SUBJECT: Consider Approval of the Revised Council of
Governments Joint Powers of Authority Agreement
Summary
The Council is in receipt of the revised Joint Powers Authority
(JPA) Agreement for the Council of Governments (COG). The COG
Steering Committee is requesting Council's reconsideration and
approval of the revised JPA.
Background
On July 1, 1992, Council approved the JPA for the formation of a
Council of Governments and appointed Mayor Lawrason as the City's
representative to the Executive Board.
Some of the cities and the County expressed concerns upon
consideration of the JPA. The Steering Committee, which includes
Mayor Lawrason, met with each of those jurisdictions in an attempt
to clarify or resolve their concerns. As a result the following
revision were made to the JPA that was previously approved by the
Council:
- Executive Board Meetings
Current: 12 meetings per year.
Revision: Not less than 9 meetings per year.

- Voting
Current: One vote per city member, five votes for the
County.
Revision: Same as the current language with the exception of
if /or the COG votes to increase the total annual
proposed budget for dues in excess of $200,000. In
that case a weighted vote will be used to increase
dues based on the percentage of the total dues a
jurisdiction contributes.
- Mission and Authority
Current: To be determined by the Executive Board.
Revised: Serve as a forum, assemble information, and explore
practical avenues for intergovernmental
cooperation.
- Withdrawal
Current: No member shall withdraw except upon an affirmative
vote by not less than two - thirds of the total
voting membership.
Revised: A member may withdraw upon written notice not less
than 60 days before the end of any fiscal year.
- Dues
Current: One- third;of all dues shall be borne by the County,
and the remaining two - thirds shall be shared by the
cities based 50 %' on population and 50% on equal
shares.
Revised: Same as current language with the addition that
total annual COG dues will not exceed $200,000
without a weighted vote of the governing body as
outlined in the section on voting.
These issues are discussed and approved by the full Steering
Committee and received the approval of the various city and county
representatives. Each jurisdiction is now being requested to
consider the JPA as revised for approval.
Recommendation
Staff recommends that Council approve the revised Joint Powers
Authority Agreement for - the formation of the Council of
Governments.
