and Revisions and Amendment No. 2 to the Agreement with
Center Glass Company No. 9 for the Ruben Castro Human
Services Center
BACKGROUND & DISCUSSION
The Ruben Castro Human Services Center (RCHSC) is being constructed as a multiple-
prime contract project with construction management provided by Barnhart Balfour-
Beatty Construction (Balfour-Beatty). Bids were solicited from trades in September,
2010, opened on October 21, 2010 and bids were awarded by the Moorpark City
Council on January 19, 2011. Center Glass Company No. 9 (Center Glass) was
selected as the lowest responsive and responsible bidder for the Glass and Glazing bid
package and a construction agreement was executed on April 11, 2011.
During the course of construction the County of Ventura Health Care Agency and other
future tenants have requested various additions or modifications to their suites including
addition of security glass for the medical center and addition of interior suite windows for
Catholic Charities. These changes were issued as Amendment No. 1 to the
Construction Agreement and within the available contingency amount.
An additional change was requested by the City of Moorpark to add an exterior door
(originally specified as a window) into the Shared Space Conference Room located in
Building B, thereby permitting the space to be used after hours without the need to
access the Catholic Charities suite. The cost for this change was $3,171.00 as shown
on Exhibit F of Attachment 1. A recap of the contract costs to date is shown below:

Currently there is $1,643.75 in contingency available under Center Glass's contract.
The cost for the glass and glazing additions and revisions is $3,171.00 which exceeds
the available contingency. Therefore staff is seeking the approval of this additional
amount.
FISCAL IMPACT
The Capital Improvement budget for the Ruben Castro Human Services Center (Fund
5020) is $11,038,064. To date $7,934,754 has been expended with $2,568,203 left in
encumbrances and $535,107 available project balance. Therefore, no additional funds
need to be budgeted for the proposed work at this time. Sufficient funds exist in the
budget to cover this work.
STAFF RECOMMENDATION (ROLL CALL VOTE)
Approve additional funding in the amount of$1,643.75 for glass and glazing changes for
the Ruben Castro Human Services Center and authorize the City Manager to execute
Amendment No. 2 in the amount of $3,171.00 to Center Glass Company No. 9 subject
to final language approval of the City Manager and City Attorney.

FOR BID PACKAGE #11 — GLASS AND GLAZING
AT THE RUBEN CASTRO HUMAN SERVICES CENTER
THIS SECOND AMENDMENT TO THE AGREEMENT FOR BID PACKAGE #11 —
GLASS AND GLAZING ("Second Amendment"), is made and entered into this
day of , 2012, ("the Effective Date") between the City of
Moorpark, a municipal corporation, hereinafter referred to as "CITY", and Center Glass
Company No. 9, a California corporation, hereinafter referred to as "CONTRACTOR".
WITNESSETH:
WHEREAS, on April 11, 2011, the CITY and the CONTRACTOR entered into an
Agreement for glass and glazing for the Ruben Castro Human Services Center; and
WHEREAS, on June 21, 2012, the CITY and the CONTRACTOR executed a
First Amendment for glass and glazing for the Ruben Castro Human Services Center;
and
WHEREAS, the CITY wishes to further amend the Agreement to include the
addition of one (1) exterior aluminum storefront door and hardware in Conference Room
104 in Building B at a cost not-to-exceed three thousand one hundred seventy-one
dollars ($3,171.00) described in Exhibit F dated January 31, 2012 and attached hereto
as part of this Second Amendment; and
WHEREAS, this total dollar amount of $3,171.00 exceeds the ten percent (10%)
contingency amount approved with the original Agreement; and
WHEREAS, on July 18, 2012, the City Council of the City of Moorpark approved
additional funding for this glass and glazing work.
NOW, THEREFORE, in consideration of the mutual covenants, benefits, and
premises herein stated, the parties hereto AMEND the aforesaid Agreement follows:
I. Section 2 of the Agreement is amended to include:
CONTRACTOR'S Scope of Services is amended to include the labor and
materials required to:
• delete one (1) fixed glass "A"-type window, and furnish and install one (1) exterior
aluminum storefront door and associated door hardware in Conference Room
104 in Building B in response to the request of the City, the architect of record's
Instruction Bulletin #15R, and per CONTRACTOR'S Proposal (11.03).

The Scope of Services for the additional glass and glazing services is described
in the CONTRACTOR'S Proposal dated January 31, 2012, attached hereto and
incorporated herein as Exhibit F respectively to the Agreement by this Second
Amendment.
II. Section 7 of the Agreement is amended to include:
CITY hereby increases the not-to-exceed amount of $216,156.25 under this
Agreement by $3,171.00 to $219,327.25.
III. Remaining Provisions
All other terms and conditions of the original Agreement shall remain in full force
and effect.

Attached you will find supplemental instructions from the Owner's Representative on the issues stated
below for the above referred project. Balfour Beatty Construction is requesting your company to review
the Instruction Bulletin #15R and determine if there will be any impact or coordination issues to your
scope of work per your contract and or plans and specifications. There will be a five (5) working day
response time allowance for any possible cost,time or coordination impacts to be brought to our attention
and returned with sufficient data to back up the claim of the impact on original scope of work. Include with
the response, detailed explanation on how the response has impacted the original scope of work, a
breakdown of additional labor, material needed to complete the issue(s) at hand. If sufficient data is not
included claim will be rejected. Please reference Instruction Bulletin#15R on all correspondence.
Attached is Instruction Bulletin#15R dated November 7, 2011 instructing all trades to revise door
at building B in accordance with attached Clarification Drawings CD-A15.1, CD-A15.2 and
CDA15.3R,CD-A15.4 and revised Specification Section 08710.
Scope by Trade:
GENERAL NOTE:Work items listed in this section are for clarification only and are not intended to
be a comprehensive list of inclusions. It is the responsibility of each Trade to identify and include
all plant, labor material, and equipment necessary to complete the work of his Bid Package as
shown on the attached plans or contained in specifications.
BID PACKAGE No. 11 —GLASS&GLAZING:
A. Furnish and install all aluminum entrances and storefront systems complete, including but not
limited to; aluminum frame system, spacers, shims, setting blocks, gaskets, reinforcement
sections, fasteners, sealants, glass, glass setting accessories, all specified and/or required
hardware for a complete operating system including but not limited to; panic devices, hinges,
stops, sill sweeps, thresholds, push/pull devices, lever devices, closers, hold opens, door stops
and locks.
B. Provide a credit for the deleted aluminum window B12 complete including but not limited to; fixed
extruded aluminum windows, glass and glazing and perimeter sealants for a complete system
installation per the plans and specifications.
C. Furnish and install head, jamb and sill aluminum flashings at aluminum systems per plans and
specifications.
D. All keying requirements including temporary keying per plans and specifications.
E. Temporary construction locks until final keying is released to proceed.
F. Caulking/joint sealant of aluminum openings, window frame openings, and all glass systems to
adjacent surfaces for weather tight seal, inside and outside regardless of sequence of installation
of other Trade Contractor work.
G. Cleaning as required per plans and specifications of any materials scheduled to receive paint or
other finishes.

A. Coordinate, furnish and install revised metal stud framed openings for items which pass into or
thru metal stud walls, ceiling or soffits including but. not limited to; door/window openings,
structural framing penetrations.
B. Cleaning as required per plans and specifications of any materials scheduled to receive paint or
other finishes.
