CALL TO ORDER: Mayor Parvin called the meeting to order at 6:48 p.m. 2. ROLL CALL: Present: Councilmembers Lowenberg, Mikos, Millhouse, Van Dam, and Mayor Parvin. Staff Present: Steven Kueny, City Manager; Joseph Montes, City Attorney; Hugh Riley, Assistant City Manager; Barry Hogan, Deputy City Manager; David Bobardt, Planning Director; and Maureen Benson, Assistant City Clerk. 3. PUBLIC COMMENT: None. 4. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 5. CONSENT CALENDAR: MOTION: Councilmember Mikos moved and Mayor Parvin seconded a motion to approve the Consent Calendar. The motion carried by unanimous voice vote. A. Consider Approval of a Real Property Agreement between Essex Portfolio L P and the City of Moorpark Reoarding Acquisition of Land for Vehicular Access to the U.S. Post Office. Staff Recommendation: Approve the Agreement, subject to final language approval by the City Manager and City Attorney, and authorize the City Manager to sign the Agreement. 6. CLOSED SESSION: Mr. Kueny requested the City Council go into closed session for discussion of three cases under Item 6.B. and Item 6.C. 000043 Minutes of the City Council Moorpark, California Page 2 March 18 2009 MOTION: Councilmember Millhouse moved and Councilmember Mikos seconded a motion to adjourn to closed session for a discussion of three cases under Item 6.6. and Item 6.C. on the agenda. The motion carried by unanimous voice vote. The time was 6:50 p.m. B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to Subdivision (c) of Section 54956.9 of the Government Code: (Number of cases to be discussed — 4) C. CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Pursuant to Government Code Section 54956.8) Property: APN 500-0-120-065; 500-0-170-135; 500-0-180-125, 145, 175, 195, 205, 215, 225, 235, 255; 500-0-281-165; 500-0-292-075, 135, 215, 225; 615-0-110-115, 185, 195, 205, 215; 615-0-150-185, 195; 500-0-180- 135, 155, 165, 185, 245 City Negotiator: Steven Kueny, City Manager Negotiating Parties: City of Moorpark, Strathearn Ventura Partners; HCR Investors Moorpark, LLC; Hidden Creek Ranch; Nature Trust of the Santa Monica Mountains Under Negotiation: Price and terms of payment AT THIS POINT in the meeting, Ms. Benson left the meeting. The time was 6:50 p.m. Present in closed session were Councilmembers Lowenberg, Mikos, Millhouse, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Joseph Montes, City Attorney; Hugh Riley, Assistant City Manager; Barry Hogan, Deputy City Manager; and David Bobardt, Planning Director. The Council reconvened into open session at 7:14 p.m. Mr. Kueny stated three cases under Item 6.13. and Item 6.C. were discussed and there was no action to report. 7.
