SUBJECT: PD 1066 Minor Modification No. 3 (Cushman)
BACKGROUND
Planned Development Permit No. 1066 was approved by the City
Council (Resolution No. 87-444) on January 20, 1988 for the
construction of a car wash and automotive repair center. On
December 12, 1990 the City approved Zoning Clearance 90-446 to
allow construction to begin. During construction a number of trees
were cut down which were to have been retained. Minor Modification
No. 1 to PD 1066 was filed to modify the landscape plans to reflect
the revised landscape plan. This Minor Modification was approved
by the City on June 25, 1991, with conditions added relating to
design and operation. On December 11, 1991 Minor Modification No.
2 was approved, allowing construction of a 68' x 25' canopy over
the gas pumps. As a matter of practice, Shiloh Church, 123 Park
Lane, has been notified of the application.
pISCUSSION
This request for a Minor Modification consists of three parts: A)
approval of a monument sign B) elimination of a number of
conditions approved in Minor Modification No. 1, and, C)
construction of a second floor addition to provide office space for
the on site manager.
A) Modify the approved sign program to allow construction of a
19.96'high, 8' wide sign with 54 sq.ft. of sign area. This sign
will be internally illuminated and will provide space for gasoline
prices. The applicant also requests two internally illuminated
"Texaco" signs with 24" letters on the canopy.
Staff will approve the request for two internally illuminated
"Texaco" signs with 24" letters placed on the canopy put will not
approve the remainder of this request about the free standing
signs. Instead, staff will approve a free standing sign with the
following conditions:

1) The sign shall be the same height (or lower) as the
freestanding sign at 476 W. Los Angeles Ave.
2) The sign should be constructed with material that matches
the existing buildings
3) Only external illumination shall be provided
4) The price of gasoline shall not be displayed on this sign.
Only the Texaco logo, the Park Lane Center Car Wash, and
tenants names may be used.
8) Applicant is requesting elimination of a number of conditions
approved under Minor Modification no. 1 which regulated the
operation of the business and related safety issues. These
conditions are as follows:
2) "Limit Sunday hours of operation of the entire site to
begin no earlier than 12:00 noon. /,This limitation on Sunday
hours of operation will remain in effect only as long as the
adjacent property is a church. A future Minor Modification
would be the vehicle for a request to change the hours of
operation in this circumstance. "//
Staff will not approve a change in the starting hour of
operation because this condition was initially placed on the
operation to insure compatibility with the Church activities.
3a) "That no delivery of any kind be made between the hours of
10:00 p.m. and 6:00 a.m. Monday through Sunday. "
Staff will approve the bulk delivery of gasoline during non-
operating hours because the deliveries are not noisy and the
site is not adjacent to any residential zones and deliveries
occur when there are no Church activities.
3b) "That gasoline pump islands shall be limited to three (3)
and no more than two (2) gasoline delivery pumps shall be
installed on each pump island."
Staff will approve this request, the total pump limitation
will be removed. Installation of additional pumps will
require approval of a Minor Modification because additional
pumps provide a change to the approved site plan.

3c) "That there shall be no outside display of any automobile
products for sale (oil, anti-freeze etc. ) . "
Section 8109- 3.1.1 of the zoning code prohibits outdoor
displays. Applicant may still apply for a Temporary Use
Permit for periodic outdoor sales. Staff will keep this
condition intact.
3d) "That all gas price signs shall be made part of an
overall sign program to be approved by the Director of
Community Development prior to the first occupancy of the auto
service building. A sign program shall be submitted to the
Director of Community Development prior to occupancy of
the car wash."
Staff will approve this request because a sign program has
already been approved, any modification or additional signs
requires an amendment to the sign program.
3e) "That all necessary permits to store and sell flammable
liquids shall be obtained from the Ventura County Fire
Department and the Ventura County Environmental Health
Department."
Staff will approve this request because the sales of these
products require approval of Ventura County Fire Department
and Ventura County Environmental Health Department.
3f) "That no advertising shall be installed on the
gasoline pumps except that related to gasoline sales. "
Staff will not approve elimination of this condition.
6) "Gasoline sales to be conducted only in conjunction with
the washing of a vehicle, i.e. , only those receiving car
washes can purchase gas."
Staff will not approve this request because this condition was
initially placed on the operation to insure compatibility with
the Church activities.
C) Construction of a 225 sq.ft. office on the second floor. This
will require expansion of the existing false second story portion
of the structure and conversion into habitable space. The design,

materials and colors shall match the existing building.
Staff will approve this request. Addition of this office space
will not exceed the amount of available parking. No office space
in the Car Wash building may be sub-leased. Materials and colors of
the addition must match the existing building.
This proposal has been reviewed by the Director of Community
Development, who intends to approve part of the application and
deny part of the application, as previously set forth on August 18,
1992, with the appeal period ending September 3, 1992. Pursuant to
Resolution No. 88-523 the Director has the authority to approve
Minor Modifications. This matter is being presented to the Council
as a courtesy. Should the Council, or any other party, desire to
appeal the Director's decision, a public hearing should be
scheduled. The next available hearing date is September 16, 1992.
If the Council takes no action, then the Director's decision
stands.

PD 1066 MINOR MODIFICATION NO. 1
CONDITIONS OF APPROVAL
1 . Comply fully with all remedial and punitive reimbursement costs per
the City Tree Ordinance (Ordinance No. 101).
-K 2. Limit Sunday hours of operation of the entire site to begin ho earlier
than 12:00 noon. This limitation on Sunday hours of operation will remain
in effect only as long as the adjacent property is a church. A future Minor
Modification would be the vehicle for a request to change the hours of
operation in this circumstance.
3. Agree to all six conditions in the memorandum dated March 13, 1991
from Pat Richards "PD 1066 (Liston), Proposed Conditions regarding Gas
Sales" as listed below:
a. That no. delivery of any kind be made between the hours of
10:00 p.m. and 6:00 a.m. Monday through Sunday.
° b. That gasoline pump islands shall be limited to three (3) and no
more than two (2) gasoline delivery pumps shall be installed
on each pump island.
c. That there shall be no outside display of any automobile
products for sale (oil, anti-freeze etc.)
d. That all gas price signs shall be made part of an overall sign
program to be approved by the Director of Community
Development prior to the first occupancy of the auto service
building. A sign program shall be submitted to the Director of
Community Development prior to occupancy of the car wash.
e. That all necessary permits to store and sell flammable liquids
shall be obtained from the Ventura County Fire Department and
the Ventura County Environmental Health Department.
f. That no advertising shall be installed on the gasoline pumps
except that related to gasoline sales.
4. A revised Landscape Plan shall be submitted and be subject to
approval by the Director of Community Development. (The revised
landscape plan replaces the eleven trees which were removed with two
48" box and one 36" box and ten 24" box Ficus Nitida [Green Gem} trees.
The plan also includes a planter 65' in length and 4' in width on the
property of the Church for additional screening. Applicant to provide
written evidence to the City that will guarantee the long term viable
health and maintenance of the trees and groundcover on the adjacent
Church property. Additional trees along the entire perimeter of the
property is required by the City in the revised landscape plan for extra
shade and aesthetic value.
5. A noise attenuation block wall of a minimum of 8 feet in height
shall be constructed along the property line adjacent to the church as
approved by the Director of Community Development. The block wall is not
eight feet in height for its entire length, but only until the most westerly
offset; the wall shall be 6 foot in height from that point forward. The
Director of Community Development will determine the exact specific
termination with the applicant.
6. Gasoline sales to be conducted only in conjunction with the washing
of a vehicle, i.e., only those receiving car washes can purchase gas.
7. The applicant will be required to reimburse the city for all costs
incurred as a result of the tree removal and any deficiencies in the
planning costs for processing. These conditions shall be formally adopted
by the processing of a Minor Modification for the project.

Subject: Request for approval of PD 1066 Minor Modification #3
Dear City Council:
As your aware when I originally prepared my sign program Pat Richards, denied a
monument sign which was then left out of the sign program in order to get certificate
of occupancy. I have been working with the City for over a year to agree on a sign,
which has been designed to comply with the sign ordinances, which have all been
denied.
So now I am requesting that the City Council approve my monument sign. (Diagram
of sign is enclosed).
All building materials will conform with the existing structure. As the diagram
shows. This monument sign will be 19.96 feet tall and 54 square feet of signage on
two faces. Sign will be internally illuminated plus space will be provided for state
mandated gasoline pricing
Also,two sets of Texaco letters on the canopy in the spaces provided in the design of
canopy. Letters will also be Internally illuminated.
This will conclude the sign program as it was originally set out to be.
Minor Modification #1 PD 1066, was for the removal of trees that were to remain on
the property. .I would like to have removed all the language from the minor
modification that did not pertain to the removal of the trees. Enclosed is a copy of the
PD 1066 Minor Modification No. 1, (see highlighted information).

At this time I would also like to get permission to expand the center false two story
portion of the car wash. The larger two story portion would be over the existing
bathrooms, hallway, closet and office of the downstairs portion. The expanded size is
approximately 20 feet by 15 feet allowing enough room for a second story office to be
built. Naturally all building colors and materials will match existing building. (See
attached drawings for details).

through Saturday between the hours of 9:00 am and 6A0 pm, at the above phone
