Engineer 's office and have
recently been approved. All development conditions regarding the
public improvements have been fulfilled. Surety bonds have been
posted as follows:
Grading $ 40,000
Performance and Payment $ 80,000
Storm Drain $ 10 ,000
Traffic Signal Modification $ 45,000
As a condition of approval, the developer was required to paveout
New Los Angeles Avenue south of the centerline and Moorpark Road
east of the centerline. The land on which these paveouts are to
be constructed is owned by the developer. According to
development condition No. 40 of PD-966 , the developer must offer
to dedicate this land to the City of Moorpark. Enclosed are the
appropriate Grant Deeds for New Los Angeles Avenue and Moorpark
Road.
At one time, the State had a slope easement across part of the
property on the south side of New Los Angeles Avenue. This

easement was subsequently relinquished to the County of Ventura
prior to the City's incorporation. At this time, it is not clear
if the easement was automatically transferred to the City upon
incorporation or if it still rests with the County. Regardless
of which agency holds the slope easement, it is appropriate that
it be abandoned because the slope will be eliminated by project
grading. A Quitclaim Deed is enclosed, with which the City can
abandon any interest it may have in the easement. The County is
currently processing a similar document.
As a condition of approval, the developer was also required to
dedicate the access rights, except for approved driveways,
adjacent to Moorpark Road and New Los Angeles Avenue along the
project frontage. Accordingly, a covenant surrendering these
access rights is enclosed.
In consideration of the above items, it is now recommended that
the City enter into an agreement to construct the improvements
within the public right-of-way, accept the Grant Deeds for
right-of-way along New Los Angeles Avenue and Moorpark Road,
accept the covenant surrendering access rights along Moorpark
Road and New Los Angeles Avenue, and abandon the slope easement
along the south side of New Los Angeles Avenue by means of a
Quitclaim Deed.
RECOMMENDED ACTION
Authorize the Mayor, on behalf of the City, to do the following:
1. Accept the Grant Deeds for right-of-way along New Los
Angeles Avenue and Moorpark Road.
2. Accept the covenant surrendering access rights along
New Los Angeles Avenue and Moorpark Road.
3 . Abandon the slope easement along the south side of New
Los Angeles Avenue by means of a Quitclaim Deed.
4 . Enter into an agreement to construct the improvements
within the public right-of-way of New Los Angeles
Avenue and Moorpark Road.
