SUBJECT: Consider Resolution Adopting Hours of Operation for Lighted Park
Facilities
BACKGROUND
Ordinance 439 amending Chapter 12.16, Parks and Open Space, of the Moorpark
Municipal Code (MMC) will become effective on August 19, 2016. The ordinance
includes section 12.16.020, Hours of operation. Previously, specific hours of operation
for lighted and unlighted park facilities were stated in this section, as follows: "A park
with exterior' lighted park facilities or structures, including but not limited to tennis courts,
softball fields, or basketball courts, shall be closed from ten (10:00) p.m. to six (6:00)
a.m. Security lighting for parking lots and walkways is not considered lighted park
facilities or structures for the purposes of this chapter. A park or open space without
lighted facilities or structures shall be closed from sunset to six (6:00) a.m."
Ordinance 439 removes these specific hours of operation for lighted and unlighted park
facilities and amends this section to state: "Parks and open space shall be closed from
sunset to six (6:00) a.m., unless otherwise approved by city council. The city council
may by resolution approve more or less restrictive hours of operation for a specific park
and for certain facilities or structures, including restrooms, and the amended hours of
operation for the park or facility shall be indicated by appropriate signage."
Currently, resolutions have been adopted for operating hours for park restrooms
(resolution 2011-3005), the dog park (resolution 2010-2947), and the skate park
(resolution 2009-2846). The revisions to section 12.16.020 require a resolution also be
adopted in order for lighted park facilities to remain open past sunset.
DISCUSSION
Attached is a draft resolution establishing hours of operation for lighted park facilities. -
Lighted park facilities include tennis courts, basketball courts, athletic fields, ballfields,

and parking lots at parks that have lighted park facilities. Facilities such as restrooms
and pavilions which may have security lighting are not considered lighted facilities for
the purpose of this resolution. The hours of operation for lighted park facilities will be
from 6:00 a.m. to 10:00 p.m., with the exception that from sunset to 10:00 p.m., lighted
facilities will be closed when the lights are not in use.
The resolution gives the City Manager or his/her designee the authority to modify the
hours of operation for lighted park facilities in accordance with Section 12.16.020. The
resolution also states that notice of lighted park facility hours of operation shall be
posted at each lighted park facility in accordance with Section 12.16.030, Signs.
FISCAL IMPACT
Minor cost to purchase and post signs at lighted park facilities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ADOPTING LIGHTED PARK
FACILITY HOURS OF OPERATION
WHEREAS, Section 12.16.020, Hours of operation, of Chapter 12.16, Parks and
Open Space, of the Moorpark Municipal Code (MMC) states that parks and open space
shall be closed from sunset to six (6:00) a.m., unless otherwise approved by city council,
and that the city council may by resolution approve more or less restrictive hours of
operation for a specific park and for certain facilities or structures; and
WHEREAS, said amended hours of operation for the park or facility shall be
indicated by appropriate signage; and
WHEREAS, the City Council hereby determines that the hours of operation for
certain lighted park facilities shall be less restrictive than the hours of operation for unlit
park facilities.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Lighted park facilities shall be defined as outdoor tennis, basketball, or
other hard surface courts with coin-operated lights, athletic fields or ballfields with field
lights, trails and walkways with lighting specifically designed for active night time use, and
park parking lots with parking lot lights at parks with other lighted facilities. Restrooms,
playgrounds, picnic pavilions, parking lots at parks without other lighted park facilities, and
other such facilities which may have security lighting are not considered lighted park
facilities for the purposes of this resolution.
SECTION 2. The City Council hereby determines that lighted park facilities shall
open at 6:00 a.m. and shall close no later than 10:00 p.m., with the condition that between
the hours of sunset and 10:00 p.m., a lighted park facility shall be closed when the lights
associated with said facility are off. Between sunset and 10:00 p.m., walkways and trails
without lighting specifically designed for active night time use may be used only to go to or
from a lighted park facility.
SECTION 3. The City Manager or his/her designee may modify the hours of
operation for lighted park facilities in accordance with Section 12.16.020, Hours of
operation, of Chapter 12.16, Parks and Open Space, of the MMC.
SECTION 4. Notice of lighted park facility hours of operation shall be posted at each
lighted park facility in accordance with Section 12.16.030, Signs, of Chapter 12.16, Parks
and Open Space, of the MMC.

SECTION 5. This resolution shall become effective upon the effective date of
Ordinance 439 approving changes to Chapter 12.16, Parks and Open Space, of the MMC.
SECTION 6. The City Clerk shall certify to the adoption of this resolution and shall
cause a certified resolution to be filed in the book of original resolutions.
