SUBJECT: Consider Authorization of Recordation of the Notice of Completion for
New Restroom at Glenwood Park
BACKGROUND
At the meeting on September 1, 2010, City Council awarded an agreement to Bottenfield
Construction, Inc., in an amount not to exceed $238,910 to provide construction of a new
restroom at Glenwood Park. Additionally, the Council authorized the City Manager to
execute agreements with Pacific Materials Laboratory, Inc. (PML), Picon, Inc. (Phil Vein),
and Martinez Architects.
DISCUSSION
The work began on December 1, 2010, and was completed on March 1, 2011, for a total
cost of $316,742. The estimated restroom construction cost was $340,527. No change
orders were required. The only additional cost was $5,215 to Pacific Materials Laboratory for
providing continued masonry inspections of block and grout installation instead of random
checks provided for in the original proposal.

With the Council's authorization to record the Notice of Completion, the City Clerk's Office
will be authorized to release the project bonds in accordance with provisions as follows:

• Payment Bond # WCN1255980 shall be released six (6) months after recordation of
the Notice of Completion.
• Performance Bond # WCN1255980 shall be released one (1) year after recordation of
the Notice of Completion.
FISCAL IMPACT
There is no fiscal impact.
STAFF RECOMMENDATION
1. Authorize the City Clerk to file the Notice of Completion for the project;
2. Authorize the release of the balance of payment due to the Contractor in accordance
with the agreement and City acceptance of completion of all contractual obligations
and all required close-out documents, on the part of the contractor, or 55 days after of
Notice Completion records, whichever occurs later;
3. Release the Performance Bond one year after Recordation of Notice of Completion in
accordance with the agreement and completion of contractual obligations on the part
of Contractor; and
4. Release the Payment Bond six months after Recordation of Notice of Completion in
accordance with the agreement and completion of contractual obligations on the part
of Contractor.
