Bascom, Inc. dba Precision Plumbing-Mechanical for Additional Work to Install an Offsite Storm Drain Connection for the Ruben Castro Human Services Center on Spring Road BACKGROUND & DISCUSSION The Ruben Castro Human Services Center Commercial Planned Development Project (Project) was approved by the City Council on May 21, 2008. The Project was bid as a multiple-prime construction project with construction management provided by Barnhart Balfour-Beatty. Bids from prime contractors were received in October, 2010, and fourteen trade contracts were awarded by the City Council on January 19, 2011. Concurrently with the award of the trade contracts, the City Council also approved a $2,700,000 Special Projects Fund loan for the Project. The contract for Site Utilities and Building Plumbing was awarded to John S. Bascom, Inc., dba Precision Plumbing-Mechanical (Precision Plumbing) in the amount of $767,223 plus a ten percent contingency. To date, Amendment No. 1 in the amount of $13,242 for removal of an existing waterline has been issued. Precision Plumbing's total contract amount is presently $780,465. Grading of the Project site commenced in February, 2011, with heavy rains experienced throughout March. These rain storms revealed the existing drainage conditions where water flows off of the Union Pacific Railroad property to the north, ponds along the Project boundary, then spills across the sidewalk and onto Spring Road. Prior to the Project grading operations, the storm water drainage ponded and spread out over the site and seeped into the undeveloped ground without causing the current problem of 1 Honorable City Council November 2, 2011 Page 2 drainage onto Spring Road. A storm drain connection from Spring Road to the Project is necessary to pick up storm water flows from the Railroad property and the Project. During the design phase of the Project, HMC Architects and the Project Civil Engineer, AMEC, LLC, were directed by the previous City Engineer/Public Works Director not to provide a storm drain connection in Spring Road; instead, storm water was to be conveyed by surface drainage means only. The rains experienced at the beginning of construction demonstrated that the previously approved design is problematic. Field and engineering research was conducted to collect data, and analyze the source and possible solutions to the drainage conditions. The Project survey consultant collected and mapped topography data, and RJR Engineering was engaged by the City to analyze the survey results and prepare two offsite storm drain alignment alternatives for a storm drain connection to Spring Road. The two alternatives include: 1) extension of a storm drain pipe southward on the east side of Spring Road with a connection to an existing storm drain at the intersection of Flinn Avenue and Spring Road (Attachment 1); and, 2) extension of a storm drain pipe from the Project across Spring Road with a connection to an existing reinforced concrete box drain on the west side of the street (Attachment 2). Both alternatives would include installation of pipe under the existing Police Services Center driveway and a catch basin on the driveway's south side. This new catch basin will improve the drainage of Spring Road in this area which tends to be a problem when it rains. To reach the new connection point, a storm drain pipe would be added to the Project site design by the Project Civil Engineer, AMEC, to convey water from the north side of the site to the proposed offsite storm drain in Spring Road. Since the Project is already well under construction and this storm drain connection would provide a more suitable drainage alternative to the site (as well as alleviate existing drainage issues on Spring Road), the design alternatives prepared by RJR Engineering were provided to Precision Plumbing for submission of preliminary cost proposals for construction of the Spring Road storm drain connection. However, as this work is beyond the scope of Precision Plumbing's contract price, this work would require an amendment to their contract separate from the ten percent contingency amount ($76,722) included as part of their contract. The preliminary cost proposals (Attachments 3 and 4) submitted by Precision Plumbing for construction of Alternatives #1 and #2 are shown below: Alternative #1 (connection at Flinn Ave. & Spring Rd.): $241,736.71 Alternative #2 (connection on west side of Spring Rd): $143,946.49 Based on a review of the proposed alternative designs and associated pricing, staff recommends Alternative #2. Staff also recommends that an asphalt overlay of the northbound lanes of Spring Road from Flinn Avenue to just south of the railroad be 2 Honorable City Council November 2, 2011 Page 3 included with the offsite storm drain installation project. The asphalt overlay will further improve the drainage of storm water on this segment of Spring Road. The cost for the asphalt overlay is estimated to be $50,000. In order for RJR Engineering to complete construction drawings for this alternative, additional field work is required to pothole the existing infrastructure and obtain existing utility elevations. Precision Plumbing has submitted a proposal in an amount not-to- exceed $35,000 for potholing the existing utilities associated with Alternative #2. Separate amendments for the potholing and storm drain and asphalt overlay construction are required since the potholing must be done first under Amendment No.2 to determine the final storm drain design. The storm drain and asphalt overlay construction cost will be refined under Amendment No. 3 based on the final design. The following figure illustrates the additional fee proposal necessary for the potholing and construction of the offsite storm drain connection and overlay: Total current contract through Amendment No. 1 $780,465 Amendment No. 2 Task #1 — Potholing existing utilities for Alternative #2 $35,000 Amendment No. 3 Task #2 — Preliminary construction cost of Storm Drain $143,946 Alternative #2 Task#3 —Asphalt Overlay, northbound Spring Road $50,000 20% Contingency for final design $39,000 Total Amendment No. 3 Amount $232,946 Total New Contract Amount $1,048,411 FISCAL IMPACT The adopted Fiscal Year 2011/12 Capital Improvement budget for the Ruben Castro Human Services Center Project (Project 5020) includes a $2,700,000 loan from the Special Projects Fund 4004, $1,771,941 of which is currently encumbered by the 3 Honorable City Council November 2, 2011 Page 4 Project. There is $918,915 of unencumbered funds in the current project budget to pay the proposed $268,000 increase. STAFF RECOMMENDATION (ROLL CALL VOTE) 1. Approve a storm drain connection in Spring Road for the Ruben Castro Human Services Center using proposed Storm Drain Alignment#2. 2. Authorize the City Manager to execute Amendment No. 2 and No. 3 to the construction agreement with Precision Plumbing-Mechanical in an amount of not-to- exceed $35,000 and $233,000 respectively subject to final language approval by the City Manager and City Attorney. Bascom, Inc., a California corporation, dba Precision Plumbing- Mechanical, a California corporation, hereinafter referred to as "CONTRACTOR". WITNESSETH: WHEREAS, on February 25, 2011, the CITY and the CONTRACTOR entered into an Agreement for site utilities and building plumbing for the Ruben Castro Human Services Center; and WHEREAS, on May 2, 2011, the CITY and the CONTRACTOR executed a First Amendment in an amount not-to-exceed thirteen thousand two hundred forty-two dollars ($13,242.00) for the removal of an existing abandoned 8-inch waterline at the Ruben Castro Human Services Center site increasing the total not-to-exceed amount to seven hundred eighty thousand four hundred sixty-five dollars ($780,465.00); and WHEREAS, the CITY wishes to further amend the Agreement to include the potholing of existing utilities in support of final design for construction of an offsite storm drain connection in Spring Road for the Ruben Castro Human Services Center at a cost not-to-exceed thirty-five thousand dollars ($35,000.00) as approved by the City Council at the November 2, 2011 meeting and described in Exhibit "D" and attached hereto as part of this Second Amendment; and WHEREAS, this amount is in addition to and separate from the ten percent (10%) contingency amount approved with the original Agreement. NOW, THEREFORE, in consideration of the mutual covenants, benefits, and premises herein stated, the parties hereto AMEND the aforesaid Agreement follows: I. Section 2 of the Agreement is amended to include: Contractor's Scope of Services is amended to include the materials and labor needed to pothole the existing utilities in Spring Road associated with Alignment #2 to be designed to provide an offsite storm drain connection for the Ruben Castro Human Services Center. The Scope of Services for the utility potholing is described and depicted in the Proposal dated October 20, 2011, and attached hereto and incorporated herein as Exhibit D to the Agreement by this Second Amendment. I1. Section 7 of the Agreement is amended to include: CITY hereby increases the not-to-exceed amount of $780,465.00 under this Agreement by $35,000.00 to $815,465.00. III.
