Bobardt, Community Development Director DATE: March 23, 2011 (CC Meeting of 4/6/2011) SUBJECT: Consider a Resolution Updating Staff Billing Rates, Deposits, and Fees for Development Processing by Adding a Reduced Fee for An Administrative Permit for Relocation of a Business with an Existing Administrative Permit to a New Address and Rescinding Resolution No. 2010-2972 BACKGROUND/DISCUSSION On March 17, 2010, the City Council adopted a comprehensive new fee resolution for development processing. This fee resolution increased Administrative Permit fees to address increased complexity of Administrative Permits due to changes in the Zoning Ordinance. The current fee for a residential Administrative Permit is $780 (6 hours staff time) and the current fee for a commercial or industrial Administrative Permit is $1,300 (10 hours staff time). These fees are based on actual processing time required for these permits. It has recently come to the attention of staff that under the existing fee resolution, businesses with Administrative Permits looking to relocate would be subject to the same fees as new businesses, even if they are moving next door in the same shopping center. A reduced fee of $390, based on 3 hours of staff time to review an application, prepare and send notices, and prepare a decision letter, is recommended for Administrative Permits for businesses with existing Administrative Permits that are simply relocating to a new address. Under the draft resolution attached, this reduced fee would not be available for businesses that are 1) expanding by more than 50% as part of the relocation, 2) changing the nature of the business, or 3) selling alcoholic beverages, as such cases would require additional staff review time. This reduced fee would also not be available if a different permit (i.e. Conditional Use Permit) is required for the business at the new location. Because this resolution involves a reduction in an existing fee, noticing and delay of implementation under Government Code Sections 66016 and 66017 is not required and the reduced fee could take effect immediately. 73 Honorable City Council April 6, 2011 Page 2 ENVIRONMENTAL DOCUMENTATION The Community Development Director has determined that the proposed updating of the fee schedule for land use development processing fees is exempt from the provisions of the California Environmental Quality Act (CEQA), in that the action of the City Council does not involve the consideration of the approval of a project. FISCAL IMPACT The fees are based on a recovery of costs associated with the processing of permits. The reduced fee for the transfer of an Administrative Permit to a new address is reflective of the reduced time needed to process the application. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) Adopt Resolution No. 2011- , adding a reduced fee for an Administrative Permit for relocation of a business with an existing Administrative Permit to a new address and rescinding Resolution No. 2010-2972. SACommunity Development\ADMIN\Fees\Entitlement Deposits\Agenda Reports\cc 110406.doc 74 RESOLUTION NO. 2011- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING STAFF BILLING RATES, DEPOSITS, AND FEES FOR DEVELOPMENT PROCESSING BY ADDING A REDUCED FEE FOR AN ADMINISTRATIVE PERMIT FOR RELOCATION OF A BUSINESS WITH AN EXISTING ADMINISTRATIVE PERMIT TO A NEW ADDRESS AND RESCINDING RESOLUTION NO. 2010-2972 WHEREAS, the City of Moorpark provides land use development review services; and WHEREAS, the City Council has determined that the cost of these services shall be offset by fees which accompany land use entitlement requests; and WHEREAS, Resolution No. 2010-2972 does not address a fee for the processing of an Administrative Permit for a business with an existing Administrative Permit that is relocating to a new location, which, when not involving the sale of alcoholic beverages, requires less staff time than the processing of an Administrative Permit for a new use; and WHEREAS, the reduced fee proposed for Administrative Permits for businesses with existing Administrative Permits that are relocating to a new address is not a new fee or an increase in an existing fee subject to the noticing and hearing process under Section 66016 of the Government Code and the delay in implementation under Section 66017 of the Government Code; and WHEREAS, the City Council concurs with the Community Development Director's determination that the proposed reduced fee for an Administrative Permit for a business relocation is exempt from the provisions of the California Environmental Quality Act (CEQA), in that the action of the City Council does not involve the consideration of the approval of a project. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. City of Moorpark staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost accounting rate per Exhibit A of this Resolution. SECTION 2. Contract services shall be billed at cost, plus fifteen percent (15%), including, but not limited to, City Attorney; geotechnical/geological services, landscape architect review and inspection services; lighting engineer review and inspection services and planning consultant services. 75 Resolution No. 2011- Page 2 SECTION 3. The Schedule of Development Processing Deposits and Fees is adopted as shown in Exhibit B of this Resolution. SECTION 4. The Community Development Director has the authority to reduce deposit amounts up to fifty percent (50%) per entitlement application, where the project involves multiple applications for the same project on the same property, to be processed concurrently. The applicant retains the responsibility to pay for all costs associated with the processing of the applications at the adopted billing rates. SECTION 5. This Resolution shall become effective immediately. SECTION 6. Resolution No. 2010-2972 is hereby rescinded upon the effective date of this Resolution. SECTION 7. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 6th day of April, 2011.
