Bankus, City Cler DATE _ November 21, 1985 S UB.7 E C T = Tape Duplicating Machine BACKGROUND: From time to time we receive requests for copies of tapes of our City Council and Commission meetings. Our present capability for reproduction is very limited and cumbersome, in that it is necessary to set up our recorder at a quiet location (sometimes difficult) and ask that the constituent bring in his/her own tape recorder and tapes, and then the constituent must record on a one-to-one basis (sometimes takes hours) . Not only is this time-consuming: on the part of the constituent, but also on staff, because we must continually monitor the taping, and in addition, there is always the risk of accidentally erasing the tape. The City Attorney has informed us that because we do tape our meetings (even if only for our own use), so long as those tapes are made and retained, we must make them available to the public to listen to on City equipment. We have received a quotation for a Telex Duplicating Machine which has the ability to reproduce a master tape within a few seconds' time. The cost of the machine is $525.00, plus tax, and we could expect delivery within ten days after placing the order. This item was not budgeted for the current fiscal year; however, because of the repeated requests for copies of tapes, it is our recommendation that you consider the purchase of this equipment at this time. The Budget Committee has concurred with this recommendation. If you concur with this recommendation, we would also request that you approve a fee schedule for tape duplication as set forth hereinafter. 799 Moorpark Avenue Moorpark, California 93021 (805)724-686- The Honorable City Council Lag 2 November 21, 1985 RECOMMENDATION: 1. Authorize purchase of Telex Duplicating Machine at a cost of $525.95, plus tax, at a total cost of $557.51, and that you allocate $560.00 from General Fund Reserve to Account No. 01-117-605 (Non-Departmental) to cover costs. 2. Approve the following fee schedule for tape duplication: (a) For copying a 90 minute tape (45 minutes each side), a fee of $25.00, with the City furnishing the tape; (b) For copying one side only of a tape (45 minutes), a fee of $15.00 with the City furnishing the tape. Tapes of Public Meetings When a tape recording is made to facilitate preparation of the minutes of a council, commission or board meeting: (a) any person may review the tape which includes the right to listen to it on City equipment; (b) any person may obtain a copy of the tape, which includes the right to buy a duplicate copy from the City or duplicate it himself, but does not include the right to have a written transcript made; and (c) the tape may be destroyed at any time if it was made and retained solely to facilitate preparing the minutes, but if it is preserved for public reference it can only be destroyed pursuant to Government Code Section 34090, et sec .
