Bardavid (Continental Garden Restaurant, Inc.). Staff Recommendation: 1) Open the public hearing, accept public testimony and close the public hearing; and 2) Adopt Resolution No. PC-2016- approving Conditional Use Permit No. 2016- 01 with conditions of approval and making a determination of exemption under CEQA in connection therewith. Carrillo) All writings and documents provided to the majority of the Commission regarding all agenda items are available for public inspection at the City Hall public counter located at 799 Moorpark Avenue during regular business hours. Staff Recommendation: 1) Open the public hearing, accept public testimony and close the public hearing; and 2) Adopt Resolution No. PC-2016- recommending to the City Council approval General Plan Amendment No. 2015-01, Zone Change No. 2015-02, subject to a Deed Restriction Requiring a Specific Plan and Development Agreement for the undeveloped hilltop property and contribution of an initial deposit of $20,000.00 toward the preparation of the Specific Plan. Staff Recommendation: 1) Find the draft Seven Year Capital Improvement Program for the Department of Public Works for FY 2015/16 - FY 2021/22 to be in conformity with the Moorpark General Plan, except as noted above; and 2) Find the planned acquisition of street right-of- way for certain specified projects described in this report, to be in conformity with the Moorpark General Plan. Bardavid (Continental Garden Restaurant, Inc) BACKGROUND On April 19, 2016, Michel M. Bardavid, for Continental Garden Restaurant, Inc, submitted an application for a Conditional Use Permit (CUP) to allow the operation of an approximately 2,142 square-foot restaurant and approximately 1,000 square-foot outdoor dining area with on-site service of beer, wine, and liquor at 6593 Collins Drive, #D-5 and #D-6 within the Campus Plaza shopping center. DISCUSSION Project Setting Existing Site Conditions: The Campus Plaza shopping center includes a mix of services, restaurants, gas station, and school office. The shopping center shares the parking lot with a Shell gas station, McDonalds and Starbucks. Access to center is from Collins Drive and Campus Park Drive. 3 Honorable Planning Commission May 24, 2016 Page 2 Previous Applications: • On April 2, 2003, the City Council adopted Resolution No. 2003-2071 approving Commercial Planned Development Permit No. 2000-04 and Tentative Parcel Map No. 5264 for the construction of an approximately 72,285 square-foot shopping center and subdivision of approximately 6.28 acres into four parcels on the southwest corner of Campus Park Drive and Collins Drive. • On February 26, 2008, the Planning Commission adopted Resolution No. 2008- 527, approving a CUP to allow alcoholic beverage (including liquor) sales for off- site consumption at a proposed Circle-K convenience store, at 6595 Collins Drive, Suite B. This CUP expired through discontinuation of the use. • On November 25, 2008, Planning Commission adopted Resolution No. 2008- 540, approving a CUP to allow a restaurant with sale and service of beer and wine for on-site consumption at 6593 Collins Drive, Suite D-4. The permit is still active and currently used by Eddymame the Grill. • On January 27, 2009, Planning Commission adopted Resolution No. 2009-542, approving a CUP to allow full service restaurant with beer, wine, and liquor sales for on-site consumption at 6593 Collins Drive, Suite D-18 and D-19. Building permits were never issued for a restaurant. Permit has expired through non-use. The Zoning Ordinance requires Planning Commission approval of a Conditional Use Permit for restaurants with or without sales of alcoholic beverages in the Commercial Planned Development (CPD) Zone when within 100 feet of residentially zoned property. This allows for consideration of the compatibility of the proposed use with surrounding uses in making findings on the application, and adoption of conditions of approval as deemed necessary. ANALYSIS Issues Staff analysis of the proposed project has identified the following area for Planning Commission consideration in their decision: • Control of Alcoholic Beverage Service • Concentration of Uses • Outdoor Dining Control of Alcoholic Beverage Service Staff analysis of the proposed project has identified control of the service of alcoholic beverages as the primary issue for Planning Commission consideration in their review of the CUP application. Conditions are recommended by staff to address security concerns associated with the service of alcoholic beverages. These conditions are consistent with those recently applied to other restaurants in Moorpark with alcoholic beverage service. The applicant has requested hours of operation from 10:00 a.m. to 12:00 a.m. (midnight). This is consistent with the permitted hours of operation of the shopping center, which are 5:00 a.m. to 12:00 a.m. (midnight). Staff is recommending a condition as follows: "Sales, service, or consumption of beer, wine, and liquor is permitted only between the hours of 10:00 a.m. and 12:00 a.m. (midnight) each day of the week." In addition, staff is also recommending a condition as follows: "Alcoholic beverages shall be stored out of reach from customers. Such storage shall be to the satisfaction of the Community Development Director." The Moorpark Police Department has reviewed this application and has no issues with the alcohol license at this location. S\Community Development\DEV PMTS\C U P\2016\CUP 2016-01 Continental Garden\Agenda Reports\MOORPARK PLANNING COMMISSION docx 5 Honorable Planning Commission May 24, 2016 Page 4 Concentration of Uses As mentioned above, the overall Campus Plaza shopping center currently has a total of one tenant that is permitted to serve or sell alcoholic beverages. Eddymame the Grill is operating under a Type 41 (On Sale Beer & Wine — Eating Place - (Restaurant)) license. This permit authorizes the sale of beer and wine for consumption as part of a bona fide eating place. Minors are allowed on the premises. The applicant is proposing to operate under a Type 47 (On Sale General — Eating Place — (Restaurant)) license. This permit authorizes the sale of beer, wine, and liquor for consumptions on the licenses premises. The eating place must operate and maintain the licensed premises as a bona fide eating place. Minors are also allowed on the premises. The State Department of Alcoholic Beverage Control (ABC) will not issue a license unless the applicant has obtained the necessary permit from the City. In its analysis, the ABC measures the number of businesses selling alcoholic beverages by census tract, and compares this number to other census tracts in the area and derives a target number of establishments based on population. If a census tract would exceed the target number of establishments, then findings of public convenience and necessity need to be made for an ABC permit to be issued. ABC relies on localities to determine whether or not findings of public convenience and necessity can be made when there is an overconcentration of establishments in a census tract. The project site is located in the Census Tract 76.14. ABC allows a total of eight licenses for on-site consumption in this tract without meeting the definition of over- concentration. Four exist at this time. Based on these numbers, the ABC has determined that there is not an over-concentration of alcohol permits in this Census Tract. This finding is one of the required findings for a CUP, unless findings of public convenience and necessity can be made. Outdoor Dining The applicant has indicated a desire for future outdoor dining on the existing patio, including serving of beer, wine, and liquor. The existing patio is designed to allow for outdoor dining; however ABC has specific requirements for fencing of outdoor alcohol service areas. . Staff is recommending a condition to address this requirement as follows: "Outdoor fencing that meets the standards of the California Department of Alcoholic Beverage Control (ABC) and outdoor furniture must be high quality, durable, and compatible with the design of the shopping center, subject to review and approval by the Community Development Director, prior to installation. The applicant shall submit photographs of the fencing, furniture and umbrellas to the Community Development Director for review and approval prior to the issuance of any building permits for the outdoor dining patio. No service of alcoholic beverages will be allowed in the outdoor dining areas without City-approved fencing that meets State standards." Findings 1. The proposed use is consistent with the provisions of the City's General Plan, Zoning Ordinance, and other applicable regulations as conditioned in that the service of alcoholic beverages for on-site consumption is in conjunction with an approved restaurant, a use consistent with the General Plan and Zoning. 2. The proposed use is compatible with both existing and permitted land uses in the surrounding area, in that this is an approved restaurant/bar where alcoholic beverages typically are served for on-site consumption. 3. The proposed use is compatible with the scale, visual character, and design of surrounding properties, in that the use does require a significant modification to the exterior of the approved building, which is permitted through a Permit Adjustment. 4. The proposed use would not be obnoxious or harmful, or impair the utility of neighboring property or uses in that conditions are required to ensure proper control of the service of alcoholic beverages for on-site consumption. 5. The proposed use would not be detrimental to the public interest, health, safety, convenience, or welfare, in that conditions are required to ensure proper control of the service of alcoholic beverages for on-site consumption. ADDITIONAL FINDINGS FOR ESTABLISHMENTS SERVING ALCOHOLIC BEVERAGES: 1. The use will not result in an over concentration in the area of establishments serving alcoholic beverages in the area, as these sales are ancillary to the service of food from this restaurant. 2. The use will serve a public convenience, in that the service of alcoholic beverages for on-site consumption is an ancillary use to the primary use of the building as a restaurant. 3. The use will not create the need for increased police services, in that conditions are required to ensure proper control of the service of alcoholic beverages for on- site consumption. The requested use at the proposed location will not adversely affect the economic welfare of the community. 5. The exterior appearance of the structure will not be inconsistent with the external appearance of commercial structures already constructed or under construction on surrounding properties, or within the immediate neighborhood so as to cause blight, deterioration or substantially diminish property values within the neighborhood. PROCESSING TIME LIMITS Time limits have been established for the processing of development projects under the Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the Subdivision Map Act (Government Code Title 7, Division 2), and the California Environmental Quality Act Statutes and Guidelines (Public Resources Code Division 13, and California Code of Regulations, Title 14, Chapter 3). Under the applicable provisions of these regulations, the following timelines have been established for action on this project: Date Application Determined Complete: May 2, 2016 Planning Commission Action Deadline: July 29, 2016 Upon agreement by the City and Applicant, one 90-day extension can be granted to the date action must be taken on the application. ENVIRONMENTAL DETERMINATION In accordance with the City's environmental review procedures adopted by resolution, the Community Development Director determines the level of review necessary for a project to comply with the California Environmental Quality Act (CEQA). Some projects may be exempt from review based upon a specific category listed in CEQA. Other projects may be exempt under a general rule that environmental review is not necessary where it can be determined that there would be no possibility of significant effect upon the environment. A project which does not qualify for an exemption requires the preparation of an Initial Study to assess the level of potential environmental impacts. Based upon the results of an Initial Study, the Director may determine that a project will not have a significant effect upon the environment. In such a case, a Notice of Intent to Adopt a Negative Declaration or a Mitigated Negative Declaration is prepared. For many projects, a Negative Declaration or Mitigated Negative Declaration will prove to be sufficient environmental documentation. If the Director determines that a project has the potential for significant adverse impacts and adequate mitigation cannot be readily identified, an Environmental Impact Report (EIR) is prepared. No further environmental documentation is required. NOTICING Public Notice for this meeting was given consistent with Chapter 17.44.070 of the Zoning Ordinance as follows: 1. Publication. The notice of the public hearing was published in the Ventura County Star on May 13, 2016. 2. Mailing. The notice of the public hearing was mailed on May 13, 2016, to owners of real property, as identified on the latest adjusted Ventura County Tax Assessor Roles, within one-thousand (1,000) feet of the exterior boundaries of the assessor's parcel(s) subject to the hearing. 3. Sign. One 32 square foot sign is to be placed on the street frontage by May 13, 2016. STAFF RECOMMENDATION 1. Open the public hearing, accept public testimony and close the public hearing; and 2. Bardavid, for Continental Garden Restaurant, submitted an application for a Conditional Use Permit (CUP) to allow the operation of an approximately 2,142 square-foot restaurant and approximately 1,000 square-foot outdoor dining area with on-site service of beer, wine, and liquor at 6593 Collins Drive, #D-5 and #D-6 (within the Campus Plaza shopping center); and WHEREAS, at a duly noticed public hearing on May 24, 2016, the Planning Commission considered Conditional Use Permit (CUP) No. 2016-01; and WHEREAS, at its meeting of May 24, 2016 the Planning Commission considered the agenda report and any supplements thereto and written public comments; opened the public hearing and took and considered public testimony both for and against the proposal; closed the public hearing and reached a decision on this matter; and WHEREAS, the Community Development Director has determined that proposed Conditional Use Permit (CUP) No. 2016-01 is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Class 1 Categorical Exemption: Existing Facilities) of the California Code of Regulations. CUP No. 2016-01 would allow for the operation of an approximately 2,142 square-foot restaurant and approximately 1,000 square-foot outdoor dining area with on-site service of beer, wine, and liquor within an existing shopping center which is currently approved and used for a mix of services, restaurants, gas station, and school office, and the use is consistent with the applicable general plan designation and all applicable general plan policies and applicable zoning designation and regulations. In addition, there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The Planning Commission concurs with the Community Development Director's determination that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies under the Class 1 PC ATTACHMENT 4 13 Resolution No. PC-2016- Page 2 exemption under State CEQA Guidelines Section 15301 (existing facilities) because CUP No. 2016-01 would allow for the operation of an approximately 2,142 square-foot restaurant and approximately 1,000 square-foot outdoor dining area with on-site service of beer, wine, and liquor within an existing shopping center which is currently approved and used for a mix of services, restaurants, gas station, and school office, and the use is consistent with the applicable general plan designation and all applicable general plan policies and applicable zoning designation and regulations. In addition, there is no substantial evidence that the project will have a significant effect on the environment. The Planning Commission has reviewed the Community Development Director's determination of exemption, and based on its own independent analysis and judgment, concurs with the determination of exemption. SECTION 2. CONDITIONAL USE PERMIT FINDINGS: Based upon the information set forth in the staff report(s), accompanying studies, and oral and written public testimony, the Planning Commission makes the following findings in accordance with City of Moorpark, Municipal Code Section 17.44.040: 1. The proposed use is consistent with the provisions of the City's General Plan, Zoning Ordinance, and other applicable regulations as conditioned in that the service of alcoholic beverages for on-site consumption is in conjunction with an approved restaurant, a use consistent with the General Plan and Zoning. 2. The proposed use is compatible with both existing and permitted land uses in the surrounding area, in that this is an approved restaurant/bar where alcoholic beverages typically are served for on-site consumption. 3. The proposed use is compatible with the scale, visual character, and design of surrounding properties, in that the use does require a significant modification to the exterior of the approved building, which is permitted through a Permit Adjustment. 4. The proposed use would not be obnoxious or harmful, or impair the utility of neighboring property or uses in that conditions are required to ensure proper control of the service of alcoholic beverages for on-site consumption. 5. The use will not result in an over concentration in the area of establishments serving alcoholic beverages in the area, as these sales are ancillary to the service of food from this restaurant. 2. The use will serve a public convenience, in that the service of alcoholic beverages for on-site consumption is an ancillary use to the primary use of the building as a restaurant. 3. The use will not create the need for increased police services, in that conditions are required to ensure proper control of the service of alcoholic beverages for on-site consumption. 4. The requested use at the proposed location will not adversely affect the economic welfare of the community. 5. The exterior appearance of the structure will not be inconsistent with the external appearance of commercial structures already constructed or under construction on surrounding properties, or within the immediate neighborhood so as to cause blight, deterioration or substantially diminish property values within the neighborhood. The development must be in substantial conformance with the plans presented in conjunction with the application for Conditional Use Permit No. 2016-01, except any modifications as may be required to meet specific Code standards or other conditions stipulated herein. Any future changes to the parking or vehicle storage layout shall require review and approval by the Community Development Director. 8. The City of Moorpark reserves the right to modify, suspend or revoke for cause this conditional use permit consistent with Chapter 17.44 of the Moorpark Municipal Code or as may be amended in the future. 9. Conditional Use Permit No. 2016-01 may be revoked or its use suspended by the City, if any of the causes listed in Section 17.44.080.B of the Zoning Code are found to apply, including if the use for which the permit was granted has not been exercised for at least twelve (12) consecutive months, has ceased to exist, or has been abandoned. The discontinuance for a period of one hundred eighty (180) or more days of a nonconforming use or a change of nonconforming use to a conforming use constitutes abandonment and termination of the nonconforming status of the use. 10. A separate sign permit application must be submitted for all proposed signs, for the review and approval of the Community Development Director prior to issuance of a building permit for a sign. 11. Games or contests requiring or involving the consumption of alcoholic beverages shall not be permitted at any time. 12. Entertainment is not approved as part of this Conditional Use Permit and requires approval of a separate permit. 16. Music and amplified sound, whether live or pre-recorded, may only take place inside the building and not exceed a volume that can be heard from beyond the property. All activities on the property must comply with the City's noise regulations. 17. Food items shall be available for purchase for on-site consumption during all hours of operation to the satisfaction of the Community Development Director. 18. Security personnel must be provided to monitor the parking area(s) designated for use by customers of the restaurant during any activity that may require the need for additional security. The applicant shall work with the Police Department, Fire Department, and Community Development Department staff to determine which activities shall require additional security. The owner/manager shall be required to obtain Temporary Use Permit approval from the City of Moorpark when a scheduled activity could create a need for increased police presence. 19. The applicant shall reimburse the City of Moorpark for any additional police or other costs incurred by the City as a result of operations approved by this Conditional Use Permit, including fifteen (15%) percent overhead on any such services. 20. The permittee must correct any safety or security problem within three (3) days upon written notice of such a problem from the Moorpark Police Department. 21. Outdoor fencing that meets the standards of the California Department of Alcoholic Beverage Control (ABC) and outdoor furniture must be high quality, durable, and compatible with the design of the shopping center, subject to review and approval by the Community Development Director, prior to installation. The applicant shall submit photographs of the fencing, furniture and umbrellas to the Community Development Director for review and approval prior to the issuance of any building permits for the outdoor dining patio. No signs or banners may be printed on, embroidered on, or attached to in any way any part of the umbrella fabric. The applicant shall comply with Chapter 8.32 PROHIBITING SMOKING IN PUBLIC PLACES at all times and shall provide signs consistent with Section 8.32.040 of the Moorpark Municipal Code to the satisfaction of the Community Development Director, prior to initiation of the uses allowed by this permit. Any smoking area, if desired, shall comply with Section 8.32.030 of the Moorpark Municipal Code. 24. No person under the age of eighteen (18) shall serve or package alcoholic beverages. 25. All exterior areas of the site, including parking areas under use by the facility, shall be maintained free of litter and debris at all times. 26. "Walk-in" alcohol service for non-restaurant patrons is not permitted at any time. Alcoholic beverages may only be sold/served to patrons of the facility during dining events. Food meal service must be available during all business hours that alcoholic beverages are sold. 27. Areas inside the establishment open to customers must be illuminated sufficiently to allow the identification of persons to the satisfaction of the Police Chief. 28. The applicant or his/her designee shall be responsible to police the exterior of the business to assure that no beer, wine, or liquor is consumed within the parking lot. The applicant shall not permit any loitering in the parking lot or in areas adjacent to the facility. 29. No exterior advertising of any kind or type is allowed promoting or indicating the availability of alcoholic beverages. Interior displays of beer, wine, or liquor that are clearly visible to the exterior shall constitute a violation of this condition. 30. No increase of floor area is permitted without approval of an additional permit. 31. Prior to the issuance of a Zoning Clearance for tenant occupancy, the applicant shall submit a Developer Waste Reduction and Recycling Plan to the satisfaction of the Community Services Administrative Services Manager. 32. These two small parcels had been acquired from Caltrans and were incorporated into the existing Sunbelt Enterprises development on the west side of Princeton Avenue south of State Highway 118 as part of the parking lot and landscaping for the site. On September 29, 2015 Sunbelt Enterprises, LLC filed applications for a General Plan Amendment and Zone Change to create a consistent general plan land use and zoning designations among all four lots under the same ownership on this 36-acre site. This would allow for a future lot line adjustment so that three existing individual buildings on the site would be located on their own lots, and one remaining large vacant lot would be created for future development (the "hilltop" lot). 22 Planning Commission May 24, 2016 Page 2 The proposed General Plan Amendment would be to change the land use designation on the two small remnant freeway parcels (0.04 acres and 0.57 acres) from Freeway/Right of Way to I-1 (Light Industrial). The site also includes a contiguous 0.30 acre lot fronting on Princeton Avenue. This lot is zoned Rural Exclusive 1-acre minimum (RE-lac), but has a General Plan land use designation of Light Industrial (I-1), the same as the rest of the site. The applicant is requesting a Zone Change on this parcel to Industrial Park (M-1) to be consistent with the rest of the site and to be consistent with its General Plan land use designation. DISCUSSION Project Setting Existing Site Conditions: The overall project site consists of three large industrial buildings on a 36-acre site. The site has been graded as two distinct pads, with the lower pad developed with the aforementioned buildings and the upper pad remaining undeveloped. Access to the parking lots is from three driveways on Princeton Avenue. The parking lots are landscaped, whereas the slopes leading to the upper lot are largely natural vegetation. Previous Applications: Resolution No. 85-249 was adopted on November 4, 1985 for General Plan Amendment 85-3, Development Plan DP-318 and LDM-5 on the project site on the application of Fred Kavli (Kavlico Corporation). The permit allowed the construction of a 130,288 square foot industrial building and division of an existing 55.9 acre parcel into two lots. Much of the site was dedicated for the SR 118/23 interchange as part of the lot split map. Resolution No. 93-914 was adopted on February 9, 1993, approving Major Modification No. 1 to Development Plan No. 318, on the application of Fred Kavli. The permit allowed a 91,549 square foot building. Resolution No. 97-1412 was approved on December 17, 1997, approving Industrial Planned Development Permit No. 97-3 on the application of Sunbelt Properties (Fred Kavli). The permit allowed a one-story 42,146 square foot industrial building on the project site. In 2000, Mr. Kavli (dba Kavlico) filed several applications to add parking, landscaping and lighting within the two lots for which a General Plan Amendment is now requested. On October 31, 2013, Kavlico submitted Pre-Application 2013-04 for a development concept for five (5), two-story medical office buildings on a nine (9) acre site as a separate lot. On November 12, 2013 the Moorpark Development Review Committee, comprised of City staff and staff from other agencies involved in development review, met to discuss this Pre-Application and determined that a General Plan Amendment \\DC1\Department Share\Community Development\DEV PMTS\G P A\2015\2015-01 Sunbelt(Kavlico)Hilltop\Agenda Reports\Sunbelt PC Staff Report(RC Draft).docx 2 3 Planning Commission May 24, 2016 Page 3 would be required on the two remnant freeway properties to develop the site as findings of General Plan consistency are required whether the 9-acre development lot is created through a lot line adjustment or through a parcel map. On October 28, 2014, Sunbelt Enterprises LLC filed a General Plan Amendment Pre- Screening application, required by code (MC 17.44.050), seeking authorization to file the current General Plan Amendment and Zone Change applications. That request was reviewed by the Community and Economic Development Committee consisting of Councilmembers Mikos and Pollock, and was approved on July 1, 2015 by the full City Council, provided that the General Plan Amendment be subject to a deed restriction that the undeveloped hilltop portion of the property could not be developed prior to the preparation and adoption of a Development Agreement and a Specific Plan that includes this property. Included in this authorization was the requirement for the developer to contribute an initial deposit of $20,000.00 toward the cost of the Specific Plan prior to recordation of a lot line adjustment on this property. Goal: Achieve a well-balanced and diversified economy within the City which provides a variety of economic and employment opportunities. • A balanced job/housing ratio should be encouraged. • New commercial and industrial uses which will generate long-term employment opportunities and diversify the community's employment base shall be encouraged. Goal: Enhance the physical and visual image of the community. • New development shall be compatible with the scale and visual character of the surrounding neighborhood. Circulation Element Goal: Provide a circulation system which supports existing, approved and planned land uses throughout the City while maintaining a desired level of service on all streets and at all intersections. • Level of service "C" shall be the system performance objective for traffic volumes on the circulation system. Goal: Provide a citywide system of safe, efficient and attractive bicycle and pedestrian routes for commuter, school, and recreational use. • New development and redevelopment projects shall be required to include safe, separate, and convenient paths for bicycles and pedestrians so as to encourage these alternate forms of non-polluting transportation. • Proposed residential, commercial, and industrial developments shall be required to include bikeways in their street improvement plans, consistent with the Circulation Element Bikeway Network Plan, and to construct the bicycle paths, or lanes, or routes as a condition of project approval. ANALYSIS The designation of the two lots subject to the General Plan Amendment is FRWY-RNV (Freeway Right-of-Way), which was intended for the development of the freeway. The two lots were created after the freeway was developed and determined to be surplus by Caltrans as they were not needed for the freeway. The proposed General Plan Amendment would change their land use designation to be the same as other private property adjacent to the freeway right-of-way in this vicinity. Additionally, as mentioned above, the site includes a contiguous 0.30 acre lot that fronts on Princeton Avenue. This lot is zoned Rural Exclusive 1-acre minimum (RE-1 ac), but has a General Plan land use designation of Light Industrial (I-1). A change to Industrial Park (M-1) zoning on this property would be consistent with the rest of the site, and would be consistent with the General Plan land use designation. It would also provide street frontage for the vacant hillside portion of the property, once a lot line adjustment separates this area from the developed portions of the site. Adjacent properties on the north side of Princeton Avenue, also with an I-1 General Plan land use designation and RE-lac zoning, have been all acquired by the City of Moorpark for the Princeton Avenue Street Widening Project. A future use of the remaining portions of these City- owned lots after street widening has not yet been determined. The buildings already developed, and their parking facilities, are in an appropriate location for uses permitted by M-1 Zoning, as they are bounded by freeway right-of-way on the north and west, and industrial uses on the east. In order to achieve consistency with the General Plan and provide certainty to both the City and developer on public improvements associated with this project, a development agreement and specific plan would be required as part of any future entitlement applications for future development of the hilltop site. \\DC1\Department Share\Community Development\DEV PMTS\G P A\2015\2015-01 Sunbelt(Kavlico)Hilltop\Agenda Reports\Sunbelt PC Staff Report(RC Draft).docx 2 6 Planning Commission May 24, 2016 Page 6 In order to preclude piecemeal planning of this area, and to ensure potential circulation issues from the development of the vacant hilltop property are properly addressed, the City Council has required that a Development Agreement and Specific Plan be required for any proposed development of that site. Staff would determine the boundaries of such a Specific Plan, as it would be appropriate to include surrounding properties. In order to guarantee funding for the preparation of the Specific Plan and Development Agreement, the applicant has agreed to contribute an initial deposit of $20,000.00 toward the cost of preparing the Specific Plan and place a deed restriction on the future hilltop lot restricting future development until such time as the Specific Plan is completed. A future owner would thus be on notice to comply with the deed restriction and apply for a Specific Plan and Development Agreement in order to develop the property. FINDINGS The Industrial Park (M-1) zoning as proposed under Zone Change No. 2015-02 is consistent with the General Plan. PROCESSING TIME LIMITS Time limits have been established for the processing of development projects under the Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the Subdivision Map Act (Government Code Title 7, Division 2), and the California Environmental Quality Act Statutes and Guidelines (Public Resources Code Division 13, and California Code of Regulations, Title 14, Chapter 3). Since this project proposal requires consideration of a General Plan Amendment and Zone Change, which are legislative matters, it is not subject to processing time limits under the Permit Streamlining Act. ENVIRONMENTAL DETERMINATION In accordance with the City's environmental review procedures adopted by resolution, the Community Development Director determines the level of review necessary for a project to comply with the California Environmental Quality Act (CEQA). Some projects may be exempt from review based upon a specific category listed in CEQA. Other projects may be exempt under a general rule that environmental review is not necessary where it can be determined that there would be no possibility of significant effect upon the environment. A project which does not qualify for an exemption requires the preparation of an Initial Study to assess the level of potential environmental impacts. Based upon the results of an Initial Study, the Director may determine that a project will not have a significant effect upon the environment. In such a case, a Notice of Intent to Adopt a Negative Declaration or a Mitigated Negative Declaration is prepared. For many projects, a Negative Declaration or Mitigated Negative Declaration will prove to be sufficient environmental documentation. The Director has reviewed this project and found it to be Categorically Exempt in accordance with Section 15301 (Class 1, Existing Facilities) of the California Code of Regulations (CEQA Guidelines). The General Plan Amendment involves small properties already in use. The Zone Change would not change the use of the property on Princeton Avenue and would provide consistency with the General Plan land use designation. No development would result from these actions. At the time that development of the hilltop lot is proposed, a separate environmental determination will be prepared. No further environmental documentation is required. NOTICING Public Notice for this meeting was given consistent with Chapter 17.44.070 of the Zoning Ordinance as follows: 1. Publication. To help effectuate the outcomes sought by the Land Owner and the City as outlined in Recitals A - F above, the Land Owner has agreed to encumber the Hilltop Parcel in accordance with the covenants and obligations set forth below. NOW, THEREFORE, subject to the terms contained herein, Land Owner hereby covenants, acknowledges and agrees to restrict the Hilltop Parcel as follows: 1. Restriction. Any development of the Hilltop Parcel shall be conditioned upon the occurrence of the following and no development on the Hilltop Parcel shall occur until the following shall have occurred: (i) the Specific Plan and the Development Agreement, all in form and content acceptable to the City, approved and adopted by the City; (ii) those documents shall have become effective; (iii) ninety (90) days shall have thereafter elapsed without any legal challenge having been filed (or if filed, shall have been dismissed or the Specific Plan and Development Agreement shall have been upheld), and (iv) all other governmental permits and approvals for the development shall have been issued. 2. Term. This Deed Restriction shall become effective upon its recordation in the Official Records of Ventura County, California (the "Official Records"), which shall be concurrent with the recordation of the Lot Line Adjustment in the Official Records, and this Deed Restriction (including, without limitation, Section 3 below) shall be binding upon the Land Owner, and each other person and entity having any interest in the Hilltop Parcel during their ownership thereof, and their respective grantees, heirs, executors, administrators, successors and assigns, until such time as the Specific Plan and the Development Agreement, shall have been approved and adopted by the City, shall have become effective, and ninety (90) days shall have thereafter elapsed without any legal challenge having been filed (or if filed, shall have been dismissed or the Specific Plan and Development Agreement shall have been upheld), at which point this Deed Restriction shall automatically terminate and have no further force or effect. Indemnification/Release. Each of Land Owner and the Trust (and all successors-in-interest to all or any portion of the Hilltop Parcel) agrees to jointly and severally indemnify, defend and hold the City harmless from all 12853-0014\1852283v3.doc 2 1263961.! 34 third party claims arising from this Deed Restriction, and each of Land Owner and the Trust (and such successors-in-interest) hereby waives and releases the City from any claim regarding the effect of this Deed Restriction on the value and future development of the Hilltop Parcel. The indemnification obligations of each of Land Owner and the Trust pursuant to this Section 3 shall terminate upon the termination of this Deed Restriction. 4. Payment of City Costs. As consideration for the City's approval of the Lot Line Adjustment and General Plan Amendment, Land Owner agrees to pay to the City the amount of Twenty Thousand and No/100 Dollars ($20,000.00), upon recordation of the Lot Line Adjustment in the Official Records. Said amount shall be applied by City to City's costs of preparing and processing the Specific Plan and the Development Agreement. Costs incurred by City may include but shall not be limited to costs of City staff (including city overhead), planning, civil engineering, traffic engineering, legal and other professional services and consultants determined necessary by City in its sole discretion to prepare the Specific Plan and related actions and Development Agreement and, if necessary, to defend approval of the Specific Plan and related actions and Development Agreement. All contract costs and out of pocket costs (such as mapping and printing) incurred by City and payable by Land Owner shall be increased by fifteen percent (15%) for City administrative costs. Notwithstanding the foregoing, in the event that the costs incurred by the City in connection with its preparation and approval of the Specific Plan and the Development Agreement exceeds $20,000, then the applicable assignee of Land Owner shall reimburse the City for such costs incurred above and beyond $20,000, provided, however, that the total amount payable to the City pursuant to this Section 4 shall not under any circumstances exceed $100,000. Except as expressly provided herein, neither Land Owner nor any of its successors and/or assigns shall have any further financial obligation with respect to the costs of preparing the Specific Plan and the Development Agreement, and all such costs over and above the total amount payable to the City pursuant to this Section 4 shall be borne entirely by the City. As in past years, prior to City Council action approving the CIP, it is necessary that the Planning Commission first review the document and render a finding with regard to its conformity with the Moorpark General Plan, as required by Section 65401 of the Government Code of the State of California. This staff report summarizes the recommended changes from the previous CIP, and requests that the Planning Commission render its finding with regard to General Plan conformity. Also included in this report is a description of certain projects which require acquisition of additional street right-of-way, and a request that said acquisitions are also in conformance with the Moorpark General Plan, as required by Section 65402 of the Government Code of the State of California. DISCUSSION A. General Plan Conformity Public Works, Engineering and Community Development staff has reviewed the draft CIP and have confirmed the following: 40 Honorable Planning Commission May 24, 2016 Page 2 1) All of the future streets and other Public Works projects listed in the Circulation Element and other elements of the Moorpark General Plan have been included in the CIP. 2) The Circulation Element of the Moorpark General Plan designates Moorpark Avenue to be a two lane local collector. CIP Project 113: Moorpark Avenue Widening calls for the widening of Moorpark Avenue to more than two (2) lanes. Said project is, therefore, inconsistent with the provisions of the Circulation Element of the Moorpark General Plan. 3) Except as noted above, the projects listed in the subject draft CIP are in conformance with the Moorpark General Plan. Staff is currently working to update and revise the Circulation Element and will present this document to the City Council in the near future. It is the intent of staff to include in the recommended changes, a different designation for Moorpark Avenue which will allow for more than two (2) lanes of traffic. B. Introduction This is the updated Seven Year Capital Improvement Program (CIP) for the City of Moorpark, Department of Public Works for the period covering FY 2015/16 through FY 2021/22. The primary purpose of this CIP is to provide the City Council with a framework for identifying, planning and prioritizing needed municipal capital improvements. The year each project is recommended to be funded, is an indication of the priority given to each project. The figures cited in the FY 15/16 column, should be identical to the appropriations approved in the FY 2015/16 Budget for capital improvement projects for(8000 series). Projects have been organized into the five (5) Sections noted below. The projects identified in this CIP include both City funded projects as well as major projects which are likely to be constructed by land developers. The projects listed in Section 100 include future streets which are identified in the Circulation Element of the Moorpark General Plan. The projects listed in Section 500 include future needed storm drains identified in the Moorpark Master Drainage Study. Also included in Section 500 are certain projects of importance to the City which are planned to be constructed by the Ventura County Watershed Protection District. Congestion Management Program The purpose of the Ventura County Transportation Commission's (VCTC) Congestion Management Program (CMP) is to monitor certain street segments and/or intersections on the CMP Road Network (see Map), to confirm that the Level of Service (LOS) [a measurement of the level of congestion] on those segments, or at those intersections, does not deteriorate below certain stipulated levels. Increased traffic generated by development is one of the major causes of increased traffic congestion and, therefore, the deterioration of the LOS. The CMP requires each Agency to identify projects designed to increase capacity and/or otherwise improve the efficient and effective movement of traffic. The projects set forth in this seven year program,which are on the CMP Road Network and which could reduce congestion, are listed on the following page.
