S.: • . - Maureen Benson, City Clerk BY: `rR, X 42 -a-s DATE: July 1, 2016 (CC Meeting of 7/6/16) SUBJECT: Consider Resolution Amending City Council Resolution No. 2016-3513 (Requesting the Board of Supervisors of the County of Ventura to Permit the County Clerk to Render Services to the City of Moorpark Related to the Conduct of a General Municipal Election to be Held on November 8, 2016, and to Canvass the Returns of the General Municipal Election)to Replace Exhibit A (Request for Specified Election Services) in its Entirety, and Including Reconsideration of Selecting Print the Full Measure Text in the Sample Ballot for the Moorpark Save Open-space and Agricultural Resources - 2050 Initiative (Moorpark SOAR - 2050) Ordinance BACKGROUND/DISCUSSION At the City Council's June 15, 2016 meeting, the Council adopted the November 8, 2016 Election resolutions, which included adoption of Resolution No. 2016-3513 (Requesting the Board of Supervisors of the County of Ventura to Permit the County Clerk To Render Services to the City of Moorpark Related to the Conduct of a General Municipal Election to be Held on November 8, 2016, and to Canvass the Returns of the General Municipal Election). Resolution No. 2016-3513 includes as Exhibit A the County Elections Division Form, Request for Specified Election Services. Several pages for Exhibit A were inadvertently not included in the draft resolution provided with the June 15 agenda report, and that error needs to be corrected (see attached resolution with a revised Exhibit A). Additionally, this week staff received a revised estimate for election costs for the SOAR Ordinance election services. The earlier estimate was for$7,000, and that is the amount that was included in the Fiscal Year 2016-17 Budget that was adopted by the City Council on June 15, 2016. The new cost estimate received from the County Elections Division yesterday is $14,000 for the SOAR Ordinance, and the additional cost is for printing the entire ordinance in the sample ballot book. What we also confirmed today from the County's Assistant Registrar of Voters is that Moorpark was the only City that had requested full printing of a SOAR Ordinance in the sample ballot book. The State Elections Code does not require printing the entire initiative ordinance in the sample ballot book. Section 9223 of the Elections Code requires that a copy of the ordinance or measure shall be made available to any voter upon request. While Moorpark has more commonly printed an initiative ordinance in the sample ballot book than not, the printing costs continue to increase, and there are other ways to make 75 A Honorable City Council July 6, 2016, Regular Meeting Page 2 an initiative ordinance available, such as posting the initiative ordinance on the City website, making the ordinance available at the public counter at City Hall and at the Moorpark Library, and emailing and/or mailing the ordinance consistent with a voter request. Any requested copy would be made available at no cost to the voter. Staff is recommending not printing the SOAR Ordinance in the sample ballot book, and the revised Exhibit A that is included with the attached draft Resolution includes this edit on the first page of Exhibit A, in Item #2, Sample Ballot Publication, "B. Full Measure Text will not be printed in the Sample Ballot." Language is required to be included in the Sample Ballot that informs the voter how to obtain a copy of the ordinance. FISCAL IMPACT If the Council decides to not have the full text of the initiative measure printed in the Sample Ballot consistent with the attached revised Exhibit A, the additional cost estimate of approximately $7,000 would be avoided. If the Council decides to select Item #2, Sample Ballot Publication, "A. Print Full Measure Text.", an additional estimated cost of$7,000 would require staff to schedule a future agenda item to request a Budget amendment. STAFF RECOMMENDATION Adopt Resolution No. 2016- amending Resolution No. 2016-3513 to replace Exhibit A in its entirety, consistent with the agenda report attachment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That Resolution No. 2016-3513 is hereby amended and Exhibit A is hereby replaced in its entirety with the revised Exhibit A attached to this resolution. SECTION 3. That the City Clerk of the City of Moorpark is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the County Clerk of the County of Ventura. SECTION 4.
