City Council W� eetirie c l0 'a7D ACTION: MOORPARK CITY COUNCIL - 4 ,d4p&i AGENDA REPORT — -----�_ TO: Honorable City Council FROM: Jennifer Mellon, Administrative Services.Managel ` DATE: May 24, 2012 (CC Meeting of June 20, 2012) !/"" SUBJECT: Consider 2012 Update on Corrected Unmet Requirements Identified in the Americans with Disabilities Act (ADA) Transition Plan Adopted by City Council on June 16, 2010 BACKGROUND AND DISCUSSION Access to civic life by people with disabilities is a fundamental goal of the Americans with Disabilities Act (ADA). To ensure this goal is met, Title II requires State and local governments to make programs, services, and activities accessible to persons with disabilities. All public entities, regardless of size, must comply with Title II's requirements. Title II of the ADA requires all cities to perform self-evaluations of programs and services provided by the cities to determine whether ADA requirements are being met. Should the self-evaluations reveal unmet needs, cities must make modifications to comply.Whenever a city with fifty or more employees determines the need for modifications, that city must develop an ADA Transition Plan to delineate parameters for those modifications. The City of Moorpark (City) adopted an ADA Transition Plan and Self-Evaluation in June 2010. The ADA Plan identified unmet requirements to be corrected over a three-year period of time with majority of the suggested corrections in facilities and parks that were considered by the City to be in compliance with ADA standards when they were built. Staff prioritized the modifications so a substantial number could be completed quickly. The Fiscal Year (FY) 2009/10 budget appropriated $69,140 for these modifications, which included the $60,000 ADA walkway to playground equipment at Arroyo Vista Community Park (AVCP). The identified projects were completed at a cost of$68,195 in FY 2009/10. The budget for FY 2010/11 appropriated $66,020 for corrections and approximately $34,000 was appropriated in FY 2011/12 and beyond, until all modifications are met. The City has steadily corrected the majority of the unmet requirements identified in the ADA Plan and, to date, the City. spent $68,135 for corrections in FY 2009/10; spent $15,018 for corrections in FY 2010/11 (the Apricot Room handrails were not completed until FY 2011/12); and spent $17,073 for corrections in FY 2011/12. At the end of FY 2011/12 all unmet requirements identified in the City's self-evaluation were expected to be either corrected, found to be in compliance upon a second inspection, or onerous; however, four projects/items remain to be completed in FY 2012/13 including AVCP and 232 Honorable City Council June 20, 2012 Page 2 Villa Campesina Park parking lot projects, repositioning of the drinking fountain in the Community Center lobby, and work to address the Handicapped Parking spaces at the Moorpark City Library. There are also two costly Capital Improvement projects, the Campus Park Restroom modification and Country Trail Park ADA requirements,to possibly be completed in future years. For purposes of this project, onerous does not necessarily mean that the City does not intend to make the correction(s); rather, that the City cannot currently justify the costs of the corrections in the foreseeable future due to budgetary constraints. An example of such a high cost would be the necessity of reconfiguring restroom fixtures or walls to allow certain clearances in a restroom stall. The stall may be large enough in which to adequately turn a wheelchair, but may not measure the ADA requirement of 55" in width. The overall cost estimate for all corrections made between FY 2009/10 and FY 2011/12 has decreased due to the following reasons: (1) the cost estimates of corrections versus the actual costs of the corrections varied; (2)some of the unmet requirements identified in the ADA plan were found to be in compliance and were deleted; (3) some of the corrections scheduled in one fiscal year were completed in a different fiscal year,or will be, which effects the fiscal year cost but not the overall cost; and (4) reductions in cost due to specific items becoming associated with a Capital Project, i.e.the costs forthe Arroyo Vista Recreation Center parking lot pedestrian and curb ramp requirements were deleted from the ADA Plan since ADA requirements were included in the entire$100,000 capital project. Finally, several correction cost estimates turned out to be far too low due to consideration of additional ADA aspects not considered in the initial cost estimates. An example being the park restroom project,where initial determinations concluded the restroom stalls could be reconfigured at a relatively low cost; however, upon further analysis the restroom was found to need wall and fixture reconfiguration at a substantially higher cost. Because these unmet requirements are not currently scheduled for correction, the associated costs were deleted from the overall cost estimate for the three-year span of the initial corrections. During FY 2011/12, the City replaced the handrails for the stage in the Apricot Room (in the June 2011 ADA Update it was reported that this had been completed in FY 2010/11 and has since been corrected) and installed handrails in the front of the Administrative Services building, neither of which were required by the ADA Plan but enhanced accessibility. Enhancing accessibility beyond ADA requirements demonstrates the City's commitment to providing people with disabilities access to civic life. FISCAL IMPACT The original cost estimate, at the time the ADA Plan was adopted by Council in July 2010, for full implementation was estimated to be$169,160.The revised cost estimate, minus the capital projects, is expected to be $105,913.
