SUBJECT: Consider a Resolution Adjusting Real Time Billing Rates, Updating
the Schedule for Land Use Development Processing Fees and
Rescinding Resolution No. 2006-2502
BACKGROUND/DISCUSSION
City Council Policy Resolution 2009-2811 (Policy No. 3.6) calls for annual review of all
City fee resolutions by each City department in conjunction with the preparation of the
next fiscal year budget to determine if an adjustment of any fee is appropriate. The
most recent update of fees (and deposits) for land use development entitlement
processing and establishment of real time billing rates occurred in 2006. Since that
time, staff's billing rates have changed based on cost of living adjustments totaling
6.08% over the past four years. The fee schedule is proposed to be updated to reflect
these changes in City costs and to ensure that fees represent the actual cost of the
service provided. Attachment 1 provides a comparison of the fee/deposit schedule
adopted per Resolution No. 2006-2502 and the proposed fee/deposit schedule. In
accordance with California Government Code Section 66016, which sets forth the
notification and hearing process required prior to levying new fees or services charges,
or prior to increasing an existing fee or service charge, notice of this City Council public
meeting has been mailed and published.
The draft resolution (Attachment 2) provides the details of the proposed billing rate and
fee adjustments. Staff is proposing the new fees to take effect on July 1, 2010 with the
start of the new fiscal year. This would provide at least sixty (60) days following the
adoption of the resolution, as required by Government Code Section 66017.
Changes to the Zoning Ordinance in recent years have reduced the level of review for
several common land use entitlements from Planning Commission and/or City Council
reviewed Conditional Use Permits and Planned Development Permits (with deposits
against which staff time would be charged) to Community Development Director

reviewed Administrative Permits (with a much lower flat fee). This has increased the
complexity of the review of Administrative Permits, which used to be for very minor
entitlements such as room additions. Staff has analyzed the actual time needed for the
processing of Administrative Permits and is recommending higher fees for each of these
permits to account for the increased time needed to process these applications. The
increases of $180.00 for residential Administrative Permits (from $600.00 to $780.00)
and $700.00 for commercial/industrial Administrative Permits (from $600.00 to
$1,300.00) reflect staff time needed for processing these applications. This is still a
substantial savings in costs from reviews that previously required public hearings before
the Planning Commission and/or City Council.
In addition, the sign regulations, comprehensively updated in 2005, now involve a
greater amount of staff time for sign review. This is particularly true for shopping center
sign programs, which are not specifically addressed in the current fee resolution.
Increases of $65.00 (from $135.00 to $200.00) for sign permit application review and
$645.00 (from $135.00 to $780.00) for sign program application review are proposed to
reflect actual costs. The permit fee for temporary signs and banners is proposed to be
reduced by $10.00 (from $90.00 to $80.00) as these permits are now being
administered at the Code Compliance Technician II level, with a related lower staff cost.
ENVIRONMENTAL DOCUMENTATION
The Community Development Director has determined that the proposed adjusting of
real time billing rates, updating the schedule for land use development processing fees
is exempt from the provisions of the California Environmental Quality Act (CEQA), in
that the action of the City Council does not involve the consideration of the approval of a
project.
STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED)
1. Open the public hearing, take public testimony and close the public hearing; and
2. Adopt Resolution No. 2010- , approving adjustments to real time billing rates,
updating the schedule of land development preliminary processing fees, and
rescinding Resolution No. 2006-2502 upon the effective date of the Resolution.

RESOLUTION NO. 2010-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, UPDATING STAFF BILLING RATES,
DEPOSITS, AND FEES FOR DEVELOPMENT PROCESSING
AND RESCINDING RESOLUTION NO. 2006-2502
WHEREAS, the City of Moorpark provides land use development review
services; and
WHEREAS, the City Council has determined that the cost of these services shall
be offset by fees which accompany land use entitlement requests; and
WHEREAS, the City of Moorpark staff costs are charged against fees, based
upon real time cost accounting; and
WHEREAS, staff costs increased over the past four years; and
WHEREAS, it is necessary to update the hourly rates for staff performing land
use development review services and the associated schedule of development
processing deposits and fees.
WHEREAS, the City Council concurs with the Community Development Director
determination that the proposed adjustments to real time billing rates and development
processing deposits and fees is exempt from the provisions of the California
Environmental Quality Act (CEQA), in that the action of the City Council does not
involve the consideration of the approval of a project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. City of Moorpark staff shall bill actual time spent on land use
applications and other items eligible for cost recovery at a real time cost accounting rate
per Exhibit A of this Resolution.
SECTION 2. Contract services shall be billed at cost, plus fifteen percent
(15%), including, but not limited to, City Attorney; geotechnical/geological services,
landscape architect review and inspection services; lighting engineer review and
inspection services and planning consultant services.
SECTION 3. The Schedule of Development Processing Deposits and Fees is
adopted as shown in Exhibit B of this Resolution.
SECTION 4. The Community Development Director has the authority to reduce
deposit amounts up to fifty percent (50%) per entitlement application, where the project
involves multiple applications for the same project on the same property, to be

processed concurrently. The applicant retains the responsibility to pay for all costs
associated with the processing of the applications at the adopted billing rates.
SECTION 5. This Resolution shall become effective on July 1, 2010.
SECTION 6. Resolution No. 2006-2502 is hereby rescinded upon the effective
date of this Resolution.
SECTION 7. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
