SUBJECT: Consider Proposed Water Rate Increase Being Considered by the
Ventura County Waterworks District Board of Directors
BACKGROUND
In October 2010, the Ventura County Waterworks District No. 1 (District) issued a Notice of
Proposed Water Rate Increase (Notice) to all water users. The 10% increase, scheduled
to be heard by the Ventura County Board of Supervisors (Board) on December 14, 2010,
was described as passing through a recent 10% increase from Calleguas Municipal Water
District (Calleguas), the agency importing water to Ventura County. Because only about
72% of the District's water related expenditures are for water supply, staff felt that the 10%
increase being considered by the District should be for 7.2%. Also, the Notice stated the
10% increase would be effective on billings dated on or after January 1, 2011.
This matter was discussed at the December 1, 2010 City Council meeting and Council
directed staff to prepare a protest letter to the Board requesting a change in the
implementation date to affect water sold on or after January 1, 2011. At its December 14,
2010 meeting, the Board voted against the 10% increase and requested District staff to
return to the Board in January to discuss the ramifications of denying the 10% increase.
At the January 25, 2011 Board meeting, District staff stated that the budget would be in a
deficit, upwards of$200,000, by the end of Fiscal Year 2010/2011 without an increase in
water rates. The Board directed its staff to return on February 8, 2011 with a
recommendation for a new water rate increase proposal with and without changing the tier
allocation. As a result, on February 17, 2011, the District issued a new Notice of Proposed
Water Rate Increase (2011 Notice). The 2011 Notice proposes a 12%water rate increase
and a tier allocation adjustment.
DISCUSSION
Previously, City staff felt the proposed 10% increase did not appear necessary because
Calleguas implemented a 10% increase to the District for purchased water which is only
about 72% of the budget. City staff felt the District should be able to forego an increase on
the balance of its expenditures. However, after the January 25, 2011 Board meeting, staff

met with District staff on three separate occasions to discuss the methodology,
calculations, and strategies used when determining the proposed water rate increase.
Mayor Parvin and Supervisor Foy, as well as staff, attended a meeting of the Districts's
Citizen's Advisory Committee (Advisory Committee) on January 27, 2011. At that time, it
became clear that the District was spending down its Rate Stabilization Fund (RSF) to
stabilize rates and without a rate stabilization increase the RSF would be depleted by June
30, 2011. At this meeting, the Advisory Committee was reminded of its policies to maintain
a balance of$660,000 in the RSF by year end of each fiscal year (6/30). It also became
clear that the setting of rates on a calendar year basis due to the timing of rate setting
decisions by Calleguas and the Metropolitan Water District of Southern California (MWD)
contributed to the depletion of the RSF and misunderstanding between City and District
staff. Through these detailed discussions, the explanations, provided by the District, that
were unclear in December became clear and are now understood by staff. An increase in
water rates that is at a percentage higher than that of the District's water related
expenditures seems unavoidable if the District is to maintain its RSF at around $660,000.
It is worthy to note, that potential alternate future water resources were also discussed at
these meetings. Presentations at the Board and Advisory Committee have made it clear
that the increase in water costs by MWD and Calleguas are a result of not only reduced
supply and related price increases but deferred maintenance of facilities and the need for
new capital investments by both entities. These latter factors have added to the projected
rate increases expected over the next decade. All parties agreed alternate future water
resources were vital to the community and may serve as a long range cost modifier for
future water rate increases.
The City's December 2010 protest letter to the Board requested a delay in implementation
allowing water users to adjust water usage prior to facing higher costs per unit of water
used. The implementation date under the October 2010 Notice, if it had been approved by
the Board, would have been effective on billings after January 1, 2011 which seemed to
affect water purchased during or before December 2010. As previously stated, this
increase was not approved. The City is now in receipt of the 2011 Notice stating that a
12% increase will take effect in May 2011, if approved by the Board. .A 12% increase in
rates implemented on May 1, 2011 would be the equivalent of an 8.4% annual increase.
The City may choose to protest the 2011 Notice in which case the City would prepare a
letter to the Board prior to the public hearing scheduled for 10:30 a.m. on April 5, 2011.
For residents, the 12% rate increase could result in a greater than 12% annual cost based
on the proposed changes to the tiers. For most users, it will require an approximate 20%
use reduction just to cap their increase at 12%.
Staff recommends not protesting the rate increase but suggesting that the Board delay
implementing the proposed tier changes until at least January 2012 to allow residents time
to prepare for the changes since most of their savings will probably have to be achieved on
exterior water use. This should be accomplished by further efforts by the District to
promote conservation including consideration of financial incentives.

FISCAL IMPACT
Without further reduction in water use, the proposed 12% rate increase would cost the City
approximately $18,000 in parks and landscaping subsidies from the General Fund and
approximately$12,000 in self-funded landscape assessment district zones for the affected
two months of Fiscal Year 2010/11. Because of ongoing conservation efforts, the City
should still spend within budget. Based on the current fiscal year budget, the annual cost
increase is estimated to be $108,000 from the General Fund and $72,000 in self-funded
landscape assessment district zones for Fiscal Year 2011/12. City staff is continuously
working on water conservation efforts and staff is optimistic that additional savings may be
achieved. In addition, in the near future, staff will present a report to Council addressing
additional measures to reduce water use for landscaping.
The tier allocation adjustment will result in an unknown increase to the water rates paid by
the City in recent years. In addition, the City would have to reduce water use by 20% to
avoid exceeding the current cost plus 12%. If the City does not reduce water use by 20%,
the rates will be assessed in a higher tier under the proposed tier allocation adjustment.
STAFF RECOMMENDATION
Direct staff as deemed appropriate.

NOTICE OF PROPOSED WATER RATE INCREASE
AND ALLOCATION ADJUSTMENTS
Ventura County Waterworks District No. 1
Ventura County Waterworks District No. 1 (District) provides water and sanitation services to the City of
Moorpark (City) and the contiguous areas to the north and west of the City limits. The District provides
local water from groundwater wells and imported water from the State Water Project, through
Metropolitan Water District (Metropolitan) and Calleguas Municipal Water District (Calleguas). The
District is responsible for providing an uninterrupted, reliable water supply meeting specific water quality
standards to District customers.
This notice is to inform you that a hearing will be held on Tuesday, April 5, 2011, at 10:30 a.m. in the
Board of Supervisors' Hearing Room in the Hall of Administration at the Ventura County Government
Center, 800 South Victoria Avenue, Ventura, to consider a proposed 12% water commodity rate
increase and adjustments to water allocations for District customers. If approved, the rate increase and
allocation adjustments would take effect on the utility bills issued in May 2011. At the hearing, any
person may be heard regarding the recommended rate increase.
Why is a rate increase needed?
The District operates as an enterprise fund, which means it is supported solely through the rates paid by
District customers. These rates provide the funding for efficient operations and maintenance of the
water system, imported water purchases, and Southern California Edison (SCE) charges related to
pumping local water.
Imported water costs to the District have increased 10% for calendar year 2011 (CY 11). In addition,
SCE rates have increased 5%, and the projected operations and maintenance costs for CY 11 have also
increased. The District's current Tier I rate is now less than the cost to purchase imported water, and
will not provide sufficient funds for the operation and maintenance of the District in CY 11. Therefore,
the District is recommending a water commodity rate increase and adjustments to the water allocations
in order to provide the revenue needed to continue to operate the water system and provide a reliable
water supply to District customers. A proposed rate increase, which was to be effective in January of
this year and for which you received an earlier notice, was deferred due to the Board's request for
additional analysis.
Why do imported water rates continue to increase so drastically?
The short answer is that the amount of water allowed to pass through the Sacramento Delta from
Northern to Southern California is limited, due to a federal judge's decision to protect the Delta smelt, an
endangered fish. Consequently, no matter how much rain or snowpack there is in the northern Sierras,
or how full the reservoirs are in Northern California, there is limited water supply available to Southern
California through the State Water Project. To make matters worse, the imported water supply from the
Colorado River has been greatly reduced due to the ongoing drought in the Colorado River Watershed.
Therefore, Metropolitan, the imported water supplier to Southern California, has pursued other sources
of water, which are more costly. In addition, Metropolitan continues to replace aging infrastructure, which
also impacts imported water rates.
Calleguas, the District's direct imported water supplier, purchases imported water from Metropolitan.
Calleguas is investing in projects to provide alternative sources of water supply to lessen its service
area's dependence on imported water. However, these projects will also be expensive, and are some
years away. On January 25, 2011, representatives from Calleguas and Metropolitan gave presentations
to the Ventura County Board of Supervisors regarding the current water supply situation and planned

Does the District have plans to develop additional local water supply, and will that impact future
rate increases?
The District is pursuing the Moorpark Desalter Project (Project) to produce additional local water supply
from currently unpotable (due to high levels of salts) groundwater. Developing additional local water
supplies will make us less dependent on imported water and should help to minimize future rate
increases. The Project, which is scheduled to be constructed by 2015, is dependent on the completion
of a Calleguas project to construct a brine line to carry the filtered salts to the ocean. Planning studies
for the Project are underway.
What is the rate review process?
The water rates are reviewed each year, after the District receives notice from Metropolitan and
Calleguas of their projected rate increases for the next calendar year, to determine whether a rate
increase is needed for the District. Before an increase is proposed and presented to the Ventura County
Board of Supervisors, the rate analysis is reviewed by the District's Citizens' Advisory Committee
(Advisory Committee) for input and recommendations to the Board. The Advisory Committee holds
regularly scheduled meetings, which are open to the public, on the second Thursday of each month.
The meetings are held at the District Office at 6767 Spring Road, Moorpark, at 3:30 p.m. At these
meetings, information is provided regarding operational issues and efficiencies in the District and the
status of District infrastructure. There are also frequent updates regarding the District's budget.
What happens if the proposed rate increase is not approved?
Should a rate increase not be adopted at this time, operations and maintenance of the water system
would be severely impacted, and the District would not be able to purchase the imported water that will
be needed in the current year. The District may be forced to impose water rationing, and higher rate
increases would be needed in the future.

If you oppose the proposed water rate increase and/or allocation adjustments, your protest must be
submitted in writing to be considered, even if you are planning to attend the public hearing. Your written
protest must be received by the Ventura County Clerk of the Board prior to the April 5, 2011 public
hearing.
Protests must contain the following information: 1) a description of the property, such as the Assessor's
Parcel Number; 2) your Ventura County Waterworks District No. 1 Account Number; 3) whether you are
the property owner of record or a lease holder. Please note that if you were not the owner of the
property as of Ventura County's last tax roll, please include written confirmation that you presently own
the property; and 4) indication that the water rate increase is being protested. You may send your written

Ventura County Waterworks District No. 1 (District) provides water and sanitation services to the City of
Moorpark and the contiguous areas to the north and west of the city limits. The District provides local
water from groundwater wells and imported water from the State Water Project, through Metropolitan

Southern California is facing an unprecedented series of challenges to its water supply:
• A federal court has curtailed water deliveries from Northern California due to environmental
factors in the Sacramento-San Joaquin Delta.
• California has been experiencing drought conditions since 2007. Furthermore, the runoff
from the 2009 snowpack was below normal.
• The Colorado River, the other major source of imported water supply for Metropolitan, is
experiencing a protracted multi-year drought.
Consequently, Southern California's water supply has been severely impacted.
In response, Metropolitan is securing other sources of water at a greater cost. Metropolitan's actions
to provide a reliable water supply to this region are increasing Metropolitan's water rates substantially.
To offset the f:"--tropolitan rate increase, Calleguas is passing through the rate increase to its-
purveyors, including the District, effective January 1, 2011. The District's imported water costs are
increasing by 10% in calendar year 2011. In addition, Southern California Edison (SCE) will be
increasing their rates by approximately 5% in 2011.
The District's water rates have been reviewed to determine the impact of the Metropolitan/Ca:i-3guas
and SCE rate increases. It has been determined that the increases cannot be absorbed by the
District's current operating budget. Therefore, we are recommending a 10% increase in the Tier I
commodity rate. Tier II and Tier III commodity rates will be increased per the District's Rules and
Regulations. The rate increase is recommended based on a water rate analysis that showed the
higher rate is necessary to cover the District's cost of providing an uninterrupted supply of high quality
water to District customers. We are not recommending any increase in the service charge at this time.
The District's last water rate increase of 16% was approved in December 2009, and implemented in
calendar year 2010.

Water conservation today is more important than ever. Due to continuing pumping restrictions to protect
A-dangered fish, Metropolitan is again requiring all water suppliers throughout Southern California to reduce
,r water consumption by 15% of their historical average this fiscal year (July 1, 2010 through June 30, 2011).
Therefore,we are asking all of our customers to continue their efforts to conserve and reduce their water usage.

Director of Water and Sanitation Department of the Public Works Agency, explaining the reasons

the City Council feels that a 10% rate increase is not justified especially in the current economic
situation and such increase should not be applied to the approximate 30% portion of the cost not

In the event the Board adopts the Proposed Increase on December 14, 2010, the City urges the
Board to reconsider the implementation date. To implement the Proposed Increase on utility bills
beginning in January 2011, which includes water services in November and December of 2010 -
a period of time pre-existing the adoption of the Proposed Increase, sends the wrong message to
water users. Many of those users, like the City, are already trying to do more with less and have
worked to reduce their water use by an overall average of 22%.
