SUBJECT: Consider a Resolution Authorizing Submittal of a Used Oil
Payment Program Application to the California Department of
Resources Recycling and Recovery (CalRecycle)
SUMMARY
The City Council is being asked to consider a resolution approving the submittal of the City's
annual Used Oil Payment Program (OPP Cycle 1)Application,formerly the Used Oil Block
Grant, to the California Department of Resources Recycling and Recovery (CalRecycle),
formerly the California Integrated Waste Management Board.
DISCUSSION
In 1993 the City began receiving Used Oil Recycling Block Grants and began a Used Oil
recycling program. The grants were administered by the California Integrated Waste
Management Board (CIWMB)with the main goal to provide funding to local governments in
order to establish and maintain used oil collection programs that encourage recycling of used
motor oil.
Used motor oil is recycled through Certified Used Oil Collection Centers and the City monthly
Household Hazardous Waste (HHW) collection events. Moorpark residents have the
opportunity to attend 36 days of HHW events annually; the second Friday and Saturday of
each month in Camarillo, and the third Saturday of every other month in Simi Valley. Two
certified centers in Moorpark, Jiffy Lube and Autozone, accept a maximum of five(5)gallons
of used oil per person, per day free of charge.
The Used Oil Block Grant program is being replaced by the Used Oil Payment Program in
2010. This new program will be a payment program rather than a reimbursable grant and
should be easier to manage. The funding will continue to be distributed on a per capita
basis. It is anticipated that the City of Moorpark will continue to receive approximately$3,000
annually. The grant administrators at the CalRecycle have the authority to determine if grant

funds can be used for a particular activity. Approved uses include purchasing equipment,
contaminated oil disposal, overhead costs, staff time, public information, promotional items,
and NPDES activity related to preventing disposal of used motor oil into the environment.
City will use the grant funds for a balanced mix of all the approved expense categories. The
grant application must contain an approved resolution from each applicant's governing body
authorizing submittal of the application and identifying the individual(s) authorized to
executive any agreements, contracts, and requests for payments. The resolution will be
included with the application.
FISCAL IMPACT
Funding for the used oil program is budgeted in the Solid Waste and Recycling Division and
expenditures will be offset by the Used Oil Payment Program if the grant application is
funded.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF A
USED OIL PAYMENT PROGRAM APPLICATION TO THE
CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND
RECOVERY, AND AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS
FOR PAYMENT
WHEREAS, the City of Moorpark recognizes that it is in the public interest to
enact and implement an integrated waste management plan to address the state's
diminishing landfill space and the potential adverse environmental impacts from
inappropriate disposal of waste materials including used oil; and
WHEREAS, Public Resources Code Sections 48690 et seq. authorize the
California Department of Resources Recycling and Recovery (CalRecycle), formerly
known as the California Integrated Waste Management Board, to make payments to
qualifying jurisdictions for implementation of their used oil programs as required by PRC
§ 48690 et seq.; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the administration of the Used Oil Payment Program; and
WHEREAS, CalRecycle's procedures for administering the Used Oil Payment
Program require, among other things, an applicant's governing body to declare by
resolution certain authorizations related to the administration of the Used Oil Payment
Program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Moorpark authorizes submittal of
applications, agreements, annual reports including expenditure reports and
amendments necessary to secure said payments to support our Used Oil Collection
Program until rescinded by the City Council of the City of Moorpark.
SECTION 2. The City Manager; Administrative Services Director; Administrative
Services Senior Management Analyst; or a designee named by the City Manager, is
hereby authorized and empowered to execute in the name of the City of Moorpark all
necessary applications, contracts, payment requests, agreements and amendments
hereto for the purposes of securing grant funds and to implement and carry out the
purposes specified in the grant application.

SECTION 3. The City Clerk shall certify to the adoption of the resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
