SUBJECT: Consider Approval of a Mandatory Refuse Collection
Enforcement Policy
Background
At the City Council meeting of February 5, 1992, Council directed
staff to develop a solid waste collection enforcement policy to
implement compliance of the City's Solid Waste Ordinance.
The City's Solid Waste Ordinance, (Chapter 8.36, section 070),
effective March 1990, states that all "residential and commercial
customers in the City shall contract with the City or its agent for
the weekly removal of solid waste from their property." Although
the ordinance makes refuse collection mandatory in the City, the
establishment of a solid waste collection compliance (enforcement)
policy is necessary to ensure that the Ordinance and cost of
providing waste management services is equally applied to all
customers.
Furthermore, State law mandates that cities conduct waste reduction
programs, as well as monitor the amount of waste generated in the
City. Since some residents and businesses do not contract for waste
collection services, complying with the State requirements becomes
increasingly difficult.
Most the of City's residents and businesses comply with the Solid
Waste Ordinance, thereby providing financial assistance for the
City's solid waste management programs. Those who do not comply
(approximately 450 residents and 5 businesses) also benefit from
services and programs without bearing any costs.
The Public Works and Facilities Committee met with staff to
evaluate various alternatives to gain compliance. It is the
Committee's recommendation to pursue a voluntary compliance policy
for enforcement. If that policy proves unsuccessful, then a more
stringent approach may be considered.

Staff will provide residents and businesses with a voluntary
approach to gain compliance with the City's Ordinance. A letter
will be distributed to those residents and businesses not
contracting for waste collection service.
The letter will inform the resident or business that the City
requires them to contract for weekly removal of solid waste from
their property, and that non - compliance is an infraction of the
City's Municipal Code and may result in a monetary fine.
The residential letter will be accompanied with a curbside
recycling brochure, and will include an offer to waive the fifteen
dollar start -up fee for a limited time.
The objective of the voluntary compliance policy is not to penalize
individuals who do not comply with the City's Solid Waste
Ordinance. Rather it is to ensure that all members of the
community share equally in the cost of refuse disposal programs and
future waste reduction activities, as well as to afford them an
opportunity to initiate service consistent with the City's
Municipal Codes.
Six weeks after the letter writing campaign, Staff will assess the
impact of the letter and present the findings to Council.
The City and the Franchisees will make every effort to assist with
compliance.
Recommendation
The Public Works and Facilities Committee and Staff recommend that
the City Council:
I. Approve the proposed voluntary approach to seek
compliance with the City's Mandatory Solid Waste
Collection Ordinance.
II. Direct Staff to report back to the City Council no later
than the first City Council meeting in December, 1992.
