SFHAs are developed by FEMA flood mapping procedures and indicate areas that may experience one foot or more of flooding due to a 100-year storm event. Flood insurance is mandatory for properties with a mortgage and with a structure located within an SFHA. FEMA periodically updates the DFIRMs to reflect changes in the SFHAs due to land development, flood protection improvements, and updated ground elevation and hydrologic data. In 2005, DFIRM updates by FEMA significantly increased the area of SFHAs within the City, impacting many Moorpark property owners with the requirement to purchase flood insurance. The DFIRM updates have indicated that the Arroyo Simi and Walnut Canyon Drain, both under the jurisdiction of the Ventura County Watershed Protection District (VCWPD), are the main sources of potential flooding in the City. The City has successfully appealed to FEMA to revise the DFIRMs thereby removing over 850 residential and commercial properties from the 100-year flood zone. This meeting is a public workshop to present the revised flood maps in a forum where the public can ask specific questions related to flood zones and flood insurance. The City's consultant and representatives from FEMA and VCWPD will be in attendance at the meeting. BACKGROUND In 2005 FEMA updated the DFIRMs covering the County of Ventura including the City of Moorpark. The flood zone maps covering the City were previously revised in September SAPublic Works\Everyone\Reports\Staff Reports\2011\larch\03-24-2011 LOMR Public Meeting.doc 1 Honorable City Council March 24, 2011 Page 2 1986 (Attachment 1) and included approximately 50 structures within the 100-year flood zone. In September 2005, the City received the preliminary updated DFIRMs (Attachment 2) which showed approximately 1,600 structures newly added into the revised 100-year flood zone requiring flood insurance for most of these property owners. The following is a chronology of subsequent events involving the DFIRM revisions. • September 2005 to January 2008 — The City appealed the 2005 DFIRMs and FEMA accepted the appeal as warranted. The limits of the floodway were reduced and approximately 520 structures were removed from the 100-year flood zone. Approximately 170 homes were added to the 100-year flood zone in the Butter Creek Road, Harvester Street and Maureen Lane areas. • June 2008 — FEMA determined that the levee owned by Villa Del Arroyo Mobile Home Park was not acceptable for certification and approximately 240 homes in this area were added to the revised DFIRM 100-year flood zone. • July 2009 — FEMA finalized the City's appealed DFIRM and notified the City of its approval with an effective date of January 20, 2010 (Attachment 3). The final revised DFIRM added approximately 1,300 structures (including the 240 mobile homes) to the 100-year flood zone as compared to the 1986 map where there were approximately 50 structures located in the 100-year flood zone. • November 2, 2009 —A public meeting was held to address concerns regarding the City's DFIRM appeal and flood insurance requirements. • November 21, 2009 — City Council appropriated $100,000 from the General Fund Reserve to hire a consultant to submit Letter of Map Revisions (LOMR's) to FEMA to remove as many residential structures from the 100-year flood zone as possible. • February 5, 2010 — A contract was executed with MR Consulting (MRC) in an amount of $79,000 to process LOMR's as necessary to remove residential structures from the 100-year flood zone. • March 23, 2010 — FEMA approved a LOMR submitted by VCWPD removing all 240 residential structures within the Villa Del Arroyo Mobile Home Park from the 100-year flood zone. • March 2010 to June 2010 — MRC collected data and analyses used in the preparation of the 2010 DFIRM from VCWPD, City of Moorpark and FEMA. MRC also made field visits to obtain speck data. MRC performed hydraulic analyses and found differences between the computer generated model developed by FEMA and the actual field conditions. SAPublic Works\Everyone\Reports\Stat7 Reports\2011\larch\03-24-2011 LOMR Public Meeting.doc 2 Honorable City Council March 24, 2011 Page 3 • June 14, 2010 — The City submitted a formal LOMR request to FEMA with a copy submitted to VCWPD for review and concurrence. • September 15, 2010 — VCWPD signed a Letter of Acknowledgement concurring with the City's request for LOMR. • November 2010 — Supplemental field survey data was gathered and submitted to FEMA in an effort to maximize the number of residences to be removed from the 100-year flood zone. Notices of specific changes to the floodway and base flood elevations were sent to eight property owners as required by FEMA prior to the approval of the LOMR. Three of these properties are located at the end of Maureen Lane and will have their structures removed from the floodway, as well as all of the structures located on two properties at the southeast corner of Spring Road and Los Angeles Avenue (Chevron and Moorpark Plaza). Two residential properties on Justin Court (off of Harvester Street) received notices that their property will be located in the 100-year flood zone as a result of the LOMR. The final notice went to the property located just north of the Arroyo Simi on the west side of Spring Road (AC Construction and RV storage) since the limits of the floodway on this property will increase as a result of the LOMR. However, the structure on this property which is currently in the 100-year flood zone will not be affected by the increase to the floodway. • January 28, 2011 — FEMA issued the approved LOMR and revised DFIRMs with an effective date of June 13, 2011 to accommodate a statutory 90-day appeal period and filing of federal records. DISCUSSION Upon the effective date of June 13, 2011, the approved LOMR and revised DFIRMs will remove approximately 861 residential and commercial parcels from the current 100- year flood zone with approximately 241 parcels remaining (Attachments 4 and 5). All parcels in the entire Butter Creek Road area and the area north of Los Angeles Avenue, south of Poindexter Avenue and west of Spring Road constitute the majority of the parcels to be removed from the 100-year flood zone. All parcels remaining in the 100-year flood zone were originally located in the flood zone shown on FEMA's 2005 DFIRMs, and the 2010 DFIRM with the exception of two residences on Justin Court. These two properties were originally located in the flood zone on the 2005 DFIRM, removed on the 2010 DFIRM and now added back to the flood zone as a result of the current LOMR. Additional measures are planned to determine if approximately 80 of the 241 parcels remaining in the 100-year flood zone may qualify to be removed from the 100-year SAPublic Works\Everyone\Reports\Staff Reports\2011\larch\03-24-2011 LOMR Public Meeting.doc 3 Honorable City Council March 24, 2011 Page 4 flood zone or be eligible for lower flood insurance premiums. These measures include 1) a LOMR currently in coordination with VCWPD for the Walnut Canyon Road, Charles Street and Walnut Street area (approx. 52 parcels); and 2) ground elevation surveys on individual lots in the Harvester Street, Elderberry Avenue, Justin Court area (approx. 25 parcels) and the Villa Campesina Avenue area (approx. 3 parcels). The other approximately 161 parcels remaining in the 100-year flood zone are located in the area on the west side of Spring Road between the Arroyo Simi and Los Angeles Avenue, and in the area east of Spring Road, north of Los Angeles Avenue, south of Princeton Avenue and west of the 118 Freeway. On March 7, 2011, notifications were mailed to all 1,102 residential and commercial property owners indicating the effect of the LOMR on their property and encouraging them to attend the public meeting on March 24, 2011, at 6:30 p.m. at City Hall. The notifications contained a sentence in Spanish with a City contact number to call if assistance with the letter in Spanish was desired. The LOMR and revised flood maps are posted on the City's website along with links to flood zone information on FEMA's website. All questions and concerns regarding flood insurance policies, premiums and refunds are being directed to FEMA flood insurance personnel. FISCAL IMPACT The City Council has previously appropriated $100,000 from the General Fund Reserve to fund the efforts to remove as many residences from the 100-year flood zone as possible. STAFF RECOMMENDATION Direct staff to present a summary of this March 24, 2011, public meeting to the City Council for consideration on April 6, 2011.
