SUBJECT: Consider Agreement Amendment with Azteca Landscape for
Landscape Maintenance Services for Poindexter Park Expansion
Project
DISCUSSION
On Saturday, December 5, 2009, California Skateparks Inc. concluded all
construction requirements at Poindexter Park expansion and the new 2.3 acre
addition opened to the public. On December 5, California Skateparks Inc. was
relieved of the skate park and all hardscape area responsibilities per the construction
contract and continued their 90 -day maintenance period that began on November 18,
2009, maintaining all irrigation and plant material.
The split of responsibilities required to maintain the park expansion required Azteca,
the City's current park landscape maintenance contractor for landscape maintenance
services at Poindexter Park, to be contracted for the balance of the 90 -day
maintenance period to supply skate park and hardscape maintenance. Azteca's
landscape services for the skate park and hardscape areas began on December 7,
2009, at $300.00 a month, concluding on February 22, 2010. The in -house
landscape services provided by California Skateparks Inc. will continue to maintain
irrigation and planted material until February 22.
The 90 -day maintenance period with California Skateparks Inc. will end February 22,
2010. Staff requested a price proposal from Azteca Landscape Services to add the
Poindexter Park 2.3 acre expansion project area. Azteca Landscape Services
provided a proposal of $750.00 per month to add the 2.3 acre park expansion to the
park Landscape Contract. Staff included sufficient funds in the FY 2009/10 budget for
the additional landscape services. It is anticipated that the City will assume full
maintenance responsibility on February 22, 2010.

FISCAL IMPACT
Park maintenance is funded from the City's Park Maintenance Fund, comprised of
revenues from the Park Improvement and Maintenance Assessment budgets. Since
the assessment does not generate sufficient revenue to offset expenses, the City
uses General Fund monies in the amount of approximately $1.2 million. With the
assumption of maintenance responsibility for the Poindexter Park expansion, the
General Fund contribution to the Park Maintenance Fund will increase.
Staff anticipated the Poindexter Park expansion increase in maintenance service cost
and increased FY 2009/10 budget to manage the increased cost. The FY 2009/10
budget appropriated an additional $6,000 for five (5) months to accommodate the
increased maintenance services for the park expansion. The FY 2009/10 budget
increased from $20,200 to $26,200, to incorporate the additional landscaped
maintenance service costs.
Poindexter Park's current monthly fee of $1,650 will increase by $750, for a total of
$2,400 per month. The total increase to Azteca for the current fiscal year is $3,900:
$810 for the California Skateparks current 81 -day maintenance period balance, and
then $3,000 for the four remaining months of FY 2009/10. Poindexter Park's annual
cost of $19,800 will increase to $23,700.
FY 2010/11, Azteca's Agreement for park landscape maintenance services will
increase by 2% ($2,448), increasing Poindexter Park's annual cost from $23,700 to
$29,376.
STAFF RECOMMENDATION
Approve an amendment to the City's Agreement with Azteca Landscape to include
services at Poindexter Park, and authorize the City Manager to execute said
amendment.

AMENDMENT NO. 2
AGREEMENT BETWEEN THE CITY OF MOORPARK
AND AZTECA LANDSCAPE FOR PARK LANDSCAPE
MAINTENANCE SERVICES
THIS AMENDMENT TO AGREEMENT, made and entered into this day
of 2009, in the County of Ventura, State of California, by
and between the City of Moorpark, a municipal corporation (hereinafter "City ") and,
Azteca Landscape (hereinafter "Contractor ").
WHEREAS, on March 5, 2008, the Moorpark City Council awarded an
agreement to Contractor for park landscape maintenance services after conducting a
competitive bid process;
WHEREAS, the City now desires to expand the landscape areas to be
maintained by Contractor; and
WHEREAS, City and Contractor have met to discuss, and mutually agreed to
the amendment as described herein, and now wish to document said agreement by
jointly approving this amendment to the aforementioned Agreement.
NOW, THEREFORE, it is hereby agreed by and between the parties that:

Exhibit C of Agreement, is hereby amended as identified in Exhibit A -1 of this
Amendment, attached hereto and made a part hereof. Said areas to be
maintained by Contractor have hereby expanded on March 5, 2010, to include:
1) Poindexter Park expansion and Skate Park, 500 Poindexter Avenue.
II. Compensation
Exhibit D of Agreement, is hereby amended as identified in Exhibit B -1 of this
Amendment, attached hereto and made a part hereof. Monthly compensation
to the contractor shall increase to include the landscape service areas
identified in Section 1 of this Amendment as follows:
1) Poindexter Park monthly fee is $1,650, (One thousand six hundred fifty
dollars) will increase by $750 (Seven hundred fifty dollars) to $2,400 per
month in FY 2009/10, and $2,448. (Two thousand four hundred forty -eight
dollars) per month in FY 2010/11.

III. Remaininq Provisions
All other provisions of the aforesaid Agreement shall remain in full force and
effect.

be executed the day and year first above written.
