HomeMy WebLinkAboutAGENDA REPORT 2012 0502 CC REG ITEM 09E ITEM 9_.E. pity Council W.eeting ACTION: MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Dave Klotzle, City Engineer/Public Works Director Prepared by: Shaun Kroes, Senior Management Analyst DATE: April 26, 2012 (CC Meeting of 05/02/12) SUBJECT: Consider Status Report on AB 1778 (Williams) Pertaining to Transit, and Streets and Roads Funding BACKGROUND/DISCUSSION As City Council is aware, SB 716 (Wolk) requires that all Transportation Development Act (TDA) funds be spent on transit services effective July 1, 2014. SB 716 also provided the Ventura County Transportation Commission (VCTC) with an opportunity to provide a report to the Legislature by December 31, 2011, analyzing options and providing a recommendation for organizing public transit services and the future expenditure of local transportation fund revenues in Ventura County. The Ventura County transit operators, including the City of Moorpark, has worked with VCTC for the past few months to finalize the report to the Legislature which was approved by VCTC on April 13, 2012. The report proposed improvements to transit services in Ventura County while also continuing to support some TDA money to be spent on streets and roads. If use of TDA money for streets and roads purposes is to continue, legislation amending SB 716 needs to be enacted. The full motion at VCTC, made by Councilmember Millhouse and approved on a nine to four vote, was: • Receive and file final VCTC Regional Transit Study. • Authorize the Executive Director to submit the Executive Summary of the study, as the plan called for by SB 716, to Senate Committee on Transportation and Housing and the Assembly Transportation Committee. • Authorize the Executive Director to pursue legislation consistent with Commission action on March 2, 2012 and for elements of the Executive Summary that require legislative action for implementation. • Include language from the Santa Paula letter in the Executive Summary. SAPublic Works\Everyone\Reports\Staff Reports\2012\May\05-02-12(AB 1778 Status Report).doc 128 Honorable City Council May 2, 2012 Page 2 • Add to final report, Section 3, page 17 following the final paragraph, "The Commission believes the proposal adopted by VCTC best addresses these concerns at this time." • A delegation determined by the Chair will meet with Assemblymembers Williams, Smythe and Gorell to discuss VCTC's concerns. • Delete recommendation #7 in the Executive Summary. • Delete pages 30-33 Policy Considerations in Final Report . • In the Final Report insert "The Commission will continue the discussion and study of a consolidation of transit operations within the County". On February 21, 2012, Assemblymember Das Williams introduced AB 1778. The proposed legislation would amend the dates adopted in SB 716 for both the report from VCTC to the Legislature and implementation of the provisions of SIB 716. Specifically, AB 1778 made the report to the Legislature a mandated responsibility of VCTC as opposed to the report being optional under SIB 716, while giving VCTC until January 31, 2013 to submit the report. AB 1778 as originally drafted also required that legislative action be completed and implemented by June 30, 2013, instead of July 1, 2014. The Moorpark City Council authorized the Mayor to sign a letter of opposition to AB 1778 on March 21, 2012. On March 28, 2012 AB 1778 was amended. The requirement for VCTC to submit a report to the Legislature was returned to an optional report, with the original December 31, 2011 deadline reinstated. AB 1778 was also amended to require that if the report's proposals for transit organization were not approved by the Legislature by the end of the 11/12 Legislative year then all TDA money would be required to be spent on transit effective July 1, 2013. The City of Moorpark currently spends approximately $700,000 a year on streets and roads, while fully funding transit services with a combination of TDA, Federal, and local revenue sources. An average of $400,000 of TDA revenue is spent on transit, supplemented by an additional $130,000 in City air quality funds. On April 17, 2012, AB 1778 was amended again. The new amendment required that all TDA funds in Ventura County could only be spent on transit effective July 1, 2014. The amendment also stated that if a respective jurisdiction in Ventura County allocated TDA funds for transit does not encumber all of the funds by the first year or does not spend the funds within two years of allocation, the unspent funds must be returned to VCTC to be redistributed to other transit operators or transit services in proportional amounts based on population, contingent upon specified criteria. AB 1778 as amended April 17, 2012, passed the Assembly Transportation Committee (member votes attached) and will now be forwarded to the Assembly Floor. At this time, a vote date has not been established, but could occur as early as the first week of May. 129 Honorable City Council May 2, 2012 Page 3 FISCAL IMPACT AB 1778 would result in the loss of TDA funding for streets and roads. STAFF RECOMMENDATION Continue to oppose AB 1778.
