5 to the Agreement with Standard Drywall, Inc. for the Ruben Castro
Human Services Center
BACKGROUND & DISCUSSION
The Ruben Castro Human Services Center (RCHSC) was constructed as a multiple-
prime contract project with construction management provided by Barnhart Balfour
Beatty Construction (Balfour-Beatty). Bids were solicited from trades in September,
2010, opened on October 21, 2010 and bids were awarded by the Moorpark City
Council on January 19, 2011. Standard Drywall, Inc., (SDI) was selected as the lowest
responsive and responsible bidder for the Finishes bid package and a construction
agreement was executed on April 12, 2011. The original contract amount was for
$2,175,000 with a contingency amount of $217,500.
The design of the RCHSC included an exterior trellis element to provide both
architectural interest and shaded areas to reduce direct afternoon sunlight into building
windows and offer shaded retreats for patrons visiting the center. The architect
specified a composite material called "Trex" for the construction of the sunshade
element.
During the final exterior construction and installation of the Trex onto the steel outrigger
supports, a concern was raised by Balfour-Beatty's construction team about the span
distances for this material and bending and twisting of the Trex material which was
being seen. The architect of record, HMC Architects (HMC), requested that a full
section of the trellis be completely installed prior to making a final determination on the
performance of the material. Upon completion of an installation of a full section of the
Trex material, a subsequent proposed supporting retrofit, and direct contact with the
manufacturer, Balfour-Beatty and City representatives determined that the Trex material
was improperly specified for the intended use, and that an alternative material would be
required. A Report from Balfour-Beatty supporting this determination is Attachment 1.

The Trex material is primarily used in deck construction. The manufacturer would not
warrant the use of the Trex material to span beyond 16 to 24 inches without additional
lateral support, as it would most likely sag over time. (See Attachment 2- Photograph of
the Trex originally installed)
Balfour-Beatty, together with City staff, sought alternative materials, including different
sizes and thicknesses of tube steel, angle iron, and "C" channel to replace the original
Trex composite lumber. While material and pricing costs were being collected, Balfour-
Beatty also researched a manufacturer called Airolite, which produces a number of
sunshade products including louvers, grilles, and other sun control applications. A
rendering of the staff-recommended alternative is Attachment 3.
Balfour-Beatty compiled pricing for the various alternative materials and labor from the
structural steel contractor, Steelcon, Inc. Additionally, Balfour-Beatty obtained costs for
the installation of the Airolite product from two other trades who hold licenses required
to install this specific product; Best Contracting, Inc., and Standard Drywall, Inc. SDI
presented the most competitive cost for installation of the Airolite sunshades. A recap
of the alternative materials and costs, including labor is provided below.

Based on factors including the original design appearance intent, ability to attach to the
existing outriggers, labor cost for installation, and future maintenance costs, City
representatives and Balfour-Beatty concurred that the Airolite sunshade product would
be the overall superior choice of the various alternatives available to replace the Trex
composite material. An additional consideration is that the Airolite closely resembles the
shade features used above south and west facing windows in Building A.The total cost
for the material and installation of the Airolite sunshades is $160,772.

The Trex material has already been purchased at a cost of $3,500 and cannot be
returned to the supplier and therefore the Trex material has been transferred to the
City's possession. The City will seek reimbursement from HMC in the amount of $3,500
to cover the cost of the Trex material that cannot be used on the project and the cost for
the partial installation of one section of the TREX and for its removal $1,400 for a total
of $4,900. Balfour-Beatty has agreed to provide installation supervision at no cost to the
City.
There have been four previous amendments issued for changes, modifications, and
construction alterations requested or required during the course of construction. A
recap of the original contract and amendments issued to date is provided below:

Currently there is $104,867.15 in contingency remaining within SDI's contract. The cost
for the installation of the sunshade is $160,772 which exceeds the remaining
contingency by $55,904.85. Therefore staff is seeking the approval of this additional
amount for the installation of the revised sunshade material.
FISCAL IMPACT
The actual Contract Change Order is summarized as follows:
• SDI labor and Materials for Airolite installation $ 175,588
• SDI give back for original Trex materials and install ($ 14,816)'`
• Adjusted cost for Airolite install $ 160,772
*SDI has given back the entire material and labor SOV for the Trex in the change
request they provided for the Airolite change.
The Fiscal Year 2012/2013 Capital Improvement budget for the Ruben Castro Human
Services Center (Fund 5020) is $13,770,119. To date $12,017,801 has been expended
with $1,488,816 left in encumbrances and $263,501 available project balance.
Therefore, no additional funds need to be budgeted for the proposed work at this time.
Sufficient funds exist in the budget to cover this work.

STAFF RECOMMENDATION
Approve additional funding in the amount of $55,904.85. for installation of revised
exterior architectural sunshade material for the Ruben Castro Human Services Center
and authorize the City Manager to execute Amendment No. 5 in the amount of
$160,772 to. Standard Drywall, Inc., subject to final language approval of the City
Manager and City Attorney.

Re; Exterior Trellis/Sunshade feature at Building B
Dear Mr. Riley,
As you are aware, the City and Balfour Beatty Construction (BBC) have concerns with the materials
specified as the sunshade cover for the exterior trellis/sunshade feature located at the West, South and
East facades of Building B.
As indicated and specified in the Contract Documents, a trellis/sunshade feature is indicated and detailed
at Building B.This trellis/sunshade is to provide partial building shading and an architectural element to
the Project. Construction of the trellis/sunshade feature includes equally spaced (10 feet to 15 feet on
center)freestanding structural steel columns with structural steel outriggers in addition to structural steel
outriggers attached to the exterior of the building (structural steel columns supporting the outriggers are
concealed in the building exterior walls). Trex material is then specified and detailed to be installed on
edge (tall face of the material set in a vertical position) on top of the outriggers in perpendicular
orientation to the structural supports. Trex(mfr. name) is fabricated from synthetic materials and is
compressed to closely resemble a natural wood framing member.Along the South and East treiiis
features, 2x4 Trex material was specified, at the West trellis feature, 2x6 Trex material was specified due
to the longer spans between the structural steel support system.
About the second week of August, 2012, installation of the Trex material at the East fagade and the South
fagade starting from the East working to the West was started. Immediately following installation of
several sections of the system, it became apparent that the nature of the Trex material would not maintain
a straight line along the material length. The material, although fastened to the structural support system
per the plan details, developed for lack of better terms, a wavy appearance along with a horizontal sag
between the outrigger supports.Along the length of the Trex members, spacing varied significantly and a
sag of+1/2" between the outriggers was evident. Concerned with the appearance of the installation, we
suspended further installation pending further review by the HMC Architects.
On August 20, 2012, following confirmation by BBC that all specified and detailed directions were
followed during installation of the Trex material, RFI#0326 was submitted to HMC Architects for their
review and response. Included in the RFI were comments received from the material manufacture stating
the specified material was not designed to span more than 16"-20" between supports.As mentioned
above, the structural steel support system is spaced equally between 10 feet and 15 feet. Response to
the RFI was received August 22, 2012 indicating options to install additional spacers at a 24" interval
and/or suggest pricing for replacement of the specified materials with similar shaped aluminum members,
fiberglass members or perforated flat sheet metal material. Installation of the additional spacers was
performed to confirm if the suggestion resolved the uneven spacing of the Trex members. Although the
spacing was improved,the fix did not fully eliminate the uneven spacing (photo# 1) nor the material sag
between support members (photo#2).
Preliminary pricing for optional trellis/sunshade materials was then initiated. Optional materials included
various sizes and shapes of aluminum tube and steel tube sections however the preliminary pricing was
performed without final details and specifications from the Architect.An outline of the preliminary costs for
optional materials is attached for reference.As of this date, no further formal direction or formal
recommendation has been received from the Architect.

In consideration of the City's review, a concern raised with various material options was future
maintenance expenditures that the City had not forecasted in the Project's maintenance program. Use of
a steel product would require periodic repainting. Considering the total length of material required being
approximately 8,200 lineal feet, prep and repaint of the system would be costly and very time consuming.
Aluminum finishes could be factory applied but are expensive.
After further discussion and research by the City and BBC, a secondary option is being considered. At
Building A(VCMC), prefabricated aluminum eyebrow sunshades have been installed. Using this same
concept, the supplier of the sunshades has developed a proposal to provide pre-fabricated sunshade
sections that are pre-finished and engineered to span the existing structural steel support system.
Installation pricing is in progress and will be shared with the City immediately upon receipt.At that time
discussion will take place considering all options including effectiveness and cost impact of each option.
The intent of these discussions will allow for a final selection of the most cost effective and lowest
maintenance solution. Included in the decision will be credit back to the City for the unused cost for
installation of the originally specified Trex materials. The Trex material itself is not returnable and will be
handed over to the City for its discretionary use.

Plan sheet A4.3 shows the layout of the trellis system along the West, South and East sides of Bldg B.
Sheets A6.3 and A6.4 indicate the attachment of the 2 x 4 Trex Transcend composite wood system on
top of the canopy steel. Sheet A4.3 shows the Trex material to span anywhere from 8'-6"to 15'
between canopy beams.
During installation on August 15, 2012 there appeared to be an aesthetic issue with the Trex
composite wood system being installed at the East end of Bldg B. Upon review of the wood, when
installed on top of the canopy spanning approx 10' between beams is showing signs of the wood not
being straight in line and sagging. This observation was shared with HMC the same day.
Balfour Beatty contacted the Manufacturer via email on August 15th requesting clarification on the
approved span of the Trex material. The Trex manufacturer responded initially on August 16th and
provided an updated response on August 17th stating the following;

"Thank you for your question to Trex. We do not recommend spanning our 2 x 4's 10'on edge; the
longest span recommended is 2'on center.
Please let me know if I can be of further assistance. Again, thank you for contacting Trex."

"Thank you for contacting the Trex Company. We do not suggest the use of our deck boards on edge.
If you are using a Trex 1'board you would have to install it 16'on center, this will give you 100
pounds per square foot which is required for a residential deck. If your joist are 24'on center you can
use the 2'board this will provide a 100psf.

Based on the provided information from the manufacturer,the design of Trex material was not
intended to be used on its edge nor span a distance more than 2'on center. This information was
relayed via a phone conversation to HMC stating that there is an issue with the design of the canopy
trellis system. On the afternoon of August 16, 2012, Balfour Beatty Construction requested Standard
Drywall, the Trade installing the Trex material, to stop the installation as the product is not being
installed per manufacturer's recommendations and cannot be warranted by the manufacturer.
Balfour Beatty Construction is requesting that HMC Architects either provide a resolution allowing the
use of Trex material that meets the manufacturer's recommendation &can be warranted or provide an
alternative product or system to be installed in its place.
Recommendation We have several options: have the contractor install more
of the spacers, perhaps at 2' centers; replace with similar

FIFTH AMENDMENT TO AGREEMENT 2011-107

AT THE RUBEN CASTRO HUMAN SERVICES CENTER
THIS FIFTH AMENDMENT TO THE AGREEMENT FOR BID PACKAGE #12 — FINISHES
("Fifth Amendment"), is made and entered into this day of ,
2012, ("the Effective Date") between the City of Moorpark, a municipal corporation,
hereinafter referred to as "CITY", and Standard Drywall, Inc., a California corporation,
hereinafter referred to as "CONTRACTOR".
WITNESSETH:
WHEREAS, on April 12, 2011, the CITY and the CONTRACTOR entered into an
Agreement for finishes for the Ruben Castro Human Services Center; and
WHEREAS the CONTRACTOR has executed four previous Amendments to the
Agreement totaling an amount not-to-exceed one hundred and twelve thousand six
hundred thirty-two dollars and eighty-five cents ($112,632.85) increasing the total not-to-
exceed amount to two million two hundred eighty-seven thousand six hundred thirty-two
dollars and ninety-six cents ($2,287,632.96) for finishes for the Ruben Castro Human
Services Center; and
WHEREAS, the CITY wishes to further amend the Agreement to include additional
work to perform installation of revised exterior trellis materials as Amendment No. 5 to the
Agreement with Standard Drywall, Inc., for the Ruben Castro Human Services Center at a
cost not-to-exceed one hundred and sixty thousand seven hundred seventy-two dollars
($160,772.00) as described in the CONTRACTOR'S Change Order Request No. 57 dated
November 12, 2012, and incorporated herein as Exhibit PP to the Agreement by this Fifth
Amendment; and
WHEREAS, this amount exceeds the ten percent (10%) contingency amount
approved with the original Agreement by $55,904.85; and
WHEREAS, on December 19, 2012, the City Council of the City of Moorpark
approved additional funding for these additional services, and
NOW, THEREFORE, in consideration of the mutual covenants, benefits, and
premises herein stated, the parties hereto AMEND the aforesaid Agreement follows:

I. Section 2 of the Agreement is amended to include:
Contractor's Scope of Services is amended to include the labor and materials
required to provide pre-fabricated sunshade sections that are pre-finished and engineered
to span the existing structural steel support system at the Ruben Castro Human Services
Center.
The Scope of Services for the installation of pre-fabricated, sunshade sections that
are pre-finished and engineered to span the existing structural steel support system at the
Ruben Castro Human Services Center are included in the CONTRACTOR'S Change
Order Request No. 57 dated November 12, 2012; attached hereto and incorporated herein
as Exhibit QQ to the Agreement by this Fifth Amendment.
II. Section 7 of the Agreement is amended to include:
CITY hereby increases the not-to-exceed amount of $2,287,632.96 under this
Agreement by $160,772.00 to $2,454,404.85.
III. Remaining Provisions
All other terms and conditions of the original Agreement shall remain in full force
and effect.

3. We specifically exclude coordination with other material suppliers and trades. Coordination provided at
customer's request would be provided at additional costs.
4. Order is to be produced as a single release. If required,partial releases or dedicated shipments can be included for additional

5. Airolite's General Exclusions: Sales and use tax(s),retainage,installation or erection,field measurements,unloading,
miscellaneous trim,structural supports,blank-off panels,anchors,fasteners,caulking,sealants,isolation of dissimilar materials,
dampers,registers,flashings and all other materials not specifically listed above.
Quotations:
Pricing is valid for ninety(90)calendar days without escalation. Orders placed after 90 days of quotation are subject to review and
re-pricing.
Shipments:
Orders shipped after nine(9)months from the date of order acceptance by Airolite will be subject to a monthly escalation fee of 1%
of order net sell price. Unless otherwise requested Airolite will provide standard and optimized packaging,crating,and shipping.
Special packaging requests require The Airolite Company,LLC's approval and additional fees will apply.
