SUBJECT: Consider Access Agreement with Ventura County Transportation
Commission and Consider Access Agreement with Union Pacific
Railroad Company to Provide Maintenance of the Railroad
Crossing Improvements at Spring Road (Project 8039)
BACKGROUND AND DISCUSSION
On October 17, 2012, the City Council of the City of Moorpark(Council)authorized the City
Manager to execute the Construction and Maintenance Agreement (Agreement) with
Southern California Regional Rail Authority (SCRRA) for the Railroad Crossing
Improvements at Spring Road subject to final language approval by the City Manager and
the City Attorney. Because the City, under terms and conditions of the SCRRA
Agreement, will have maintenance responsibilities on properties belonging to both the
Ventura County Transportation Commission (VCTC) and the Union Pacific Railroad
Company (UPRR), it will be necessary for the City to obtain from both the VCTC and
UPRR access authority in order to comply with the SCRRA Agreement.
Staff is working with VCTC and UPRR to finalize language for access agreements and it is
anticipated that the access agreements will become exhibits to the SCRRA Agreement.
STAFF RECOMMENDATION
1) Authorize the City Manager to execute an access agreement with the Ventura
County Transportation Commission for maintenance of the Railroad Crossing
Improvements at Spring Road relating to Project 8039, subject to final language
approval by the City Manager and the City Attorney; and
2) Authorize the City Manager to execute an access agreement with Union Pacific
Railroad Company for maintenance of the Railroad Crossing Improvements at
Spring Road relating to Project 8039, subject to final language approval by the City
Manager and the City Attorney.
