TO: Honorable City Council BY: /.p FROM: Brian Chong, Administrative Services Manager& DATE: April 5, 2016 (CC Meeting of 4/20/16) SUBJECT: Consider Resolution Authorizing Submittal of Applications for CalRecycle Payment Programs and Funding Request Submittal for FY 2015/16 Beverage Container Recycling Grant BACKGROUND AND DISCUSSION The California Beverage Container Recycling and Litter Reduction Act provides funding to cities and counties for beverage container recycling programs. Programs are funded by the California Redemption Value (CRV) premium that is paid when consumers purchase beverages in cans, glass bottles, and plastic containers. Funding is distributed by the California Department of Recycling Resources and Recovery (CalRecycle) each year on a per capita basis, and the City of Moorpark is entitled to receive $9,344 in funding for FY 2015/16. The City previously received $9,418 in FY 2013/14 and $9,519 in FY 2014/15. For its 2015/16 funding cycle, CalRecycle is implementing a new requirement for the governing bodies of grantees to adopt a resolution authorizing submittal and administration of applications for its payment programs. Such a resolution was not previously required. Resolutions must be adopted prior to submittal of an application to CalRecycle for funding. Eligible activities for the expenditure of these funds include: • Support for new or existing curbside recycling programs • Neighborhood drop-off recycling programs • Public education promoting beverage container recycling • Litter reduction and cleanup where beverage containers are recycled • Cooperative regional efforts among two or more cities and counties, or both • Support for mandatory commercial and multi-family residential recycling • Other beverage container recycling programs 98 Honorable City Council April 20, 2016 Page 2 Staff recommends that the Council adopt the attached resolution authorizing submittal of applications for CalRecycle payment programs and also authorize the funding request submittal for a FY 2015/16 Beverage Container Recycling Grant. The funding request would allocate funds to support various beverage container recycling projects, programs, and future initiatives including: • Procurement and maintenance of permanent beverage recycling containers for park facilities, areas of high pedestrian travel, and City bus stops • Coastal Clean-up Day events • Recycling promotion and collection at city and community large events such as the 3rd of July, Country Days, and private sports tournaments at the Arroyo Vista Recreation Center Presently, the Beverage Container Recycling Grant program is an annual recurring grant. Upon acceptance and approval of the City's funding request, funds are received by the City. FISCAL IMPACT The recommended actions would request $9,344 in funding from CalRecycle, with no matching funds required. Any funds received must be expended on beverage container recycling projects by June 29, 2018. STAFF RECOMMENDATION Adopt Resolution No. 2016- and authorize submittal of a funding request to CalRecycle. Moorpark Page 2 of 2 Printed: 4/5/2016 101 RESOLUTION NO. 2016- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF APPLICATIONS FOR PAYMENT PROGRAMS AND RELATED AUTHORIZATIONS WHEREAS, pursuant to Public Resources Code sections 48000 et seq., 14581, and 42023.1(g), the Department of Resources Recycling and Recovery (CalRecycle) has established various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark authorizes submittal of an application to CalRecycle for any and all payment programs offered. SECTION 2. The City Manager, or a designee named by the City Manager, is hereby authorized as Signature Authority to execute all documents necessary to implement and secure payment. SECTION 3. This authorization is effective until rescinded by the Signature Authority or the City Council of the City of Moorpark. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this th day of 2016.
