HomeMy WebLinkAboutRES CC 2016 3512 2016 0615 RESOLUTION NO. 2016-3512 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 2016, FOR THE ELECTION OF CERTAIN OFFICERS OF THE CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES; AND FOR THE SUBMISSION TO THE VOTERS OF A CERTAIN BALLOT MEASURE FOR THE RE-ADOPTION AND EXTENSION TO THE YEAR 2050 OF THE CITY OF MOORPARK URBAN RESTRICTION BOUNDARY LINE (MOORPARK CURB) ORDINANCE ENTITLED "MOORPARK SAVE OPEN-SPACE AND AGRICULTURAL RESOURCES — 2050 INITIATIVE, OR MOORPARK SOAR — 2050" AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF VENTURA TO CONSOLIDATE SAID MUNICIPAL ELECTION WITH THE STATE GENERAL ELECTION ON SAID DATE, PURSUANT TO SECTION 10403 AND 10418 OF THE ELECTIONS CODE WHEREAS, under the provisions of the laws relating to general law cities in the State of California, a General Municipal Election shall be held on November 8, 2016, for the election of Municipal Officers; and WHEREAS, pursuant to authority provided by statute, a petition has been filed with the legislative body of the City of Moorpark, California, signed by more than 10 percent of the number of registered voters of the City to submit a proposed Moorpark Save Open- space and Agricultural Resources—2050 initiative, or Moorpark SOAR—2050 Ordinance to the voters; and WHEREAS, the City Clerk has ascertained that the petition has been signed by the requisite number of registered voters of the City and has so certified; and WHEREAS, the City Council is authorized and directed by statute to submit the proposed ordinance to the voters of the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, there is called and ordered to be held in the City of Moorpark, California, on Tuesday, November 8, 2016, a General Municipal Election for the purpose of electing a Mayor for the full term of two (2) years and two (2) Members of the City Council for the full term of four (4) years. SECTION 2. That the City Council, pursuant to its right and authority, does order submitted to the voters of the City at the General Municipal Election on November 8, 2016, the following question: Resolution No. 2016-3512 Page 2 Shall the Ordinance entitled "Moorpark Save Open-space and Yes Agricultural Resources — 2050 initiative" ("Moorpark SOAR — 2050") be adopted to extend with certain amendments the provisions of the 1999 voter-approved Moorpark SOAR from December 31, 2020 to December 31, 2050 and continue to No prohibit the City of Moorpark from permitting urban services or urbanized uses of land outside the current Moorpark City Urban Restriction Boundary (CURB) with certain exceptions during that extended period? SECTION 3. That the proposed complete text of the ballot measure ordinance submitted to the voters is attached hereto as Exhibit A. SECTION 4. That the ballots to be used at the election shall be in form and content as required by law. SECTION 5. That pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Ventura is hereby requested to consent and agree to the consolidation of said Municipal Election with the Presidential General Municipal Election on Tuesday, November 8, 2016. SECTION 6. That the City of Moorpark acknowledges that the consolidated election will be held and conducted in the manner prescribed in Section 10418 of the Elections Code. SECTION 7. That the polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day, when the polls shall be closed, except as provided in Section 14401 of the Elections Code of the State of California. SECTION 8. That said Board of Supervisors is hereby requested to issue instructions to the County Clerk to take any and all steps necessary for the holding of said consolidated election. SECTION 9. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 10. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give such further or additional notice of the election, in time, form, and manner required by law. SECTION 11. That pursuant to the provisions of Elections Code Section 15651(a) and City Council Resolution No. 2010-2929, a tie vote shall be resolved and determined by lot. That the City Clerk of the City of Moorpark is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the County Clerk of the County of Ventura. SECTION 13. TIN! This initiative measure shall be known as the Moorpark Save Open-space and Agricultural Resources 2050=dative,or Moorpark SOAR-2050 SeeSoa 2. Purees. and Findtoas. A. The purpose of the initiative is to readopt for the City of Moorpark its existing Urban Restriction Boundary. The Moorpark City Urban Restriction Boundary(Moorpark CURB)line readopthon and extension to the year 2050 hal the following objectives 1. lb continue to aucceset lly promote stability in long term planning for the City by eetabliehmg a cornerstone policy within the General Plan desigeatmg the geographic limits of long term urban development and allowing sufficient gemblhty within those limns to respond to the City's changing needs over time, 2 To continue to encourage efficient growth patterns and protect the(Sty ofMompark's quality of 11th by concentrating funs development largely within existing developed areas consistent with the availability of miestone a and semen 3. As importunity,we have learned that adopting a geographic urban limit line around the City of Moorpark has promoted the formation and continuation of a cohesive commumty by defining the boundaries and by helping to prevent urban sprawl Such a boundary hes promoted efficient municipal services and famlmes by confining urban development to defined development areas 3 The protection of existing open-space,watershed,vlewshed and agricultural lands,within and surrounding the City of Moorpark has been and is of critical imponanoe to present and figure residents of the City of Moorpark Agriculture has been and remains a myon contributor to the economy of the Moorpark area and County of Ventura,directly and indirectly creating employment fur many people and generating substantial tax revenues for the City and its surrounding area. 4. In particular,the City of Moorpark is a component of Ventura County and a gate-keeper to the surroundmg area,with its unique combination of sods, micro-climate and hydrology,which has become one of the finest growing:evens in the world. Vegetable end fruit production from the County of Ventura and more particularly from the sods and silt from the Arroyo Sum,the entire Callegma watershed area,the Tierra Rada Valley and alluvial plains arbacmt to the Qty have achieved international acclaim,enhancing the City's economy and reputation. 5. This initiative ensures that the Goals and Policies relating to Agriculture(Goal 11 and Polices 11 I through 11 3)and Preservation of Environmental Quality(Goal 14 and 15)and Policies 14.1 through 14.6 and Policies 15.1 through 153, 15.5,and 15 g of the General Plan are mvrolable against transitory short-term political decisions and that agricultural,watershed end open apace lands ere not prematurely or unnecesearily converted to other non-agricultural or non-open space uses without public debate and a vote ofthe people Aamidagly,the=native mance that until llwemher 9l 9010 the City of M..cipark shall,with minor exceptions,restrict the provision of urban services,and creation of urban uses,other than m certain circumstances end according to specific procedures set forth m the initiative,to within the City Urban Restriction Boundary restated and readopted by this=hative 6.
