MOORPARK CITY COUNCIL City council w�metinc- AGENDA REPORT °Xlf ION: � TO: The Honorable City Council FROM: Allen Walter, Landscape/Parks Maintenance Superintendent DATE: September 17, 2012 (CC Meeting October 17, 2012) SUBJECT: Consider the Extension of the Azteca Landscape Services Agreement Annual Compensation, Including Contingency Amount for the Term of the Agreement Beginning July 1, 2012, and Expiring on June 30, 2015 DISSCUSSION On June 21, 2011, the City and Azteca Landscape Services entered into an Agreement pertaining to landscape maintenance services at the Moorpark Landscape Maintenance District Citywide Zones, Zones of Benefit, and Miscellaneous Properties, totaling $461,183.00 The term of the Agreement is from July 1, 2011, through June 30, 2012, and upon the mutual consent of both parties, the term of the Agreement may be extended for three (3) additional one (1) year periods expiring on June 30, 2015. On January 18, 2012, the City Manager approved Amendment No. 1 to the June 21, 2011, Agreement for various landscape maintenance services and contingency amount of fifteen percent (15%), in the amount of $69,177.00 and weed abatement services for $4,800.00, increasing the total annual Agreement amount to $535,160.00. On June 28, 2012, the City Manager approved Amendment No. 2 to the June 21, 2011, Agreement extending the Term of the Azteca Landscape Services Agreement twelve (12) months, through June 30, 2013. However, the provisions provided in the Azteca Landscape Services Agreement, only extended the Term of the Agreement. The provisions of the Agreement did not specifically extend the compensation for another year of service. Therefore, staff is requesting the Council authorize extension of the Azteca Landscape Services Agreement compensation of $1,605,480.00 which includes 15% contingency in the amount of $221,931.00 for the additional three (3) one (1) year periods, expiring on June 30, 2015, unless sooner terminated as provided for within the Agreement. 162 City Council Meeting October 17, 2012 Page 2 FISCAL IMPACT $535,160.00 has been included in the FY 2012/13 operation budget. Staff is not requesting additional appropriations to cover this cost in fiscal year 2012/13 approved annual budget. In FY 2013/14 and FY 2014/15, staff will include $535,160 to the Lighting and Landscape Maintenance District operating budget to cover these cost, should the City extend the service Agreement at that time. STAFF RECOMMENDATION: Authorize the City Manager to approve Amendment No. 3, increasing the compensation for the Landscape Maintenance Services Agreement with Azteca Landscape Services for three (3) additional one (1) year periods at a total cost of $1,605,480.00, which includes three (3) years of landscape services at a total cost of $1,383,549.00,15% contingency at a total of $207,532.00 and three (3) years of weed abatement services at a total cost of $14,440.00 expiring June 30, 2015, unless sooner terminated, as provided for within the Agreement. The landscape maintenance services shall be extended at an annual cost of $535,160.00, subject to final language approval by the City Manager and the City Attorney. 163
