GEDNEY City Treasurer M E M O R A N D U M TO: The Honorable City Council FROM: Steven Kueny, City Manager DATE: August 1, 1985 SUBJECT: Cooperation Agreement for Participation in the Community Development Block Grant Program BACKGROUND: With the participation of all six ( 6 ) cities under 50 , 000 population in the County, the County of Ventura can qualify for Community Development Block Grant (CDBG) funding under the Urban County program. If any of the cities fail to participate, the County does not qualify as an Urban County. This is an Entitlement Program, which means that funding is guaranteed for a three ( 3) year period, as opposed to competing for funding on an annual basis. A copy of the County staff report is attached. The six ( 6) cities and Ventura County have agreed that the funds will be distributed on a per capita basis. The County will retain 160 of the program funds for administration 'of the program. Depending on the level of funding available each year, Moorpark would be eligible for about $100 ,000. 00 for each of the three ( 3 ) years. In order to participate, Moorpark must approve the attached Cooperation Agreement by August 12. Participation in this program could assist in funding several com- munity development projects in the City. SK:ddb attachments COOPERATION AGREEMENT COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS THIS AGREEMENT, made and entered into this 5th day of August, 1985 , by and between the COUNTY OF VENTURA, a political subdivision of the State of California (hereinafter called and the CITY Or MOORPARK a municipal corporation located within Ventura County (hereinafter "CITY" ) , W I T N E S S E ^' H : ;-,—HEREAS, the United States Department of Housing and Urban Development (hereinafter "HUD" ) has notified COUNTY that it is considered to have the required qualifications (determination of essential powers) to participate in the Community Development Block Grant (CDBG) program as an urban county as that term is defined in Title I of the Housing and Community Development Act of 1974 ,' as amended; and WHEREAS, the CDBG qualification process requires that following HUD ' s determination that a county possesses the essential powers to participate in the CDBG program as an urban _ county, that the units of general local government within the county be notified of their opportunity to participate in the county ' s program by entering into a cooperation agreement with the designated urban county; and WHEREAS, such cooperation agreements provide that the unit of general local government and the county will cooperate in community development and/or housing assistance activities and that the area and population of the unit of general local government will be included with that of the County by HUD in determining funding levels ; and WHEREAS, COUNTY has notified CITY of the opportunity to participate in COUNTY' S CDBG program; and WHEREAS, CITY desires to participate in and be a part of COUNTY' S CDBG program; NOW, THEREFORE, it is mutually agreed between COUNTY and CITY as follows : 1 . CITY shall participate in COUNTY' S CDBG program during Federal fiscal years 1986 , 1987 , and 1988 . (The Federal Fiscal year is a twelve month period commencing October 1 and con- tinuing through and including the following September 30) . 2 . COUNTY and CITY shall cooperate to undertake , or assist in undertaking, community renewal and/or lower income housing assistance activities, specifically "urban renewal and publicly assisted housing" . � . CITY shall undertake all actions necessary to carry out a cc=unity development program and the approved Housing Assis- tance Plan and comply with all CDBG program requirements and applicable Federal and State laws and regulations . 5 . COUNTY is expected to receive funding for the CDBG program HUD. These funds will be distributed to cities on a per capital allocation formula based upon total urban county popu- lation as set forth in rttachment "A" of this Agreement. In an effort to fairly allocate reimbursement for ac,;,i-istrative costs incurred by CITY under this Agreement, it is understood that in addition to the allocation in the foregoing, CITY will be. entitled to receive an amount for its administra- tive expenses . This amount will be a percentage, not in excess OF 11 c_ CITY ' S total annual share of funds from COUNTY for the perfor.-.=nce of this Agreement. 6 . This agreement shall remain in effect through the 1988 CDBG progra year (a program year is the twelve month period comniencing July 1 and continuing through and including the following June 30) . Neither COUNTY nor CITY shall terminate or withdraw from this agreement, unless COUNTY fails to qualify as an urban county or if COUNTY does not receive a Community Development Block Grant in any year of the three year period for which COUNTY is seeking to qualify as an urban county. 7 . COUNTY and CITY hereby assume the obligation to take all required actions to comply with the provisions of Title VI of the Civil Rights Act of 1964 , Title VIII of the Civil Rights Act of 1968, Section 109 of Title I of the Housing and Community Development Act of 1974 , and any and all other applicable laws, regulations , and orders . 8. COUNTY and CITY shall not obstruct the implementation of the approved three year housing assistance plan during the three program years for which COUNTY is seeking to qualify as an urban county. 9 . CITY understands and agrees that as part of COUNTY ' S CDBG program it will not be eligible for a CDBG entitlement or eligible to apply for grants under the Small Cities or State CDBG Programs for the three year period of COUNTY' s qualifi- cation unless COUNTY does not receive a grant in any year of the three year period. 10 . COUNTY shall assume no liability for the negligence of CITY or any officer, employee, or agent, thereof, and CITY shall hold CO',-"-N---, Y free and harmless from any loss , damage, or liability tnat -.;v arise out of the performance of this Agreement, except as c:..e_•.:i se be zrovided 'herein . S `1_Y shall indemnify COUNTY in the amount of any CITY under this Agreement which is determined by HUD to be such amount is charged against the COUNTY or with- ^eld from COUNTY ' S share of funds under the Act. COUNTY shall indemnify CITY in the amount of any COUNTY expenditure under this Agreement which is determined by HUD to be _mproper, if such amount is charged against the CITY or withheld frcT CITY' S share of funds under the Act. 11 . This agreement may only be modified by an instrument in writing executed by COUNTY and CITY and approved by HUD. 12 . For each Federal fiscal year during the term of this Agreement, COUNTY and CITY shall enter into a Supplemental Agree- ment which will have a term coinciding with said fiscal year and enumerate the project (s) CITY will implement with its entitlement =ands . Said Supplemental Agreement shall set forth the time schedule for completion of said project (s) . If substantial compliance with the completion schedule, due to unforeseen or uncontrollable circumstances, cannot be met by CITY, the schedule for the project (s) may be extended.
