SUBJECT: Consider Update Report on Corrected Unmet Requirements Identified in
the Americans with Disabilities Act (ADA) Transition Plan Adopted by
City Council on June 16, 2010
BACKGROUND AND DISCUSSION
Access to civic life by people with disabilities is a fundamental goal of the ADA. To ensure
this goal is met, Title II requires State and local governments to make their programs,
services, and activities accessible to persons with disabilities. All public entities, regardless
of size, must comply with Title II's requirements. Title II of the ADA requires all cities to
perform self - evaluations of programs and services provided by the cities to determine
whether ADA requirements are being met. Should the self - evaluations reveal unmet
requirements, cities must make modifications to comply with those unmet requirements.
Whenever a city with fifty or more employees determines the need for modifications, that
city must develop an ADA Transition Plan to delineate parameters for those modifications.
The City of Moorpark (City) adopted an ADA Transition Plan and Self- Evaluation (ADA
Plan) on June 16, 2010. The ADA Plan identified unmet requirements to be corrected over
a three -year period of time. The majority of the suggested corrections listed are for
facilities and parks that, when originally built, were considered by the City to be in
compliance with ADA standards.
Staff prioritized the modifications so that a large number of modifications could be
completed on a short timeline. The Fiscal Year 2009/10 budget appropriated $69,140 for
these modifications, which included the $60,000 ADA walkway to playground equipment at
Arroyo Vista Community Park project. The budget for Fiscal Year 2010/11 appropriated
$66,020 for corrections and approximately $34,000 is expected to be appropriated in Fiscal
Year 2011/12 and beyond, until all modifications are met.
The City has steadily corrected the majority of the unmet requirements identified in the
ADA Plan. To date, the City actually spent $68,195 for corrections in Fiscal Year 2009/10,
is expected to spend $23,315 for corrections in Fiscal Year 2010/11, and anticipates

spending $23,705 for corrections in Fiscal Year 2011/12. At the end of Fiscal Year
2011/12 all unmet requirements identified in the City's self - evaluation are expected to be
either corrected, found to be in compliance upon a second inspection, or onerous.
Onerous, in this instance, does not necessarily mean that the City does not intend to make
the correction. Rather, the City cannot currently justify the costs of the onerous corrections
in the foreseeable future due to budget constraints. An example of such a high cost would
be the necessity of reconfiguring restroom fixtures or walls to allow certain clearances in a
restroom stall. The stall may be large enough in which to adequately turn a wheelchair, but
may not measure the ADA requirement of 55" wide.
The overall cost estimate for all corrections made between Fiscal Year 2009/10 and Fiscal
Year 2011/12, has decreased and the decrease may be attributed to several reasons. One
reason is the cost estimates of corrections versus the actual costs of the corrections. Most
of the actual correction costs closely matched the cost estimates but in some cases were
less than the cost estimates. A second reason is that some of the unmet requirements
identified in the ADA plan were found to be in compliance. Therefore, those costs were
deleted. Third, some of the corrections scheduled in one fiscal year were completed in a
different fiscal year, or will be, and this rescheduling, though not impacting the overall
costs, affected the fiscal year cost. Another reason for the decrease is explained by unmet
requirements becoming associated with a Capital Project, as is the case with the Arroyo
Vista Recreational Center (AVRC) parking lot to building pedestrian and curb ramp
requirements. The costs were deleted from the ADA Plan since ADA requirements were
included in the entire $100,000 project.
Finally, several correction costs turned out to be far too low due to certain aspects not
considered in the initial cost estimates and are now considered. Revisiting the example
previously described, a park restroom at which it was initially thought the restroom stalls
could be reconfigured at a relatively low cost was found to need wall and fixture
reconfiguration at a much higher cost. Because these unmet requirements are not
currently scheduled for correction, the associated costs were deleted from the overall cost
estimate for the three -year span of the initial corrections.
As reported at the time the ADA Plan was adopted, a $60,000 playground walk way project
was included in the costs even though the components of the project were not identified as
unmet requirements in the ADA Plan because it was a new project that enhanced
accessibility. During Fiscal Year 2010/11, the City replaced the handrails for the stage in
the Apricot Room and installed exterior handrails at the Library, neither of which were
required by the ADA Plan but enhanced accessibility. Enhancing accessibility beyond ADA
requirements demonstrates the City's commitment to providing people with disabilities
access to civic life.

FISCAL IMPACT
The original cost estimate, at the time the ADA Plan was adopted by Council in July 2010,
for full implementation was estimated to be $169,160. The revised cost estimate is
expected to be $115,215.
