City Council Meeting of 4-Al-9010 ACTION: MOORPARK CITY COUNCIL AGENDA REPORT TO: The Honorable City Council FROM: Tom Kruse, Parks and Recreation Director Prepared By: Jeremy Laurentowski, Landscape and Parks Superintendent DATE: April 7, 2010 (CC Meeting of April 21, 2010) SUBJECT: Consider Approval of College View Dog Park Proposed Design Plan, Amenities, Rules, and Budget BACKGROUND The southern most section of College View Park has been previously recommended by the Parks and Recreation Commission and approved by the City Council for the City's first dog park. The proposed project site is bounded on the south by the 118 freeway west bound off-ramp, on the east by an existing parking lot (former College View Avenue), and on the west by Collins Drive. The area consists of a passive turf area, mature eucalyptus and pine trees, an unused turf volleyball court and parking. The proposed site is completely within the existing Caltrans right-of-way. The City currently has a lease agreement and encroachment permit for continued use of the Caltrans site. Staff has discussed the current lease agreement with Caltrans and has determined that the proposed use is within substantial compliance of the outlined terms and conditions. Several below and above ground utilities transect the proposed site. Staff has contacted all relevant utility companies and has confirmed that there are no utility conflicts with the dog park location. Staff has presented the College View Dog Park proposed design plan, amenities, rules, and budget to the Parks and Recreation Commission on three separate occasions (January 11, February 1, and March 1, 2010). During the February 1, 2010, Parks and Recreation Commission meeting, several concerns about the proposed dog park were raised by two City of Moorpark residents. The concerns were in regards to the size of the dog park, proximity to residential homes, and adequacy of the existing parking lot. In addition, there was a concern that several of 17 Honorable City Council April 21, 2010 Page 2 the proposed amenities were too close to the entrance of the dog park and that additional dog waste disposal stations should be added to the plan and dispersed throughout the site. During the February 1, 2010, Parks and Recreation Commission meeting, the Commission discussed in detail the park selection process and concluded that the College View Park location was the largest and most suitable location currently available in Moorpark. The Proposed design plan addresses the concerns raised by the City residents and the Parks and Recreation Commission. During the March 1, 2010, Parks and Recreation Commission meeting, the College View Dog Park was placed on the Consent Calendar and was approved as presented. DISCUSSION Staff is proposing to install a dog park that will accommodate both small and large breed dogs. The approximate 0.6 acre dog park will consist of two separate fenced-in areas for unleashed play, with a separate staging area to prevent dogs entering the park from interacting with dogs that are leaving. The dog park will consist of five foot height chain link fencing, decomposed granite walkways, self shut-off hose bibs, bench seating, pet waste disposal stations, trash receptacles, open play areas, and park rules signage. The site amenities have been purposely located away from the park entry locations to reduce congestion as dogs enter and exit the park areas. In addition, several dog waste disposal stations have been dispersed throughout the site. Staff is proposing a total of seven pet waste stations. Four will be located within the large breed dog park and three within the small breed dog park. In addition to providing waste disposal bags, each pet waste disposal station will be installed with a moderately sized waste disposal container. Staff has also included two recycle bins for glass, aluminum, and plastic recycling. One bin will be located in each dog park area. Each dog area will be installed with a hose bib where owners can fill their dog's water bowl. Two hose bibs will be located within the large breed dog park and one within the small breed dog park. Each hose bib will be located within an 8' gravel basin with sump drain. Staff has adequately sized the basins to minimize water intrusion into the adjacent areas, keeping pedestrian access dry. The basins are also adequately sized to allow for multiple water bowls to be placed within each basin. Staff is proposing to remove the existing turf and replace the turf with wood chips provided by the City's contract tree trimming company (West Coast Arborists). In addition to saving approximately 840,000 gallons of water a year (approximately $5,200), staff has determined that the maintenance cost that the City will save from reduced mowing and fertilization will equal the increased maintenance costs 18 Honorable City Council April 21, 2010 Page 3 associated with maintaining the dog park, such as trash and waste removal and the occasional replenishing of wood chips. Staff has visited several local dog parks and has completed an internet survey and has determined that the installation of wood chips in lieu of turf is common practice, as turf maintenance in high use areas can be costly. In addition, staff is proposing to utilize the existing 5' height chain link fence on the south and west side of the project site. The existing chain link fence was installed by Caltrans and is currently used to discourage pedestrian access to Hwy 118 and the west bound off-ramp/Collins Drive intersection. Staff has discussed utilizing the existing fence as the dog park boundary with Caltrans and has received a verbal approval for its continued use. FISCAL IMPACT Staff has prepared a preliminary installation budget for the proposed project and has determined that the $15,000 appropriated for the dog park by City Council in the FY 2009/2010 Park Improvement Zone 2 Fund is not sufficient for the standard program elements required for the dog park. Staff has determined that a total of 148 labor hours will be required to install the dog park. 19 Honorable City Council April 21, 2010 Page 4 The Park Improvement Zone 2 Fund (2112) has a total of $138,996 appropriated in the current fiscal year for the design and construction of handball wall ($25,000) at Campus Canyon Park and the following improvement projects at College View Park: basketball court lighting project ($23,996), dog park ($15,000) and replacement of tot lot equipment and swings ($75,000). The basket ball court lighting project was completed under budget in 2009 with $5,016 in savings. To date, there is $119,850 available appropriation for the remaining projects. Staff recommends utilizing the surplus $5,016 from the Basketball Court Lighting Project, the $15,000 appropriated for the dog park and $29,196 from the fund to replace the tot lot equipment. Staff has obtained informal bids for the new tot lot equipment and has determined that the remaining balance of $45,804 will be sufficient to replace the tot lot equipment this fiscal year. At the beginning of the current year, Park Improvement Zone 2 Fund (2112) reported a $122,728 fund balance surplus. It is estimated to receive $1,000 in revenues and incur about $68,192 in expenditures by year end. The expenditures include the total project cost of the dog park. The projected fund balance surplus at the end of the year is $55,536. No increase in appropriation is requested. STAFF RECOMMENDATION 1. Approve the College View Dog Park proposed design plan, amenities, and rules, and 2. Approve the budget and use of funds from the Park Improvement Zone 2 Fund. ATTACHMENT D City of Moorpark Dog Park Rules HOURS OF OPERATION Open 7:00 a.m. to 5:00 p.m. Pacific Standard Time/7:00 pm Pacific Daylight Savings Time. The Dog Park will be closed every Wednesday from 7:00 a.m. to 12:00 p.m., except holidays, for maintenance. USER AGE REQUIREMENTS No children under 16 years of age are allowed without adult supervision. No children under 6 years of age are allowed. USER ASSUMES ALL RISK Enter at your own risk. Adults and children assume all risks associated with a leash-free Dog Park. USE REQUIREMENTS All dogs must display current valid license, be properly inoculated, healthy (no contagious conditions), and parasite-free. Violations are subject to a citation in accordance with Moorpark Municipal Code (MMC) Section 6.16.010 and 6.20.010. Dogs shall be kept on a leash (not exceeding 6') when outside the Dog Park fence at all times. Do not have your dog unleashed between your vehicle and gated entrance. Leash and unleash your dog inside the double-gated holding area, not inside the Dog Park. All dog owners must carry a leash, but no dogs shall be leashed once inside the park. All dogs must wear a collar with current tags. Holes dug by dogs must be filled. Dogs 29 pounds or less shall use the Small Dog Play Area. Dogs 30 pounds or more shall use the Large Dog Play Area. Dogs left unattended at the Dog Park shall be impounded by Animal Control. Close supervision of your dog is required. Mutt Mitts are provided. Owners must clean up after their pets and dispose dog feces in the provided dog waste receptacles located throughout the park. When leaving the park, please remove all tennis balls, toys or other personal items, or they will be discarded. 26 Suggestion: Dog owners are responsible and liable for any other dog that escapes the Dog Park while entering or exiting. PROHIBITED ACTIVITIES No air horns or bullhorns. No food of any kind is allowed inside the Dog Park, including people food. No smoking. Female dogs in heat are prohibited from entering the park. No puppies under four months of age, due to their vulnerability to disease and injury. No grooming of dogs. No commercial use of this facility is allowed, including solicitation and advertisements for pet services. No pinch or spiked collars. No private classes or lessons. Four(4)dogs per user is the maximum allowed inside the Dog Park. People may not run,jump or engage in other active recreational activities within the Dog Park. DOG PARK CONDITIONS AGGRESSIVE DOGS must be removed from the Dog Park area IMMEDIATELY without debate. You are responsible for your actions and those of your dog. Aggressive dogs may be banned for appropriate periods of time. Aggressive dogs are defined as either vicious or dangerous dogs, as designated in the California Food and Agricultural Code 31601-02-03. Furthermore, an aggressive dog is defined as any dog that is determined by the City of Moorpark to pose a threat to dogs or people by virtue of a single incident or history of unprovoked acts of aggression against people or animals. Violation of the Food and Agricultural Code carries penalties not to exceed $1000. City reserves the right to close the Dog Park for any reason, at anytime, including City sponsored programs and maintenance. All other City Ordinances, Rules, and Regulations apply and will be enforced at the Dog Park. VIOLATIONS ARE SUBJECT TO A CITATION IN ACCORDANCE WITH MMC SECTION 1.10.020.
