Walter, Landscape/Parks Maintenance Superintendent` DATE: June 23, 2010 (Meeting of July 7, 2010) SUBJECT: Consider Amending Venco Western, Inc., and Azteca Landscape, Inc., Park Landscape Maintenance Agreements SUMMARY On March 5, 2008, the City Council awarded a 26-month (May 1, 2008 through June 30, 2010) Agreement to Azteca Landscape for park landscape maintenance and awarded a 26-month (May 1, 2008 through June 30, 2010) Agreement to Venco Western for parkway, slope, and median (cityscape) landscape maintenance. Each of the Agreements provided the City and Contractor, by mutual agreement, the option of extending the term of the respective Agreement for up to three (3) additional one-year (1) terms. DISCUSSION The City's two existing landscape maintenance agreements with Azteca and Venco Western are set to expire June 30, 2010. Staff desires to extend the term of the Agreements for one year. Venco Western's services Agreement term will be extended one year to June 30, 2011, with the provisions of the April 2, 2008, Agreement remaining in full force and effect. Azteca Landscape's services Agreement term will also be extended one year to June 30, 2011. In addition, Azteca Landscape's services Agreement's Scope of Work provisions will be amended, reducing mowing from 48 to 24 times per year. This will reduce compensation by $21,715.20 annually. 260 Honorable City Council July 7, 2010 Page 2 The remaining provisions of the April 2, 2008, Agreement with Azteca Landscape will remain in full force and effect. Staff is requesting a one-year extension to these Agreements to give staff time to develop modified performance and scope of work requirements. FISCAL IMPACT The City Council has previously approved the appropriation for these services as part of the adoption of the FY 2010/11 Budget. The proposed action does not require any additional funding. STAFF RECOMMENDATION Authorize the City Manager to execute Amendment No. 3 to the Agreement with Azteca Landscape Maintenance Services and Amendment No. 3 to the Agreement with Venco Western Landscape Maintenance Services, consistent with this report subject to final language approval by the City Manager and the City Attorney. 261
